For the purposes of this chapter, the following words or phrases shall be defined as follows:
(A) "Commission"
means the California Public Utilities Commission.
(B) "Development"
means the activity of preparing land and constructing buildings or other facilities in order to establish or expand a land use.
(C) "Person"
means and includes individuals, firms, corporations, partnerships and their agents and employees.
(D) "Poles, overhead wires and associated overhead structures"
means poles, towers, supports, wires, conductors, guys, stubs, platforms, crossarms, braces, transformers, insulators, cutouts, switches, communication circuits, appliances, attachments and appurtenances located aboveground and used or useful in supplying electric, communication or similar or associated service.
(E) "Underground utility district" or "district"
means that area in the City within which poles, overhead wires and associated overhead structures are prohibited as such area is designated and described in a resolution adopted pursuant to the provisions of PMC § 12.04.040.
(F) "Utility"
includes all persons or entities supplying electric, communication or similar or associated service by means of electrical materials or devices.
(G) "Utility facilities"
shall mean poles, overhead wires and associated overhead structures as defined in subsection (D) of this section.
