As used in this chapter, the following terms shall have the meanings indicated:
BOROUGH
Means the Borough of Summit Hill, Carbon County, Pennsylvania.
DOMESTIC ANIMAL
Means any animal, including but not limited to a dog, cat or horse, that has been tamed and is kept by any person or persons as a pet, work animal or food source, and whether or not the said person(s) and/or domestic animal(s) reside(s) in the Borough.
OWNER
Means any individual, natural person, estate, trust, firm, corporation, partnership, governmental entity, association or other legal entity that owns, maintains, is in possession of, control of, or is otherwise responsible for the supervision of, a domestic animal at any relevant time.
PARK
Means any grounds, buildings, improvements, walls, fences and walks under the ownership and/or control of the Borough, including but not limited to "Ludlow Park," "Bill Black Park," "Phillip Melley Memorial Park," "Ginder Park" and "Memorial Park," together with all public roadways immediately adjacent thereto.
The following rules and regulations are hereby established in order to preserve the life, health and property of persons and to maintain the public peace in and about the Borough parks:
A. 
During the months of October through April, the parks shall be open to the public daily between the hours of 6:00 a.m. and 6:00 p.m., at which time all activities shall cease immediately. Except for those specifically authorized by the Borough, no persons shall be in the parks after 6:00 p.m. or before 6:00 a.m. the next morning;
B. 
During the months of May through September, the parks shall be open to the public daily between the hours of 5:00 a.m. and 9:00 p.m., at which time all activities shall cease immediately. Except for those specifically authorized by the Borough, no persons shall be in the parks after 9:00 p.m. or before 5:00 a.m. the next morning;
C. 
No person shall injure, deface, remove, cut or damage any of the trees, plants, shrubs, turf, buildings, structures or fixtures therein or any other property owned by the Borough located within the Park;[1]

D. 
No person shall remove any bench, seat or table from any park, or change the location thereof, without prior written permission from the Borough;
E. 
No person shall conduct himself within the parks or adjacent sidewalks, road surfaces or grassy areas so as to annoy any other person using the parks for recreational purposes or persons residing adjacent to said parks;
F. 
No person shall hold any meeting or gathering, assembled through advertisement or public notice, or any gathering otherwise assembled and composed of 25 or more persons, within the limits of the parks without having first made application to the Borough thereof for a permit;
G. 
No person shall set up any booth, table or stand for the sale of any article whatsoever within the limits of the parks without the consent of the Borough, who shall have the authority to refuse such consent in any instance;
H. 
No person shall dispose of any waste or garbage in the parks, except in receptacles designated for the respective purposes. All persons using the parks shall dispose of all waste and garbage left by them in such proper receptacles. No household waste or garbage shall be deposited in any receptacles within or adjacent to any parks;
I. 
No person shall injure, deface or destroy any notice, rule or regulation posted at any place within the parks by the authority of the Borough or any other authority of the Borough; nor shall any person post, at any place within the parks, any notice or placard other than by the authority of the Borough;
J. 
No person shall bring any alcohol beverages into the parks, either for his or her own use or for the use of any other person, except as permitted by the Borough;
K. 
No person, other than an officer of the law, shall carry any firearm within the limits of the parks, nor shall any person engage in hunting from within the parks or any immediately surrounding areas;
L. 
Dogs and other domestic animals must be leashed and under the control of its owner at all times. It shall be unlawful for the owner of a domestic animal to allow, either willfully or through failure to exercise due care and control, her or its domestic animal(s) to be unleashed or to otherwise run at-large in and upon a park or other Borough property;
M. 
It shall be unlawful for the owner of any domestic animal to permit, either willfully or through failure to exercise due care and control, any domestic animal to defecate in or upon any park or other public property within the Borough, unless the owner of the domestic animal shall immediately remove and properly dispose of the feces in a designated animal waste receptacle;
N. 
The owner of any domestic animal shall remove and properly dispose of any and all feces and other domestic animal wastes in and upon a park or other Borough property so as to avoid noxious and nauseous odors that are irritating, annoying or offensive to a person of normal sensibilities; or that are injurious to human, plant or animal life; or that reasonably interferes with the use and enjoyment of the park or other public property;
O. 
No person shall ride or use an all-terrain vehicle (ATV), quadricycle ("quad") or any other motor vehicle in Ginder Park;
P. 
No person shall maintain any open fire(s) within a park or other Borough property at any time. Stoves of the "Coleman," propane, heat tablet, charcoal or similar types are strictly prohibited in Borough parks without prior written permission from Borough Council or the Borough Mayor.
A. 
A permit shall be required for all reservations.
B. 
Reservations for the use of all parks will be issued in writing by the Borough Secretary, authorizing groups and/or individuals to reserve portions of the park for special events in accordance with the rules and regulations for use of a park as approved by Borough Council from time to time. The reservation, on a form executed by the Borough Secretary, shall entitle the holder either to the exclusive use of the gazebo (at Ginder Park) or a designated portion of the park during the period of the reservation. In addition, bathroom facilities will be available for the event, although not exclusively, as these facilities can be used by the public whenever they are open. In the event of a conflict in reservations, the first party in time to apply for a reservation shall take precedence over any subsequent application for a reservation.
C. 
The fee and damage deposit for reservations for all parks shall be as established by resolution of Borough Council from time to time.
D. 
Any request for the use of a park for more than one day must be approved in advance by Borough Council. Each day of a multiple-day event shall require a separate reservation and fee, although only a single damage deposit will be required for the duration of the event.
A. 
Any person who shall violate any of the rules and regulations as heretofore set forth shall, upon conviction in a summary proceeding under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings.
B. 
Each day that such violation exists shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense.
C. 
Upon judgment against any person by summary conviction, or by proceedings by summons on default of the payment of the fine or penalty imposed and the costs, the defendant may be sentenced and committed to the county correctional facility for a period not exceeding 30 days.
D. 
In addition to or in lieu of enforcement under this section, the Borough hereby expressly reserves the right to pursue any and all other available legal civil and criminal remedies and causes of action as against any person and/or entity, and nothing in this chapter shall be construed as a limitation or waiver of such rights.
