The city parks, recreation and entertainment commission is hereby established. The parks, recreation and entertainment commission shall serve in an advisory capacity to the city council. The commission shall consist of five members who shall serve without compensation.

For the purposes of this chapter, the following words and phrases shall have these meanings:
"Commission"
shall mean the city parks, recreation and entertainment commission established by this chapter.
"Commissioners"
shall mean those persons appointed to the commission in accordance with this chapter.
"Department"
shall mean the city department responsible for parks, recreation, and entertainment.
"Director"
shall mean the director of the department, appointed to that position by the city manager.

A. 
To be eligible for appointment or to hold office as a member of the parks, recreation and entertainment commission: (1) no fewer than three appointees shall be at least 18 years of age and a resident of the city of Hughson; and (2) no more than two appointees shall be a person at least 18 years of age that reside outside the city limits but within the 95326 zip code.
B. 
Elected officials, planning commissioners or employees of the city shall not be eligible for appointment as commissioners.
C. 
Members of the commission shall be appointed by the mayor with the approval of three affirmative votes of the city council.

A. 
The term of office for each commissioner shall be for two years, and until his or her successor is appointed, except as provided in subsection C of this section, or HMC § 2.14.050.
B. 
Should a vacancy occur on the commission for any reason, including expiration of terms, the vacancy shall be filled by appointment by the mayor, with the approval of three affirmative votes of the city council. Except in the case of a vacancy occurring due to expiration of a term, appointments to fill vacancies shall only be for the balance of the unexpired term of the vacant portion.
C. 
The initial commission, at its first meeting, shall stagger the terms of the initial commissioners, so that two of the five shall have an initial term of one year, instead of two years. The determination of those two commissioners shall be by drawing lots.
D. 
To ensure that the commission has three commissioners that reside within the city limits of the city of Hughson, as required by HMC § 2.14.030(A), and comply with staggered terms, as required by subsection C of this section, in years where three commissioners are to be appointed, at least two commissioners shall reside within the city limits of the city of Hughson. In years where two commissioners are to be appointed, at least one commissioner shall reside within the city limits of the city of Hughson.

Notwithstanding any other provision of this chapter:
A. 
The commissioners serve at the will of the mayor and may be removed at any time by the mayor, with the approval of three affirmative votes of the city council.
B. 
A vacancy shall be deemed to have occurred for the position of any commissioner who absents himself or herself from any three consecutive regular meetings of the commission for any reasons other than illness or family emergency.
C. 
A vacancy shall be deemed to have occurred for the position of any commissioner who is absent from a total of six or more regular meetings of the commission in any 12-month period.

A. 
The commission shall meet initially at 7:00 p.m. on the first Monday after the full commission is appointed by the council, at City Hall.
B. 
The commission shall, at that first meeting, establish a regular meeting schedule including dates, time and location for itself, which shall be at least once per calendar month.
C. 
Regular meetings shall be noticed and agendized in accordance with California Government Code Sections 54950 and following, as they are now or may be amended.
D. 
Special meetings may be called in accordance with California Government Code Section 54956, as it is now, or may be amended.
E. 
Meetings may be continued, and emergency meetings may be called, in accordance with the applicable provisions of California Government Code Sections 54950 and following, as they are now or may be amended.
F. 
The city manager shall assign such staff as may be necessary to assist the commission.

A. 
A quorum consists of at least three commissioners.
B. 
An affirmative vote of at least three commissioners shall be necessary for any actions.
C. 
Each commissioner, including the chair, shall have one vote, and each commissioner, including the chair, may initiate or second motions.
D. 
All actions of the commission shall be by minute action, and roll call vote.

Immediately following their appointment and thereafter as soon as practicable following the first day of January of each year, the commission shall meet, organize, and elect one of its members to serve as the presiding officer, to be known as chairperson, to serve at the pleasure of the commission. It shall also elect a vice-chairperson from its membership. The secretary of the commission shall be the planning director or his or her designee. In addition, the commission shall immediately adopt, and later may change or alter, rules and regulations of organization and procedure consistent with the city ordinances and state laws. The commission shall keep written records of its proceedings which shall be open at all times to public inspection.

The commission shall:
A. 
Advise the city council regarding policies for the acquisition, development, maintenance and improvement of park facilities and make recommendations as appropriate.
B. 
Formulate and recommend to the city council fee schedules, policies, rules and regulations for park sites and other recreation facilities.
C. 
Formulate and recommend to the city council a recreation, park and entertainment program for the inhabitants of the city which emphasizes general educational and recreational objectives for children and adults of the city; promotes and stimulates public interest in parks, recreation, arts and entertainment programs; advises the city council on parks, recreation, arts and entertainment experiences; and which encourages to the fullest extent possible the cooperation of the local school authorities and other public and/or private agencies or interests.
D. 
Advise the city council regarding the acceptance or rejection of offers of donations of money, personal and/or real property to the city for recreation, park and entertainment purposes and use and make recommendations where appropriate.
E. 
Advise the city council regarding the parks, recreation and entertainment budgets and make recommendations as appropriate.
F. 
At the first meeting in each calendar year, except the first year of establishment, the commission shall approve an annual report of its activities, and the state of the city's parks and recreation programs, and forward it to the city council.
