Service charges as established in the city fee schedule in chapter 18 for the collection and disposal of all garbage, brush/yard waste and trash within the city limits by the city, being fair and reasonable, are hereby provided for the following:
(1) 
Single-family residential unit.
Monthly fee for single-family unit as housed in a single-family residence structure for twice a week pick-up.
(2) 
Multifamily residential unit.
Multiple unit residential structures, whether duplex or apartment:
a. 
With less than eight units: Monthly, per unit, for twice a week pick-up.
b. 
With more than eight units and sharing a large container (three cubic yard or 300 gallon) by the city: Monthly fee, per unit, for twice a week pick-up.
(3) 
Mobile home residential unit.
Mobile home parks, subdivisions, recreational vehicle parks and others:
a. 
With more than eight units sharing a large container (three cubic yard or 300 gallon) by the city: Monthly fee, per unit, for twice a week pick-up.
b. 
With individual garbage container: Monthly fee, per unit, for twice a week pick-up.
(4) 
Recreation vehicle residential unit.
Monthly fee, or fraction of month, for unit while occupied for twice a week pick-up.
(5) 
Commercial units.
a. 
The following enumerated commercial or industrial businesses, churches, public or private schools, public and charitable entities are defined as commercial units and shall be charged at the following monthly rates:
1. 
All retail, wholesale and industrial business establishments.
2. 
Office buildings.
3. 
Professional business and servicing businesses.
4. 
Hotels, motels, inns, roominghouses and boardinghouses, whether private, public or quasi-public.
5. 
Hospitals, public, private, charitable or otherwise.
6. 
Fraternal organizations, public or private clubs associations or organizations, whether for profit or nonprofit.
7. 
Residential apartment complexes, mobile home and R.V. Parks with more than eight units sharing a large container (three cubic yard or larger) may request commercial rates and be considered a commercial customer. Request must be submitted to the public works department in writing for processing.
8. 
All other charitable and/or other tax supported institutions:
(i) 
Base service rate: as established in the city fee schedule in chapter 18.
(ii) 
Using a three cubic yard city supplied container (includes base service rate), the following fees as established in the city fee schedule in chapter 18:
A. 
One pickup/week.
B. 
Two pickups/week.
C. 
Three pickups/week.
D. 
Four pickups/week.
E. 
Five pickups/week.
F. 
Six pickups/week.
G. 
Seven pickups/week.
(iii) 
Using a 300 gallon city supplied container (includes base service rate), the following fees as established in the city fee schedule in chapter 18:
A. 
One pickup/week.
B. 
Two pickups/week.
9. 
Establishments requiring containers larger than three cubic yards will be charged an additional monthly fee per cubic yard for each cubic yard larger than three cubic yards in addition to the fees established in subsections (5)a.8(iii) of this section.
10. 
Roll-off service:
(i) 
Per pull/haul-off.
(ii) 
Per ton.
(iii) 
Daily rental fee if not serviced more than twice per month.
11. 
Any and all other types of public or private concerns, organizations or institutions not otherwise herein provided for.
12. 
Regardless of size of container or number of collections, no commercial customer shall be charged less than the amount as established in the city fee schedule in chapter 18 per month for garbage collection services.
(6) 
Mandatory subscription.
From and after the effective date of the ordinance from which this section is derived, each family unit and commercial unit within the city limits shall be and hereby are required to subscribe to and use the services of the city for solid waste collection and disposal services.

Franchise required.
It shall be unlawful for any person or entity to engage in the collection of solid waste in the city without the express grant of a franchise to do so by the city.

Special pick-up rates as established in the city fee schedule in chapter 18 plus disposal fees, in the city fee schedule, per ton, or partial thereof, shall be charged for the collection of all heavy bulky waste items as specified in section 38-29(d)(2), and additional brush/yard waste collections as specified in section 38-39(d) and (e) and for request to collect a city issued garbage container apart from the regularly scheduled pick-up. The public works director or his representative, upon visual inspection, shall determine the special pick-up fee.

The service charges hereinabove provided for in section 38-69(a) and (b) are herewith declared to be and are herewith assessed and charged as incurred against and to be paid to the city by the head of each single-family household and each church in the city. The minimum monthly charge and billing as provided for in section 38-69(c) shall be assessed and charged as incurred against and to be paid by each enumerated entity in section 38-69(c); provided that this minimum monthly charge and assessment shall not be construed as affecting the computation, assessment, charge, and collection of the monthly charges in excess of the monthly minimum as provided for and actually incurred.

(a) 
All service charges provided for in this division shall be due and payable monthly not later than the tenth day of the month following the month for which such service is billed.
(b) 
Failure to pay such charges within 15 days from the first day of the month following the month for which billed shall authorize and empower the city to disconnect water service to the entity delinquent for such period of time in the payment of such garbage and trash collection monthly charge, with such terminated water service to continue until such delinquent garbage and trash collection charges are paid in full to the city. In the event of such disconnection of water service, the entity incurring the same shall pay an additional charge in advance to the city in the required amount to reconnect such water service, the same being to defray the expense incurred in such disconnection and reconnection. In the event persons occupying and using real property in the city not supplied with water service by the city fail to pay the monthly garbage and trash collection assessment charge for three cumulative months, the city shall thereafter discontinue garbage and trash collection and pickup service for such property. The city shall notify the user/occupant of such property by certified mail of such discontinuance by the city of such garbage and trash pickup and collection for such property and shall further advise the user of such real property that, henceforth, until such delinquent monthly garbage and trash pickup and collection charges are paid by such user, such user shall be responsible for the pickup and collection of the garbage and trash accumulating from such property and the delivery of same to the city burial and disposal site at intervals to be specified in such written notice and commensurate with the city's scheduled garbage and trash collection and pickup service to such property.
(c) 
Cumulative of all the foregoing, violation of any provision of this division shall constitute an offense and, upon conviction thereof, shall subject the violator to a fine as prescribed in section 1-7.
