Whenever any words and phrases are used in this chapter, the meanings respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein. a.
The Chief of Police or, in his absence, disability or inability to act, the Mayor of the municipality, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.
b.
Any regulations promulgated by the Chief of Police and/or the Mayor and in accordance with Subsection a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c.
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed $50.
d.
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.
11-4.1
Regulations not exclusive. The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.
11-4.2
Parking prohibited at all times on certain streets. No person shall park a vehicle at any time upon any of the streets or parts of streets described in Schedule I attached to and made a part of this chapter.

Stopping or standing of motor vehicles prohibited on certain streets. No person shall stop or stand a vehicle at any time at the locations described in Schedule II attached to and made a part of this chapter. No stopping or standing signs shall be installed in accordance with Title 39 of the Revised Statutes.

11-4.5
Parking at Lake Topanemus regulation. No person shall park a vehicle on Pond Road (extension of Monument Street), beginning at the intersection of Water Works Road thence south along Pond Road, for a distance of 2,500 feet to the intersection of Standpipe Road from May 1 to October 1 between 10:00 a.m. and 5:30 p.m. during Eastern daylight saving time and between 10:00 a.m. and 8:00 p.m. during Eastern standard time.
11-4.6
Long-term parking restrictions.
a.
Long-term parking prohibition. It shall be unlawful for any person to park or leave unattended a vehicle on a long term basis in any parking lot, public, quasi-public, or private within the Township of Freehold, unless:
1.
That person is an employee or independent contractor for the property owner or other person in control or possession of the property.
2.
The vehicle displays a valid parking permit pursuant to Chapter 228 of the Code of the Township of Freehold and is parked within that area of the parking lot designated for permit parking.
3.
The vehicle is disabled making it impossible or impractical to move and the owner or driver makes good faith efforts to have it removed as soon as possible giving consideration to the surrounding circumstances.
4.
Other emergency exists requiring abandonment of the vehicle for more than six hours, providing the owner or driver makes good faith efforts to remove it as soon as possible giving consideration to the surrounding circumstances.
5.
The owner or driver of the vehicle has the permission of the property owner or other person in control or possession of the property and is not parked within that area of the parking lot designated for permit parking.
b.
Definition. As used herein, "on a long-term basis" shall be deemed to be six hours or more.
c.
Rebuttable presumption. A rebuttable presumption shall arise that a vehicle was parked or left unattended on a long term basis if:
d.
Penalties. Anyone found in violation of Subsection 11-4.6 shall be subject to the penalties as set forth in Chapter 1, Article II, General Penalty, of the Code of the Township of Freehold. Nothing herein shall be construed as limiting the rights and remedies conferred by N.J.S.A. 39:4-56.6 and 39:4-56.7.
11-4.7
Parking prohibited on snow-covered streets.

a.
No person shall park a vehicle on, or leave a parked vehicle on, any snow- and/or ice-covered street within the Township. Snow- and/or ice-covered as used herein shall mean that the snow and ice, in any combination, shall have accumulated on the paved portion of the street to form a continuous cover, except where such cover may have been disturbed by the passage of vehicles, pedestrians or drifting of snow caused by wind.
b.
No parking signs advising the public of the restrictions set forth in Subsection a above shall be posted on all major highways which provide access to the Township. If any such highways are under the jurisdiction of another governmental entity which shall not permit the erection of such signs, the Township shall be relieved of this posting requirement. Nothing herein shall be deemed to abrogate the presumption that each person knows the various laws which apply in this jurisdiction. Failure of compliance with this subsection shall not provide a defense for charged violations of this subsection.
c.
Any person convicted of a violation of Subsection a above shall be liable to a fine of not more than $500 for each offense. In addition, any vehicle left parked in violation of Subsection a above shall be liable to be towed upon order of a Township, county, or state law enforcement officer and the owner thereof shall be liable for the cost of towing and any storage charges accruing.
11-4.8
Permit parking.

