The provisions of the New Jersey State Sanitary Code, Chapter 8, Body Art Procedures, N.J.A.C. 8:27-1 et seq. and all future amendments thereto, shall be enforced in the Township of Freehold.
As used in this chapter, the following terms shall have the meanings indicated:
BODY ART
The practice of physical body adornment using the following techniques, but not including ear piercing:
A. 
Body piercing;
B. 
Tattooing; and
C. 
Permanent cosmetics.
BODY ART ESTABLISHMENT
Any place or premises, whether public or private, temporary or permanent in nature or location, where the practices of body art, whether or not for profit, are performed.
EAR PIERCING
The puncturing of the ear lobe and the trailing edge of the ear using a pre-sterilized single-use, stud­and-clasp ear-piercing system following the manufacturer's instructions.
EAR PIERCING ESTABLISHMENT
Any place or premises, whether public or private, temporary or permanent in nature or location, where the practice of ear piercing, whether or not for profit, is performed.
It shall be unlawful for any person to operate a body art establishment without a current license to operate issued by the Health Department to operate such establishment pursuant to the provisions established hereof. Any body art establishment operating with an expired license shall be considered as operating without a license.
A. 
The application for an initial license shall be accompanied by the appropriate fee. The license shall not be transferable. Any change of ownership shall require a new application and license with payment of the requisite fees therefor. All licenses shall expire on the last day of December annually and must be renewed annually for continuing operation of the establishment.
B. 
An application for renewal and the appropriate license fee shall be submitted prior to the expiration of the current license as further set forth herein.

The Board of Health of the Township of Freehold, County of Monmouth, State of New Jersey, does hereby adopt the following fees:
A. 
An application for initial license for a body art establishment or ear piercing establishment for a period ending on the last day of the calendar year in which the license is issued shall be made to the Health Department of the Township of Freehold accompanied by a fee in the amount of $500.
B. 
The renewal license fee for engaging in the business of operating a body art establishment subject to this chapter within the Township of Freehold shall be $300 per year. All licenses shall expire on the last day of each calendar year. All applications for renewal must be presented to the Health Department in writing on forms prescribed by the Board, no later than 30 days from the end of the calendar year.
C. 
The renewal license fee for engaging in the business of operating an ear piercing establishment subject to this chapter within the Township of Freehold shall be $250 per year. All licenses shall expire on the last day of each calendar year. All applications for renewal must be presented to the Health Department in writing on forms prescribed by the Board, no later than 30 days from the end of the calendar year.
A. 
Prior to the issuance or renewal of a body art or ear piercing establishment license, the Health Officer or authorized representative shall inspect the body art establishment. A license may not be issued if the establishment is found to be in violation of any of the requirements of this chapter, including the New Jersey State Sanitary Code (N.J.A.C. 8:27 et seq.) as referenced in § 370-1.
B. 
A body art or ear piercing establishment license may be renewed if said establishment has been inspected by the Health Officer or authorized representative and found to comply with all the requirements of this chapter and the state regulations, providing the inspection is performed and compliance is determined within 90 days prior to the expiration of the license.
C. 
Any establishment not served by a NJDEP-approved public community water supply shall be required to sample for total coliform bacteria on a quarterly basis. The sample must be collected from the sampling point by personnel employed by a New Jersey licensed laboratory and tested by a New Jersey licensed laboratory. The results must be provided to the Health Department upon receipt.
