Editor’s note–Former division 3 pertaining to park rules, was amended and replaced with similar provisions by Ordinance 907-25 adopted 5/22/2025. Prior to the replacement, this division derived from the following: Ordinance 436-10 adopted 5/18/10 and Ordinance 717-21 adopted 8/24/21.
The following words, terms and phrases shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
City park.
Any playground, recreation center, sports complex, athletic facility, community center, or any other area in or outside the city that is owned, controlled, leased, or used by the city, and devoted to active or passive recreation use by the public, including such areas or locations within such areas where use is authorized by the city pursuant to a reservation or pursuant to a permit issued by the city.

(a) 
Prohibitions.
Except in accordance with a special event or other permit issued by the city, it shall be unlawful for any person to engage in any one or more of the following acts or to cause such acts to occur in a city park:
(1) 
To drill oil, gas or other mineral extraction wells, including but not limited to the quarrying, excavating or other surface mining of minerals, sand, gravel or coal.
(2) 
Except in designated areas of a city park as identified by signage:
(A) 
To hitch, fasten, lead, drive or let loose any animal, reptile, or fowl of any kind.
(B) 
To ride or drive any horse or other animal.
(C) 
To ride or drive a bicycle, motorcycle, automobile, or any other type of vehicle:
(i) 
Upon any drive or street within any city park at a rate of speed that is unreasonable and imprudent under the conditions existing or in excess of a posted speed limit; or
(ii) 
Upon any sidewalk, walkway or trail in any city park.
(D) 
To operate a motorized vehicle of any type within a city park.
(3) 
Except as allowed by state law, to carry or discharge any firearm, firecrackers, rockets, torpedoes or any other fireworks, air guns, BB guns, bow and arrows, or slingshots.
(4) 
To damage, cut, damage, cut, break, injure, deface, or disturb any tree, shrub, plant, rock, building, cage, pen, monument, fence, bench or other structure, apparatus, or property; or to pluck, pull up, cut, take or remove any shrub, bush, plant or flower; or to mark or write upon, paint, or deface any building, monument, fence, bench or other structure.
(5) 
To cut or remove any wood, turf, grass, soil, rock, sand, gravel or fertilizer.
(6) 
To swim, bathe, wade in or pollute the water of any fountain, pond, lake or stream.
(7) 
To make or kindle a fire, except in picnic stoves, braziers, fire pits or designated areas provided for that purpose.
(8) 
To wash dishes or to empty salt water or other waste liquids elsewhere than in sinks provided for those purposes.
(9) 
To litter, including the discard of garbage, cans, bottles, papers or other refuse elsewhere than in receptacles designated for that purpose.
(10) 
To participate or engage in any activity in any city park when such activity will create a danger to the public or may be considered a public nuisance.
(11) 
To camp overnight or at any time during which the city park is closed.
(12) 
To wager play or bet at or against any game or event which is played, conducted, dealt or carried on, including without limitation events and activities with cards, dice, or other devices, or athletic events, for remuneration of any kind, utilizing money, chips, shells, credit or any other representative of value, or to maintain or exhibit any gambling table or other instrument of gambling or gaming.
(13) 
To participate in any game or other event upon which a wager or bet is made for remuneration of any kind.
(14) 
To use or speak any threatening, abusive, insulting or indecent language in any city park.
(15) 
To engage in any obscene, lewd or indecent act or create any nuisance.
(16) 
To disturb or disrupt in any manner any lawful picnic, meeting, service, concert, exercise, exhibition, or any activity in an area reserved for private use pursuant to a reservation approved by the city.
(17) 
To sell or offer for sale any food, drinks, confections, merchandise or services, except as authorized by city permit or ordinance.
(18) 
To practice, carry on, conduct or solicit for any trade, occupation, business or profession.
(19) 
To remain or stay or loiter in any city park at any time not within the city park's scheduled open hours, 5 a.m. to 10 p.m.
(20) 
To remain, stay or loiter in any city park after being instructed to leave as directed by a licensed peace officer due to dangerous weather conditions regardless of time of day.
(21) 
To remain, stay or loiter in any city park at any time that the city has posted at or near the entrance of the city park any notice that the city park has been closed for any reason.
(22) 
To use the restrooms and washrooms designated for the opposite sex if the person is over the age of six years.
(23) 
To possess or consume any alcoholic beverage in any city park except as permitted by the city or state law.
(24) 
To possess any glass containers within any city park, including but not limited to parking lots contained within a city park or provided in close proximity for persons using a city park, playground areas, and all other areas or structures within the boundaries of any city park.
(25) 
To appear nude or in a state of nudity as defined below:
(A) 
The appearance of a human bare buttock, anus, male genitals, female genitals, pubic region or areola of the female breasts; or
(B) 
A state of dress which fails to opaquely cover a human buttock, anus, male genitals, female genitals, pubic region or areola of the female breast.
(26) 
To smoke or use tobacco products in city parks except in designated areas.
(27) 
To use any designated athletic field that has a posted reservation only sign without first obtaining a reservation through the city.
(28) 
To play golf, disc golf or hit golf balls in any city park except in designated areas.
(29) 
To ride bicycles, skateboards, skates or scooters (motorized and nonmotorized) at athletic facilities, except on areas designated for those purposes.
(30) 
To allow dogs or other pets onto designated athletic fields.
(31) 
To fail to properly clean up pet waste and dispose of such waste in receptacles.
(32) 
To hang on a basketball goal, including but not limited to rim, net, backboard or any other piece of the goal.
(33) 
To use or possess a controlled substances within a city park when such use or possession is unlawful.
(34) 
To use confetti and/or silly string at any city park.
(35) 
To utilize or distribute bird seed indoors at a city park.
(36) 
To fail to comply with or adhere to instructions provided on signage posted by the city.
(b) 
Standards of conduct - reserved areas: All persons shall adhere to the following minimum standards of conduct when utilizing a reserved area within a city park:
(1) 
Use of reserved area shall only be allowed pursuant to a reservation for such use approved by the city.
(2) 
Adhere to instructions provided on posted park signage.
(3) 
Upon conclusion of a reservation, all reserved facilities shall be cleaned and left in a condition that is as good as existed upon commencement of the reservation. Failure to comply with this provision shall do so, will result in a cleaning fee. Refer to fee schedule.
(4) 
Any reserved areas, it is prohibited to use nails, thumb tacks, etc., for any decorative purposes on walls, structures or furnishings.
(c) 
Failure to comply with the requirements of this division may result in denial of any subsequent use of facilities and or forfeiture of the facility deposit.
