(a) 
Equal employment opportunity shall be assured in the city service and affirmative action provided in its administration. Discrimination against any person in recruitment, examination, appointment, training, promotion, retention, discipline, or any other aspect of personnel administration because of political or religious opinions or affiliations, membership or nonmembership in employee organizations or unions, or because of race, color, national origin, marital status, or other nonmerit factors, is prohibited. The consideration of age, sex, or physical disability in any employment decision is prohibited except where specified age, sex, or physical condition constitute a bona fide occupational qualification necessary for proper and efficient operation.
(b) 
The city affirmative action program is amended to the extent of any conflicts with the affirmative action program and policies attached to Ordinance No. 79-23 as Exhibit A (on file and available for public inspection in the office of the city secretary) and included herewith the same as if fully set forth in the body of this section, and the same is hereby ordained.

Ordinances effecting the plan for participation in the TMRS, employee contributions, updated service credits, increases in benefits, supplemental benefits, supplemental death benefits and retirement annuities and any other applicable legislation of the city and state are adopted by reference into this Code of Ordinances as if fully set forth herein and shall be kept on file in the office of the city secretary.
