The Village hereby establishes a Community Benefit Fund, the purposes of which shall be to provide funds to benefit the residents of the Village by providing for landscaping, beautification, maintenance, and safety of Village property, and to otherwise enhance the operations and services of the Village for the benefit of the residents of the Village.

A. 
In addition to such other fees as may be required for the granting of a subdivision application, every grant of a subdivision shall include the requirement that the developer pay to the Community Benefit Fund 2 3/4% of the fair market value of all of the lots within the subdivision, based upon their value after the granting of the subdivision application, excluding, however, the fair market value of any buildings located thereon. No deduction from said 2 3/4% shall be made for the cost of improvements, including, but not limited to, any streets or bringing utilities to the subdivision.
B. 
When a subdivision includes a new street, in addition to the fee required in Subsection A hereof, the applicant shall pay to the Community Benefit Fund an additional sum of $50,000 for each lot within the subdivision.
C. 
When a subdivision application is only to change the boundary line between two existing lots, in lieu of the fee required in Subsection A hereof, the applicant shall pay to the Community Benefit Fund the sum of $50,000.
In the event that the applicant for the subdivision does not agree with the Planning Board’s determination of said fair market value, then, and in that event, at the option of the applicant, to be exercised within 15 days after the Planning Board’s determination of said fair market value, the applicant may request, in writing, to the Village Clerk that the Planning Board engage an independent appraiser, at the applicant’s sole cost and expense, to be chosen by the Planning Board, to provide the Planning Board with an appraisal to assist it in its determination of said fair market value. If said request is not received by the Village Clerk, in writing, within said fifteen-day period, the applicant’s option to obtain said appraisal shall be deemed waived.

A. 
The purpose of the Community Benefit Enhancement Committee, sometimes hereinafter referred to as the "CBEC," shall be to advise the Board of Trustees on the landscaping, beautification, maintenance, safety, and overall improvements and enhancements of the Village that could be improved with the funds collected in the Community Benefit Fund.
B. 
There is hereby created a Community Benefit Enhancement Committee, consisting of five to seven members to be appointed for terms of one year by the Mayor, subject to the approval of the Board of Trustees.
C. 
The Chairperson of the CBEC shall be appointed for a term of one year by the Mayor, subject to the approval of the Board of Trustees.
D. 
The CBEC shall hold meetings from time to time as called by the Chairperson, or, in the absence of the Chairperson, by such person as shall be appointed from time to time by either the Chairperson or the Mayor to act as a temporary Chairperson during the absence of the Chairperson. Those meetings shall be open to the public.
E. 
The sole power of the CBEC shall be to advise the Board of Trustees from time to time on the landscaping, beautification, maintenance, safety, and overall improvements and enhancements of the Village that could be improved with the funds collected in the Community Benefit Fund.
