It is and has been the intent and purpose of present and past Mayors and Councilmembers, as well as persons who have donated land to the Borough, that any such land dedicated for, or indicated to be for use of, the residents of the Borough be preserved, insofar as is possible, under law, the intent to reserve to the residents of the Borough the use and enjoyment of Borough-owned parks, playgrounds and recreation facilities.

For the purpose of this chapter:
PARK
Shall mean any playground, field, recreation center or any other lands owned by the Borough and devoted to active or passive recreation.

a. 
Damage to Property Prohibited. No person shall cut, injure, deface, remove or disturb any tree, shrub, building, fence, bench or any other structure owned or erected by others in parks, playgrounds or recreational facilities, of the Borough nor shall any person pick, cut or remove any shrub, bush or flower, or mark, write, paint or in any way deface any building, fence, bench or other structure within the above named areas.
b. 
Indecent Language Prohibited. No abusive, profane or indecent language shall be allowed or permitted which shall be offensive or annoying to other members of the public.
c. 
Animals Running At Large Prohibited. No animals shall be allowed to run loose in parks, playgrounds or recreational areas of the Borough.
d. 
Firearms; Throwing of Objects Prohibited. No person shall carry firearms of any description without a proper permit; nor shall the throwing of stones or other missiles or objects be permitted in parks, playgrounds or recreational areas of the Borough.
e. 
Betting; Gambling Prohibited. Betting, gambling in any form or maintaining gambling equipment is prohibited.
f. 
Ball Playing. Ball playing shall be prohibited except in areas set aside for this activity.
g. 
Posting of Notices Prohibited. It shall be unlawful to post, paste, mail or in any way affix any place card, notice or sign within any park, playground or recreation area unless proper authorization has been made to the Mayor and Council, who shall rule upon the application.
h. 
Disregard for Signs or Posted Notices. It shall be unlawful for any person to enter upon any portions of a park, playground or recreational area in the Borough in disregard of signs or posted notices forbidding same, which signs shall be governed by the terms of this section.
i. 
Swimming Prohibited. No swimming shall be permitted in any waters in parks, playgrounds or recreational areas.
j. 
Boats, Rafts Prohibited; Exception. No person shall put, place or cause to be put or placed a boat, raft or other floatable device into any waters in any park, playground or recreational area within the Borough. This paragraph shall not apply to sailboats or similar craft which are not capable of carrying people or animals.
k. 
Smoking Prohibited. Smoking and/or the carrying of a lighted cigarette, cigar, pipe or other combustible substance, in any manner or any form, including vapor from an electronic smoking device, shall be prohibited at all times, in all Borough parks, playgrounds, playing fields, recreation facilities, and recreational areas. This includes all public areas adjacent to such parks and facilities, including but not limited to the seating areas, parking areas, paths, walkways, driveways, or drive aisles.

No person shall make or kindle an open fire in any park, playground or recreation area of the Borough, except with a proper permit, and in picnic stoves or receptacles provided by the Borough for that purpose. There shall be no charge for such permits, and the permits shall be issued by the Fire Prevention Bureau after proper application being made.

No person shall sell, offer or solicit for sale, in any park, playground or recreational area, any goods or merchandise without first having secured a proper permit from the Police Department or the Board of Health of the Borough, or both. In the event that the New Jersey Statutes or common law exempt a person from such permit, then that Statute or law shall govern.

No person shall throw or deposit or permit any servant, agent or employee to throw or deposit litter, garbage, refuse, or rubbish in or upon any park within the Borough, except in public receptacles or in authorized private receptacles for collection. Where no receptacle is provided or available, all litter shall be carried from the park by the person responsible for it and disposed of elsewhere.

No person shall operate any motor vehicle through or use any park as a throughway. This shall not prohibit the parking of any motor vehicle at duly designated parking areas nor the temporary conveyance of supplies and equipment into any park by motor vehicle for use in the park.
No motor vehicle operated in any park shall exceed a speed of five miles per hour.

It shall be unlawful for any person to hold or conduct any meeting or address any public assemblage, meeting, gathering or to take part in any public debate, entertainment, exhibition or discussion without having first obtained a permit from the Police Department. There shall be no fee for such permit. Permission for such assemblage, address or other activity set forth above shall not be withheld unless there exists a conflict in date whereby two or more activities are planned to occur on the same date, at the same time and in the same place; or, for the reason that traffic will be impeded by virtue of such assemblage; or, if in the opinion of the Mayor and Council, on consultation of the Police Department, such assemblage or activity would be inimicable to public health, safety, welfare and morals. It is expressly stated that it is not the intention of the Mayor and Council to in any way inhibit the rights of free speech or assemblage.

No person shall consume any alcoholic beverages within the limits of the Borough or have in his possession any opened alcoholic beverage container with unconsumed alcoholic beverage therein while in or on a public street, sidewalk, public parking place, park, playground or recreation area, school building or grounds, or any other public or quasi-public place or in any public conveyance.

