The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Person with disabilities
means any person who has a physical or mental impairment that substantially limits one or more major life activities, has a record of such an impairment, or is regarded as having such an impairment.
Physical or mental impairment
includes, but is not limited to:
(1) 
Any physiological disorder or condition, cosmetic disfigurement, or anatomical loss affecting one or more of the following body systems: neurological; musculoskeletal; special sense organs; respiratory, including speech organs; cardiovascular; reproductive; digestive; genitourinary; hemic and lymphatic; skin; and endocrine.
(2) 
Any mental or physiological disorder such as mental retardation, organic brain syndrome, emotional or mental illness, and specific learning disabilities.
(3) 
Such diseases and conditions as orthopedic, visual, speech and hearing impairments, cerebral palsy, epilepsy, muscular dystrophy, multiple sclerosis, cancer, heart disease, diabetes, mental retardation, emotional illness, drug addition, and alcoholism.

No qualified person with disabilities as defined herein shall, solely by reason of his handicap, be excluded from participation in, be denied benefits of, or be subjected to discrimination under any program, service, or activity conducted by the city.

(a) 
In an effort to ensure accessibility by persons with disabilities to all programs, services, activities and facilities of the city, it is hereby enacted that:
(1) 
No formal or contractual relationships will be established by the city with any agency, organization, and the like, that has the effect of discriminating against qualified persons with disabilities.
(2) 
Any qualified person with disabilities desiring to participate in any service, program, or activity of the city and requiring auxiliary aids to accommodate special problems of persons with disabilities may request the city to provide such aids subject to their availability. The request must be made through the city secretary's office no less than 72 hours prior to the day of the city function for which aid is requested.
(3) 
A plan of structural alterations has been compiled by the city's public services director (Exhibit A, which is on file and available for inspection in the city secretary's office) to eliminate inaccessibility in facilities where city programs, services, and activities are conducted.
(4) 
A plan of nonstructural changes has been developed by Section 504 of the Rehabilitation Act of 1973, with persons with disabilities coordinator to improve accessibility of city services and programs (Exhibit B which is on file and available for inspection in the city secretary's office).
(b) 
In the event a qualified person with disabilities has reason to believe he has been denied benefits of, been excluded from participation in, or been subjected to discrimination under any program, service, or activity, by reason of his status as a person with disabilities, the city has adopted a grievance procedure for resolution of such complaints.

The Section 504 Grievance Procedure incorporated herein by reference as Exhibit A (on file in the office of the city secretary) is hereby adopted, in compliance with Section 504 of the Rehabilitation Act of 1973, as amended (29 USC 794) and pursuant to 31 CFR 51.55(d)(2).
