The following words, terms, or phrases, when used in this Chapter, shall have the meanings ascribed to them in this Section.
GUARDIAN
Includes parents or natural guardians, court appointed guardians or any persons having charge, control, or custody of any minor.
MINOR
Any child seventeen (17) years of age or less.
SCHOOL YEAR
The school year as defined by the school district, typically from August of one year to May of the following year.

A. 
Any guardian shall either:
1. 
Enroll such minor under their charge, control, or custody in public, private, parochial, parish school, home school, FPE school, or full-time equivalent attendance in a combination of such schools for the compulsory attendance ages established by the school district where the child resides and as set forth in Section 167.031, RSMo., and shall ensure that the child attends such school as required by law.
2. 
Provide the child a program of "home school" academic instruction that is in compliance with the provisions of Section 167.031.2, RSMo.
B. 
It shall be a violation of this Section by any guardian if any minor under their charge, control or custody has more than ten (10) unexcused absences from school in any semester. The school district shall give such guardian written or electronic notices when such unexcused absences reach three (3), five (5), seven (7) and ten (10). Excused absences shall include those deemed excused by the school's administration, for attending a funeral for a death in the family, and those resulting in a doctor note being filed with the school administration indicating such absence was necessary.
C. 
Any guardian who is convicted of any violation of this Section, shall be subject to the penalty provisions of Section 100.220, General Penalty.