The authorized officer of any organization, group or association having been granted a permit to use a Borough facility may apply, on a form provided by the Borough Clerk, for a permit for alcoholic beverage consumption. The application shall state the time and place of such occasion requested and such other information as the Borough Clerk may require to identify the group, organization or association and its membership.
Such alcoholic beverage permit shall be valid only between the hours of 10:00 a.m. and 8:00 p.m. (prevailing time) for the location stated on the permit for one day only, except, in their reasonable discretion, the Mayor and Council may extend the hour from 8:00 p.m. to a reasonable hour thereafter, taking into consideration the nature of the affair, the number of people attending, the purpose of the affair, the specific event or series of events, for which a particular organization, group or association may wish to use a public facility.
Permits for outdoor consumption of alcoholic beverages in the areas described above may also be issued to individuals, families or informal groups upon application to the Borough Clerk.
The issuance of permits for the consumption of alcoholic beverages, as provided for herein, is restricted to adults, as defined in the State Statutes, in accordance with State Statutes controlling consumption of alcoholic beverages and in accordance with all regulations of the Alcoholic Beverage Control Commission of the State of New Jersey.
The consumption of alcoholic beverages without a proper permit in the areas above described herein shall be deemed a violation of this section.

No person shall sell, buy, exchange, offer or solicit for sale any alcoholic beverages in the aforementioned areas, except upon written permission of the Borough Clerk or Mayor and Council. The granting of the permission shall be subject to the regulations as set forth in subsection 9-3.3 covering permits.

In the event that any group or organization wishes to drink, imbibe or consume any alcoholic beverage on any portion of any properties which are public school facilities within the Borough, permission shall also be obtained from the Board of Education or its duly authorized representatives.

It shall be unlawful for any person to remain or stay in a park, playground or recreational area between the hours of 10:00 p.m. and sunrise.

No person shall use, or play upon, the tennis courts of the Borough, unless he is the holder of a properly issued permit for the use of the courts. The permit shall be issued by the Borough Clerk upon the payment of the fee as established by the Tennis Committee. The Tennis Committee shall be authorized to adopt rules and regulations governing the use of the tennis courts and hours of play. The tennis courts shall be used for playing tennis exclusively and for no other purpose and any other use shall be considered a violation of this section.

a. 
Establishment and purpose.
1. 
There is hereby established the Haworth Swim Club Advisory Committee (hereinafter referred to as "the Committee") to serve as an advisory body to the Mayor and Council on matters pertaining to the Haworth Swim Club.
2. 
The Committee shall provide recommendations on membership rates, operational improvements, event planning, engage with Swim Club members to gather feedback and address concerns.
3. 
And other related activities to enhance the experience of Swim Club members.
b. 
Membership and structure.
1. 
The Committee shall consist of not less than five and no more than nine members. Members will be current season pass holders of the Haworth Swim Club, representing the general membership, including up to three non-resident members.
2. 
Members shall be appointed by the Mayor with the advice and consent of the Council.
3. 
Each member shall serve a term of two years, with the possibility of reappointment.
4. 
In the event of a vacancy, a new member shall be appointed to fill the unexpired term.
5. 
The members shall receive no compensation for their services. The Committee may designate, among its members, a Chair, Treasurer and Secretary.
c. 
Repealer.
1. 
All ordinances or parts thereof inconsistent with the provisions of this subsection are hereby repealed to the extent of such inconsistency.
d. 
Severability.
1. 
If any section, paragraph, subdivision, clause, or provision of this subsection shall be adjudged invalid, such adjudication shall apply only to that section, paragraph, subdivision, clause, or provision, and the remainder of this subsection shall be deemed valid and effective.
e. 
Effective date.
1. 
This subsection shall take effect immediately upon final passage and publication as required by law.

A paid member, whether resident or non-resident, may bring a guest(s) subject to a $20 fee per guest.
b. 
Each guest's full name must be entered in the comments section of the Spond APP when booking a court.
c. 
The guest fee must be paid via the Spond APP within 24 hours of court use. Failure to pay within this timeframe may result in suspension of court booking privileges.
d. 
Only a paid member may book a court and must be present during the entire game.
e. 
Court time is limited to 90 minutes per session.
f. 
Repeated violations of this policy, including failure to pay guest fees within the required timeframe, may result in removal from the Spond APP for a minimum of two weeks at the discretion of the Pickleball Committee. A member subject to removal may submit a written appeal to the Committee within seven days of notification.

Refers to the soccer, baseball, and softball fields located within the parks and other Borough-owned properties.

Refers to the public parks owned and maintained by the Borough of Haworth, including but not limited to Memorial Field and other area parks.
PUBLIC AREAS
Refers to spaces within the parks and other Borough-owned properties designated for public gatherings, events, or block parties.

The following permit fees shall apply:
a. 
Application fee: $50 (one-time annual). This fee does not apply to permits for one-time events such as a BBQ or a block party.
b. 
Playground/BBQ at Memorial Field/use of other area parks: $50 out-of-town/$25 resident.
c. 
Fee for block party (closure of municipal street): $50.
d. 
Facility and field use fee: $50 per hour, with a cap of $7,500 per permit for the year. This fee applies to both games and practices.

a. 
The Recreation Commission shall have the discretion to recommend fee waivers for organizations that have provided services to Borough recreation programs or are engaged in activities that directly benefit the Borough's recreational offerings. Waivers may be considered based on the nature of the event or program and its benefit to the community.
b. 
The Mayor and Council must approve all fee waivers. The Mayor and Council will review recommendations from the Recreation Commission and determine whether the waiver aligns with the Borough's interests and community goals.

All fees established herein shall be subject to annual review and may be adjusted by resolution of the Mayor and Council.