11-4.8.1
Parking by permit only on designated streets. No vehicle shall be parked in the streets or parts of streets described in Schedule IIIB between the hours specified in the schedule on days when school is in session unless:
a.
A vehicle is owned and operated on a regular basis by a resident of that street; and
b.
The vehicle has displayed on its left rear window, in such a manner as to be closely examined by an officer or person enforcing the parking restrictions, a residential parking permit issued pursuant to Subsection 11-4.8.2; or
c.
The vehicle falls under one of the following exceptions:
1.
Contractors, service and delivery vehicles bearing the name and address of a commercial business may park without a permit during the time they are rendering service to a resident within a permit parking area.
2.
Emergency and municipal vehicles and public service, telephone and other public utility vehicles may park within the permit parking area during the time that they are rendering service or repairs within the permit parking area.
11-4.8.2
Residential parking permit.

a.
Each household located on those streets or portions of streets set forth in Schedule IIIB shall receive two parking permits from the Township Clerk's office. Application for additional parking permits shall be made in writing on the forms provided by the Township Clerk. Permits shall be issued only under the following terms and conditions:
1.
To persons who are residents on said streets or portions thereof upon which the parking is restricted by this section.
2.
Permits shall be valid for one year.
3.
A maximum number of permits for each household shall be determined based on one permit for each vehicle owned or principally operated by household residents.
4.
All vehicles for which permits are issued must be fully operational and registered with the Division of Motor Vehicles.
b.
There shall be no fee charged for residential parking permits hereunder.
11-4.8.3
Use of parking permits.

a.
A parking permit shall not authorize the standing or parking of any vehicle in such places and during such times when the stopping, standing or parking of vehicles is prohibited and shall not excuse the observance of any traffic regulation.
b.
Whenever the holder of a residential parking permit no longer fulfills the applicable provisions of this subsection, the holder shall notify the Township Clerk, who may then direct the holder to surrender the parking permit.
c.
A parking permit shall be valid only in the area identified in Schedule IIIB for which it is issued.
d.
It shall be a violation of this subsection for the holder of a parking permit to fail to surrender the permit when directed to do so.
e.
It shall be a violation of this subsection for any person to represent in any fashion that a vehicle is entitled to a parking permit authorized by this subsection when it is not so entitled. The display of a parking permit on a vehicle not entitled to such a parking permit shall constitute such a representation.
f.
It shall be a violation of this subsection for any person to duplicate, or attempt to duplicate, by any means, a parking permit authorized by this subsection. It also shall be a violation of this subsection for any person to display on any vehicle such a duplicate parking permit.
g.
The Township Clerk may revoke the residential parking permit of any person found to be in violation of this subsection and, upon written notification thereof, the person shall surrender such permit to the Township Clerk. Failure to surrender a revoked residential parking permit when requested to do so shall constitute a separate violation of this subsection.

Trucks over four tons gross weight are hereby excluded from the streets or parts of streets described in Schedule IV attached to and made a part of this chapter, except for the pickup and delivery of materials.
11-5.1
Limiting the use of streets during certain hours to a certain class of vehicles. Non-single-unit trucks, known as tractor trailer "articulated" vehicles, are hereby excluded during the hours specified on the streets or parts of streets described in Schedule IVA attached to and made a part of this chapter.

No person shall park a truck (except a pickup truck or sports utility vehicle not in excess of 8,000 pounds, gross vehicle weight) commercial vehicle, trailer, boat, recreational vehicle, pole trailer, equipment, tractor or bus on any street in the Township between the hours of 11:00 p.m. and 6:00 a.m.
11-7.1
Through streets. Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule V attached to and made a part of this chapter are hereby designated as through streets. Stop signs shall be installed on the near-right side of each street intersecting the through street except where yield signs are provided for in the designation.

Yield intersections. Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described in Schedule VI attached to and made a part of this chapter are hereby designated as yield intersections. Yield signs shall be installed as provided therein.
11-7.3
Stop intersections. Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described in Schedule VII attached to and made a part of this chapter are hereby designated as stop intersections. Stop signs shall be installed as provided therein.

