For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
As defined and specified by the director in rules and regulations adopted pursuant to the provisions of this chapter.
means that story of a building or dwelling located wholly or partly underground, but having less than half of its clear floor-to-ceiling height below the average grade of the adjoining ground, as measured from finished floor to finished ceiling.
means the housing board of review.
means a portion of a building or dwelling located partly or wholly underground and having half or more than half of its clear floor-to-ceiling height below the average grade of the adjoining ground, as measured from finished floor to finished ceiling.
means the inspector of buildings.
means any building or part thereof which is wholly or partly used or intended to be used for living and sleeping by one or more occupants. A dwelling may include one or more dwelling units or rooming units or a combination of both.
means the land and auxiliary buildings thereon used or intended to be used in connection with the dwelling.
means any room or group of rooms within a dwelling and forming a single and separate habitable unit with facilities which are used or intended to be used for living, sleeping, cooking and eating.
means any element whether created by nature or created by man/woman, which with reasonable foreseeability could carry litter from one place to another. Elements shall include, but not be limited to, air current, rain, water currents and animals.
means the horizontally projected floor area inside of and between exterior walls or partitions or any combination thereof, as assured within a habitable room exclusive of that portion of the habitable room which does not have a ceiling height of at least four feet.
means all waste, animal or vegetable, such as but not limited to, waste material and refuse from kitchens, residences, grocery stores, butcher shops, restaurants, cafes, rooming houses, boarding houses, and all other commercial, industrial or residential structures.
means a room or enclosed floor space used or intended to be used for living, or sleeping, or cooking, or eating purposes; and excluding bathrooms, toilet rooms or compartments, laundries, pantries, foyers, communicating corridors, closet and storage space.
means the presence, within or around a dwelling or dwelling premises, of rodents, vermin or pests.
means an uncontainerized man-made or man-used waste which, if deposited within the city otherwise than in a litter receptacle, tends to create a danger to public health, safety and welfare or to impair the environment of the people of the city. Litter may include but is not limited to, any garbage, trash, refuse, confetti, debris, grass clippings or other lawn or garden waste, newspapers, magazines, glass, metal, plastic or paper containers or other construction material, motor vehicle parts, furniture, oil, carcass of a dead animal, or nauseous or offensive matter of any kind, or any object likely to injure any person or create a traffic hazard.
means any person over one year of age, living, sleeping, cooking or eating in, or having actual possession of a dwelling unit or rooming unit.
means any person who has charge, care or control of a multiple dwelling or rooming house, in which dwelling units or rooming units are let or offered for occupancy.
means any person, agent, operator, firm or corporation having a legal or equitable interest in the property, or recorded in the official records of the state, county, or city as holding title to the property; or otherwise having control of the property, including the guardian of the estate of any such person, and the executor or administrator of the estate of such person if ordered to take possession of real property by a court.
includes all of the following supplied facilities, equipment and devices: Gas pipes, water pipes, toilets, lavatories, sinks, laundry tubs, installed dishwashers, garbage disposal units, installed clothes washing machines, catch basins, wash basins, bathtubs, shower baths, waste pipes, cesspools, septic tanks, drains, vents, traps and any other gas-burning or water-using fixtures and appliances, together with all connections to water, waste or gas pipes.
means any waste, rubbish, garbage, trash, or any material of any kind that has been discarded, rejected, cast aside or thrown away as worthless, except body wastes.
means any dwelling, or part thereof, which contains three or more rooming units, in which space is rented or intended to be rented to three or more persons who are not husband or wife, son or daughter, mother or father, or sister or brother of the owner or operator.
means any room or group of rooms forming a single habitable unit rented or intended to be rented for living purposes.
means any combustible and noncombustible solid wastes such as, but not limited to, ashes, paper, cardboard, tin cans, clippings, trimmings, wood, grass, bedding, crockery, plastics, rubber by-products, litter, machinery, inoperative, wrecked, junked or dismantled motor vehicles, vehicle parts, junk and other discarded items.
means dwelling units regularly occupied for less than five months of the year and not the permanent residences of the occupants.
means paid for, furnished by or provided by the owner or operator.
means any rubbish such as feathers, coffee grounds, ashes, tin cans, paper, boxes, glass, wood, shrubs, yard clippings, leaves, tree trimmings and similar matter.
