The ordinance codified in this title shall be known as the "Vehicles, Traffic and Mobility Ordinance" and may be cited as such and will be referred to herein as "this title."

It is the intent of the city council in adopting this title to provide a comprehensive method for the identification and enforcement of the traffic, mobility and parking regulations within the city.

Provisions of this title are supplementary and complementary to all of the provisions of this code, state law, and any law cognizable at common law or in equity, and nothing in this title shall be read, interpreted or construed in any manner so as to limit any existing right or power of the city to enforce traffic laws or regulations.

The provisions of this title apply generally to all property throughout the city wherein any of the conditions hereinafter specified are found to exist; provided, however, that any condition which would constitute a violation of this title, but which is duly authorized under any city, state or federal law, shall not be deemed to violate this title.

The provisions of this title regulating the operation, parking and standing of vehicles shall not apply to the following:
A. 
Any vehicle of a police or fire department, any public ambulance, or any public utility vehicle or any private ambulance, which public utility vehicle or private ambulance has qualified as an authorized emergency vehicle, when any vehicle mentioned in this section is operated in the manner specified in the Vehicle Code in response to an emergency call.
B. 
Any parking enforcement vehicle while such vehicles are being used in parking enforcement and traffic control. As used in this section the term "parking enforcement vehicle" means any vehicle used by an authorized official of the city for traffic control or during the enforcement of parking and registration regulations pursuant to the chapters of this code and the Vehicle Code.
C. 
Any vehicle owned or operated by the United States Postal Service while in use for the collection, transportation, or delivery of United States Mail.
D. 
Any vehicle of a city department or public utility while necessarily in use for construction or repair work, or while responding to an emergency.

A. 
The following words and phrases, when used in this title, shall have the meanings respectively ascribed to them in this section:
"City manager"
means the city manager or designee.
"Commercial vehicle"
means as defined by Section 260 of the Vehicle Code, excluding any vehicle that is operated primarily for agricultural production purposes. This exclusion shall not be construed to include commercial vehicles used for the transportation of agricultural products. Pickup trucks and vans not exceeding one-ton rated capacity and which are used primarily for private noncommercial purposes are not considered commercial vehicles.
"Construction zone"
means any area on a street which is for the exclusive use of construction activities, including parking.
"Council"
means the city council of the city of West Sacramento.
"Curb"
means the lateral boundary of the roadway, whether such curb is marked by curbing construction, or not so marked. The word "curb" as used in this title does not include the line dividing the roadway of a street from parking strips in the center of the street, nor the tracks or right-of-way of public utility companies.
"Emergency"
means those conditions described in the Vehicle Code or Municipal Code as emergencies.
"Light Rail Transit"
also referred to as "LRT" refers to regional light rail passenger transit services using electric, hydrogen-electric hybrid, or other propulsion system with or without passenger cars coupled thereto, operated upon rails primarily off-street with right-of-way priority over motor vehicle traffic. LRT may also operate on-street with the flow of traffic; see "Streetcar".
"Loading zone"
means the space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials.
The "Manual on Uniform Traffic Control Devices (MUTCD)"
means that document referenced in 23 Code of Federal Regulations (CFR), Part 655, Subpart F and recognized as the national standard for all traffic control devices installed on any street, highway, bikeway, or private road open to public in accordance with 23 U.S.C. 109(d) and 402(a). This California Manual on Uniform Traffic Control Devices (California MUTCD) is published by the State of California, Caltrans and is issued to adopt uniform standards and specifications for all official traffic control devices in California, in accordance with Section 21400 of the Vehicle Code. The California MUTCD ("CA MUTCD") incorporates the latest edition of Federal Highway Administration's Manual on Uniform Traffic Control Devices and shall be the standard for all official traffic control devices within the State of California, under Section 11340.9(h) of California Government Code and Section 21400 of Vehicle Code.
"Official Time Standard"
Whenever certain hours are named in this title, they mean standard time or daylight-saving time as may be in current use in the city.
"Ordinance"
means the ordinance, rule or regulation adopted by the city relating to the movement of traffic, and enforcement thereof.
"Parking enforcement officer"
means an individual authorized by the city to enforce parking and registration regulations pursuant to the chapters of this code and the Vehicle Code.
"Parking facility"
means any space, plot, lot, garage, place, parcel, yard or enclosure or any portion thereof, where more than five motor vehicles can be parked, stored, housed, or kept, and which is available to the public for parking.
"Parking meter space"
means any space within a parking meter zone, adjacent to a parking meter or controlled by a pay machine or an authorized technology platform, which is duly designated for the parking of a single vehicle.
"Parking meter"
means any mechanical device or meter not inconsistent with this title placed or erected for the control or regulation of parking by the authority of this title.
"Parkway"
means that portion of a street other than a roadway or a sidewalk.
"Passenger loading zone"
means the space reserved for the exclusive use of vehicles while loading or unloading passengers.
"Pay machine"
means any mechanical/electronic device or mechanism not inconsistent with this title placed or erected for the control or regulation of multiple parking meter spaces by the authority of the city.
"Police officer"
means every officer of a duly constituted law enforcement agency.
"Railroad train"
refers to long-distance heavy freight and/or passenger rail transportation system using a diesel-electric hybrid engine, electric or other propulsion system with or without freight or passenger cars coupled thereto, operated upon rails with right-of-way priority over motor vehicle traffic.
"Streetcar"
means any urban light rail passenger transit system operating on rails within a city or county street right-of-way. These systems typically operate with the flow of traffic and are subject to motor vehicle traffic control devices.
"Traffic control devices"
mean all signs, signals, markings, and other devices used to regulate, warn, or guide traffic, placed on, over, or adjacent to a street, highway, pedestrian facility, bikeway, or private road open to public travel by authority of the city.
"Traffic enforcement unit"
means that unit within the police department of the city.
"Transportation and mobility division"
means that division within the community development department of the city responsible for planning and coordination of public transit, micro-transit and ridesharing services, shared mobility devices, bicycle and pedestrian mobility, and traffic engineering services.
"Transportation, mobility and infrastructure (TMI) commission"
means the transportation, mobility and infrastructure (TMI) commission of the city of West Sacramento.
"Vehicle Code"
means the Vehicle Code of the state of California.
B. 
Whenever any words and phrases used in this title are not defined herein but are defined in the Vehicle Code and amendments thereto, such definitions shall apply.
C. 
Masculine pronouns, such as "he" and "him," are utilized in the text of this title for the sake of brevity, and are intended to refer to persons of either sex.
