For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ANIMAL CONTROL OFFICER or VACO
The person, persons or firm with whom the Borough shall contract to enforce certain provisions of this chapter. The Animal Control Officer must be certified by the state as an animal control officer and must maintain such certification in good standing during the entire term of the contract.
AT LARGE
Off the premises of the owner and not under the control of the owner or members of the owner's family, either by leash, cord, chain or otherwise.
CAT
Both male and female.
DOG
Both male and female, bitch or spayed bitch.
DOG OF LICENSING AGE
Any dog which has attained the age of seven months or which possesses a set of permanent teeth.
OWNER
Any person or persons, firm, property manager, partnership, association, corporation or organization of any kind who owns or has a right of property in such dog and/or cat or who has control and/or ownership in the premises where the dog and/or cat is kept or harbored.
PET SHOP
Any room or group of rooms, cage or exhibition pen, not part of a kennel, wherein dogs and/or cats for sale are kept or displayed.
POUND
Any establishment for the confinement of dogs and cats, seized either under the provisions of this chapter, the statutes of the state or otherwise.
A. 
Any person who shall own, as defined herein, keep or harbor a dog of licensing age in the Borough, in the month of January in each year, shall apply for and procure from the Borough Clerk a license and official metal registration tag for each such dog so owned, kept or harbored.
B. 
Any person who shall own, as defined herein, keep a cat of licensing age in the Borough, in the month of January in each year, shall apply for and procure from the Borough Clerk a license and official metal registration tag for each such cat so owned, kept or harbored.
C. 
Any person who owns or keeps a dog or cat of licensing age in the Borough, at all times while the dog or cat is off of the premises of such owner, shall have some form of identification either on the body of such dog or cat or within the control and possession of the person who has such dog or cat under his or her control. Such identification may be in the form of the metal registration tag provided by the Borough with the annual license, as computer identification chip installed on the body of the dog or cat or some other acceptable means of identification.
A. 
The person applying for a license pursuant to this chapter shall pay to the Borough Clerk the following license fee, which shall include the registration tag:
(1) 
For each dog which has not had its reproductive capacity altered through sterilization, the fee shall be an amount set annually by Borough Council. If payment is made after March 31, in addition to the license fee, a late fee as set annually by the Borough Council shall be assessed.
(2) 
For each dog which has had its reproductive capacity altered through sterilization, the fee shall be an amount set by Borough Council. If payment is made after March 31, in addition to the license fee, a late fee as set annually by the Borough Council shall be assessed.
(3) 
For each cat which has not had its reproductive capacity altered through sterilization, the fee shall be an amount set annually by Borough Council. If payment is made after March 31, in addition to the license fee, a late fee set annually by the Borough Council shall be assessed.
(4) 
For each cat which has had its reproductive capacity altered through sterilization, the fee shall be an amount set by Borough Council. If payment is made after March 31, in addition to the license fee, a late fee as set annually by the Borough Council shall be assessed.
B. 
Each license and tag shall be renewed annually, and for each annual renewal the person applying shall pay the same fee for the license and registration tag as hereinbefore provided. The licensing year for dogs and cats shall run from January 1st of each year through December 31st of the same year.
C. 
Dogs used as guides for visually impaired or hearing impaired persons and commonly known as "Seeing Eye" or "Hearing Ear" dogs shall be licensed and registered as other dogs hereinbefore provided for, except that the owner or keeper of such dog shall not be required to pay any license fee therefor.
D. 
Dogs or cats acquired after March 31.
(1) 
The owner or possessor of any dog of licensing age acquired after March 31 or of any dog which attains licensing age after March 31 shall make application for a dog license within 10 days of such acquisition or age attainment. Upon presentation of proof of the date of acquisition or age attainment, that person shall be required to pay the license fee only.
(2) 
The owner or possess or of any cat of licensing age acquired after March 31 or any cat which attains licensing age after March 31 shall make application for a license within 10 days after such acquisition or age attainment. Upon presentation of proof of the date of acquisition or age attainment, that person shall be required to pay the license fee only.
E. 
New residents shall make application for a license within 60 days of residency. Upon presentation of proof of the date of residency, new residents shall be required to pay the license fee only.
The completed application form furnished by the Borough Clerk, which, when signed by the Borough Clerk or Deputy Clerk, shall become the license for such dog and/or cat, shall state the breed, sex, age, color and markings of the dog or cat for which the license and registration are sought, whether the dog and/or cat is of a longhaired or shorthaired variety, the name, state and post office address of the owner and the person who shall keep or harbor such dog and/or cat.
Any dog or cat owned by a resident of the state, and duly licensed for the current licensing year by and bearing the proper registration tag for a New Jersey municipality, shall be exempt from the licensing and tag provisions of this section for the then current year.
Any person who shall bring or cause to be brought into the Borough any dog or cat licensed in a state other than New Jersey for the current licensing year, and shall keep the same in the Borough for a period of more than 90 days, shall immediately apply for a license and registration tag for such dog and/or cat.
Any person who shall bring or cause to be brought into the Borough any unlicensed dog or cat and shall keep the same in the Borough for a period of more than 10 days shall immediately apply for a license and registration tag for such dog and/or cat.
The owner of any newly acquired dog of licensing age, or a cat of licensing age, or of any dog which attains licensing age or cat which attains licensing age shall apply for a license and registration tag for such dog and/or cat within 10 days after such acquisition or age attainment.
