The Borough Clerk shall annually cause a canvass to be made of all dogs and cats owned, kept or harbored within the limits of the Borough. This census shall be completed in accordance with N.J.S.A. 4:19-15.16 and all reports made shall be as required under such statute.
No dog or cat shall be permitted off the premises of the person owning, keeping or harboring it unless accompanied by a person who is capable of controlling it and who has the dog and/or cat securely confined and controlled.
No person owning, keeping or harboring a dog or cat shall permit or suffer it to do any injury or damage to any lawn, shrubbery, flowers, grounds or property owned by any person or entity (including any condominium association or homeowners' association common area property) other than the property of the owner or person having the care, custody or control of such dog or cat.
A. 
The Chief of Police, every police officer, and the Animal Control Officer shall have the authority to take into custody and impound or cause to be taken into custody and impounded, the following:
(1) 
Any dog or cat running at large in the Borough;
(2) 
Any dog or cat off the premises of the owner or of the person keeping or harboring the dog or cat, which dog or cat the official or his agent or agents have reason to believe is a stray dog or cat;
(3) 
Any dog or cat off the premises of the owner or of the person keeping or harboring the dog or cat, which dog or cat is not controlled by a leash or chain as provided by this chapter;
(4) 
Any dog or cat with fierce, dangerous or vicious propensities or noticeably infected with rabies or bitten by a dog or cat suspected of having rabies;
(5) 
Any dog or cat off the premises of the owner or of the person keeping or harboring such dog or cat, without a current registration as provided in this chapter; and
(6) 
Any female dog or cat in season off the premises of the owner or of the person keeping or harboring such dog or cat which dog or cat is not controlled as provided in this chapter.
B. 
Dogs and/or cats may be released from impoundment only after the impound facility verifies that such dog or cat has been licensed in accordance with this chapter and that all rabies shots required for the age and size of the dog or cat have been given and all required booster shots are current.
Any dog or cat seized under this chapter shall be handled and disposed of with proper notices given, as required under N.J.S.A. 4:19-15.16.
The Borough shall have the authority to provide by contract with a carrier for the impoundment of dogs or cat seized. Maintenance and redemption fees shall be as set forth in such contract. All contracts with any carrier shall require such carrier to only release dogs and cats impounded by such carrier after the owner (or any person or otherwise obtains the release of such dogs and cats from impoundment), provides the proof required under § 125-24B above. This provision shall apply to contracts entered into from and after January 1, 2001.
No person owning, keeping or harboring any dog or cat shall allow it to create a noise disturbance across residential real property lines of any neighboring property. For the purpose of this section, a "noise disturbance across residential real property lines of any neighboring property" is defined as that created by a dog or cat barking, whining, howling or fighting continuously for five minutes, or intermittently for 15 minutes.
No person owning, keeping, harboring, walking, or in charge of any dog or cat shall cause, suffer, permit or allow such dog or cat to soil, defile, defecate on or commit any nuisance on any thoroughfare, street or sidewalk or upon any public property whatsoever or upon any private property without permission of the owner of the private property. If any such person shall permit such dog or cat to soil, defile, defecate on or commit any nuisance on the areas shall immediately remove and dispose of all feces and droppings deposited by such dog or cats, which removal shall be in a sanitary manner by a shovel container, disposal bag, or the like. If the management, ownership or association owning, operating or controlling the common areas of a multidwelling complex provides a pet walking or exercise area on the common areas of the complex, occupants of the complex shall take his or her dog(s) or cat(s) only to the designated walking or exercise area for exercise, defecation and/or elimination and all such occupants who use such area shall do so, including removal of and disposal of all feces and droppings by such dog(s) or cat(s), in accordance with the rules and regulations of such complex. All dog or cat owners shall maintain his or her own property, including any patio, porch, deck, yard or other outside area which is part of his or her home or over which the owner/occupant has exclusive control in a sanitary manner in order to prevent any noxious odors or any other public health nuisances to neighbors.
A. 
Purpose. A section to establish requirements for the proper disposal of pet solid waste in the Borough so as to protect public health, safety and welfare, and to prescribe penalties for failure to comply.
B. 
Definitions. For the purpose of this section the following terms, phrases, words and their derivations shall have the meanings stated herein unless their use in the text of this section clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
IMMEDIATE
That the pet solid waste is removed at once, without delay.
OWNER/KEEPER
Any person who shall possess, maintain, house or harbor any pet or otherwise have custody of any pet, whether or not the owner of such pet.
PERSON
Any individual, corporation, company, partnership, firm, association or political subdivision of this state, subject to municipal jurisdiction.
PET
A domesticated animal (other than a disability assistance animal) kept for amusement or companionship.
PET SOLID WASTE
Waste matter expelled from the bowels of the pet; excrement.
PROPER DISPOSAL
Placement in a designated waste receptacle or other suitable container and discarded in a refuse container which is regularly emptied by the municipality or some other refuse collector; or disposal into a system designed to convey domestic sewage for proper treatment and disposal.
C. 
Requirement for disposal. All pet owners and keepers are required to immediately and properly dispose of their pet's solid waste deposited on any property, public or private, not owned or possessed by that person.
D. 
Exemptions. Any owner or keeper who requires the use of a disability assistance animal shall be exempt from the provisions of this section while such animal is being used for that purpose.
E. 
Enforcement. The provisions of this section shall be enforced by the Police Department and the local code enforcement official of the Borough.
F. 
Violations and penalty. Any person(s) who is found to be in violation of the provisions of this section shall be subject to a fine not to exceed $250 for each offense.
A. 
It is unlawful to chain or tether unneutered/unspayed dogs in any manner and/or at any time within the Borough.
B. 
Neutered/spayed dogs may be tethered under the following circumstances:
(1) 
The tether must be at least 15 feet long and have operative swivel on both ends, weigh no more than one-eighth of the dog's weight and be attached to a properly fitting collar or harness.
(2) 
The collar used for tethering may not be a choke chain collar, slip collar, or prong collar.
(3) 
The tether must allow the dog access to proper shelter, sufficient food and sufficient water.
(4) 
The tether may not be used in any area where it may become tangled around any object, such as, but not limited to, a tree, pole, fence, or stake.
(5) 
The tether cannot inhibit the movement of the animal's limbs or cause injury, harm, entanglement or strangulation.
(6) 
The tether must restrain the dog within the bounds of the owner's or caregiver's property.
(7) 
The tether must terminate no less than five feet from any fence, pool, wall, vehicle, tree, or other object or obstruction upon which any animal may harm itself.
(8) 
Dogs may be tethered for no more than four consecutive hours in any twenty-four-hour period of time and never between sunset and sunrise.
C. 
When a violation of this provision occurs, an animal control officer or law enforcement officer is authorized to document the circumstances and evidence, take reasonable measures to remove the animal from the tether, take the tether as evidence, and take the animal to the pound.
