A "planting strip" is defined as the area located between the adjacent street and the platted lot line(s). The subject strip is a part of the town's property and may consist of and be occupied by grass (or other material if expressly approved in writing by the town council), and in some areas may also include sidewalks and trees. The curbs and sidewalks shall be maintained by the town in a reasonable condition subject to the availability of funds and staff to do the work. The town's responsibility for maintenance of the trees is limited to trimming and pest control, which work is also subject to the availability of funds and staff. Removal and replacement of trees within the planting strip is covered by CDMC § 2.40.040.

It shall be the duty of the occupant and/or owner of each and every parcel of real estate in the town of Coulee Dam to remove, or cause to be removed, all snow and ice from the sidewalk where sidewalks exist, in front of or adjacent to such premises to the full paved width of such sidewalk within 24 hours after such snow or ice shall have fallen or accumulated thereon.

All vegetation existing in the planting strip(s) shall be appropriately maintained in the same manner as that existing on the occupant's and/or owner's lot(s). Minimum care to be performed includes removal of noxious and seed-producing weeds, water and mowing. The frequency for mowing shall be the same as that performed on the lot, but the growth of ground cover in the strip shall not exceed a maximum height of six inches.

Any owner, occupant or person in charge who fails, neglects or refuses to fully comply with the terms of this chapter shall be found to have committed a civil infraction and shall be assessed a monetary penalty, which penalty may not exceed $100.00 for each offense. Each day during which a violation continues shall be deemed a separate offense and separate penalties may be assessed for each separate offense.