Unless another penalty is expressly provided by New Jersey statute, any person convicted of a violation of this chapter or any supplement thereto shall be liable to a penalty.

The streets or parts of streets described in Schedule VIII attached to and made a part of this chapter shall have the speed limit designated in such schedule.

Pursuant to the provisions of N.J.S.A. 39:4-86, the streets described in Schedule IX attached to and made a part of this chapter are hereby designated as no-passing zones. No-passing-zone signs shall be installed as provided therein.
The driver of a vehicle shall not turn such vehicle around so as to proceed in the opposite direction (a maneuver commonly known as a "U-turn") at any of the locations as described in Schedule X.
11-11.1
No left turns. No person shall make a left turn at the locations described in Schedule XA.

a.
Purpose. The purpose of this section is to establish certain specific traffic regulations in certain areas of the Freehold Raceway Mall. In addition to the specific traffic regulations set forth in this section, by request of the property owner pursuant to N.J.S.A. 39:5A-1, the Township Committee has adopted a resolution authorizing the enforcement of Subtitle 1, Title 39 of the Revised Statutes of the State of New Jersey. Application of traffic regulations to certain areas of the Freehold Raceway Mall is deemed to be in the best interests and to promote the safety of those persons working at or visiting the mall as well as residents who live in the vicinity of the property.
b.
Traffic regulations. The following traffic regulations shall apply and be enforced in the areas designated below:

Intersection of Ring Road (known as "Winner's Circle") and the U.S. Route 9 Access Road (known as "Raceway Mall Drive") [Department of Transportation Plan designated LTS 3053].
(b)
Intersection of Ring Road (known as "Winner's Circle") and County Route 537 Access Road (known as "Trotters Way").
(c)
Intersection of Stable Drive and County Route 537 Access Road (known as "Trotters Way").
The traffic signal installations shall be in accordance with the provision of an act concerning motor vehicles and traffic regulations, Subtitle 1 of Title 39 of the Revised Statutes; shall conform to the design and shall be maintained in operation, as authorized by the Department of Transportation.
7.
Turn prohibited. No person shall make a turn at the location listed and in the manner described below:

Loading zones. No motor vehicle shall park, stop or stand within a designated loading zone except a commercially registered motor vehicle which is being actively loaded or unloaded. Observation, which need not be continuous and uninterrupted, of a commercially registered vehicle parking in a loading zone for a period of more than two hours without active loading or unloading activity taking place during any such observation shall give rise to a presumption that there has been a violation of this subsection. Such observation is neither required for there to exist probable cause for issuance of a summons hereunder nor a prerequisite prior to issuing a summons hereunder. The parking, stopping or standing of any noncommercially registered motor vehicle for any period of time in a designated loading zone shall give rise to a presumption that this subsection has been violated. Violation of any portion of this subsection shall subject the person so convicted or pleading guilty to such fines or penalties as set forth in § 1-3. Motor vehicles found in violation of this provision may be ordered towed at the owner's or operator's expense.

c.
Signage. All signs, posts, bolts or other necessary materials shall be installed and paid for by the property owner/applicant. The installations shall be inspected by the Township Police Department to insure that they meet state and federal specifications, and all signing shall conform to the current Manual on Uniform Traffic Control Devices.
d.
Penalty. The penalty for any person convicted of having violated any portion of this section, shall be as prescribed by New Jersey state statutes and/or the New Jersey Administrative Code. In the event no such penalty applies, the penalty provisions of Chapter 1, Article II, General Penalty, of the Code of the Township of Freehold shall be applicable.

Through street. The following street is hereby designated as a through street. Stop signs shall be installed on the near right side of each street intersecting the through street except where yield signs are provided for in the designation.

Parking. No person shall stop or stand a vehicle at any time upon either side of the entire length of Raintree Road.

