As used in this chapter, the following terms shall have the meanings indicated, unless the context clearly requires otherwise:
A. "Approved helmet"
means a head covering that meets or exceeds safety standards adopted by Standard Z-90.4 set by the American National Standards Institute (ANSI), or the Snell Foundation, or such subsequent nationally recognized standard for bicycle helmet performance as the city council may adopt, which shall be worn over the head and equipped with either a neck or chin strap that shall be fastened securely while the vehicle is in motion.
B. "Bicycle"
means every device propelled solely by human power upon which a person or persons may ride, having two tandem wheels, either of which is 16 inches or more in diameter, or three wheels, any one of which is more than 20 inches in diameter (RCW 46.04.071). Within this chapter, the term "bicycle" shall include any attached trailers, side cars, child seat and/or other device attached or being towed by a bicycle. For the purpose of this chapter, the term bicycle shall include electric assisted bicycles as defined in subsection (C) of this section.
C. "Electric-assisted bicycle"
means a bicycle with two or three wheels, a saddle, fully operative pedals for human propulsion, and an electric motor. The electric-assisted bicycle's electric motor must have a power output of no more than 1,000 watts, be incapable of propelling the device at a speed of more than 20 miles per hour on level ground, and be incapable of further increasing the speed of the device when human power alone is used to propel the device beyond 20 miles per hour.
D. "Guardian"
means a parent, legal guardian, an adult with custody, or temporary guardian, who maintains responsibility, whether voluntary or otherwise, for the safety and welfare of a person under the age of 18 years.
E. "Motorized foot scooter"
means a device with no more than two 10-inch or smaller diameter wheels that has handlebars, is designed to be stood upon but may have a seat, and is powered by an internal combustion engine or electric motor that is capable of propelling the device with or without human propulsion. "Motorized foot scooter" does not include a motor-driven cycle, a moped, an electric-assisted bicycle, or a motorcycle.
F. "Pocket bike"
(such as "Pocket Rocket" and "Mini Motorcycles") means a motor-driven device that meets the definition of motorcycle set forth in RCW 46.44.050 as a motor vehicle designed to travel on not more than three wheels in contact with the ground, on which the driver rides astride the motor unit or power train and is designed to be steered with a handle bar, but does not meet one or more of the equipment requirements for operation on roadways, such as the minimum wheel base requirements set forth in RCW 46.44.050, minimum headlamp requirements sets forth in RCW 46.37.525, minimum tail lamp height requirements set forth in RCW 46.37.525; mirror requirements set forth in RCW 46.37.400; and tire composition requirements set forth in RCW 46.37.420, and the requirement for a conforming 17-digit vehicle identification number (VIN) indicating compliance with Federal Motor Vehicle Safety Standards.
G. "Public area"
means public roadways, sidewalks, bicycle paths, parks, or any right-of-way or publicly owned facility under the jurisdiction of the city of Edgewood.