Tow-away. Any vehicle parked or standing as to obstruct or impede a normal flow of traffic, block entrances or exitways, any grass area, pedestrian walkway, or present in any way a safety or traffic hazard may be removed by towing the vehicle at the owner's or operator's expense.

Signs. All signs, posts, bolts or other necessary materials required by the Township or the Department of Transportation shall be installed and paid for by the property owner/applicant. All signing shall conform to the current Manual on Uniform Traffic Control Devices. Subsequent to the initial installation of said signs, posts, bolts or other necessary materials, the owner/applicant shall be responsible for the repair, maintenance and restoration of same at no cost or expense to the Township.

Pavement markings. Any pavement markings required by the Township or the Department of Transportation shall be installed and paid for by the property owner/applicant. All pavement markings shall conform to the current Manual on Uniform Traffic Control Devices. Subsequent to the initial installation of pavement markings, the owner/applicant shall be responsible for the repair, maintenance and restoration of same at no cost or expense to the Township.

Penalty. The penalty for any person convicted of having violated any portion of this section shall be as prescribed by the New Jersey State Statutes and/or the New Jersey Administrative Code. In the event no such penalty applies, the penalty provisions of Chapter 1, Article II, of the Code of the Township of Freehold shall apply.

Within any area of the Township where hard surface motor vehicle parking ("parking lot") is open to the public in which lines are painted or otherwise visible ("designated lines") indicating individual parking spaces or stalls ("parking spaces"), motor vehicles shall, at all times, park within and not on or across such designated lines. When a motor vehicle's size, or by reason of its towing of an appropriately licensed trailer or vehicle ("oversized vehicle"), renders it impossible for that oversized vehicle to fit within the designated lines of a single parking space, such oversized vehicle shall be parked in such a manner as to occupy only as many parking spaces as is required to park the oversized vehicle safely. No motor vehicle (including oversized vehicles) shall be parked outside of the designated parking area such as in travel lanes or other areas of the parking lot not having designated lines to create parking spaces. Motor vehicles parked outside of such designated parking area shall be subject to being towed at the owner's or operator's expense and/or such fines and penalties as set forth in § 1-3.

No motor vehicle shall park, stop or stand within a designated loading zone except a commercially registered motor vehicle which is being actively loaded or unloaded. Observation, which need not be continuous and uninterrupted, of a commercially registered vehicle parking in a loading zone for a period of more than two hours without active loading or unloading activity taking place during any such observation shall give rise to a presumption that there has been a violation of this section. Such observation is neither required for there to exist probable cause for issuance of a summons hereunder nor a prerequisite prior to issuing a summons hereunder. The parking, stopping or standing of any noncommercially registered motor vehicle for any period of time in a designated loading zone shall give rise to a presumption that this section has been violated. Violation of any portion of this section shall subject the person so convicted or pleading guilty to such fines or penalties as set forth in § 1-3. Motor vehicles found in violation of this provision may be ordered towed at the owner's or operator's expense.

(c)
Beginning at the southerly pavement line of the main entrance road from Jackson Mills Road and measuring in a southerly direction 77 feet to the northerly curbline of Parking Lot 1.

Mid-block crosswalks. The following described locations are hereby designated as mid-block crosswalks:

(b)
The westerly connector road between Parking Lot 1 and Parking Lot 2, more particularly described as beginning at the easterly curbline of Parking Lot 1 and measuring in a northeasterly direction 271 feet to the southerly curbline of Parking Lot 2.
b.
Mid-block crosswalks. The following described locations are hereby designated as mid-block crosswalks.
1.
On the easterly entrance road from East Freehold Road located 949 feet southerly as measured from the southerly curbline of East Freehold Road.
2.
On the easterly entrance road from East Freehold Road located between Parking Lot 3 and Parking Lot 4, 21 feet easterly as measured from the easterly curbline of Parking Lot 3.
3.
On the westerly connector road between Parking Lot 1 and Parking Lot 2, 23 feet easterly as measured from the easterly curbline of Parking Lot 1.
