There is hereby adopted by reference the Standard Unsafe Building Abatement Code, published in pamphlet form by the Southern Building Code Congress, 1985 Edition. A copy of said code shall be kept in the Clerk's office and in the Building Inspector's office.

The term "building official" as used in said code shall mean the Building Inspector. The term "office of the recorder" as used in said code shall mean the office of the City Clerk. The term "fire official" as used in said code shall refer to assistants to the Fire Marshal as designated in the Code of Alabama.

Section 105.1 of said code is deleted and the following substituted therefor:
105.1 - APPOINTMENT
A Board of Adjustments and Appeals shall be established for the express purpose of providing for the hearing permitted by this Code. The Board shall consist of five members who are not employees of the City, who shall be appointed by the City Council. The members shall be residents of the City.

Wherever in said code it is provided that anything must be done to the approval of, or subject to the direction of, the Building Inspector, or wherever the Building Inspector is authorized to act or determine anything in his discretion, this shall be construed to give such officer only the discretion of determining whether the rules and standards established by ordinance have been complied with; and no such provision shall be construed as giving any officer discretionary powers as to what such regulations or standards shall be, or power to require conditions not prescribed by ordinance, or to enforce ordinance provisions in an arbitrary or discriminatory manner.

A. 
It shall be unlawful to build, erect or construct any building or buildings, house or shed within 200 feet on either side of a line drawn through the center of Main Street from the old courthouse in the Town of Columbiana to the intersection of Depot Street with Main Street other than of stone, cement tile or brick.
B. 
It shall be unlawful to use shingles or other materials other than fireproof shingles or materials on any building or buildings by way of repairs or otherwise within 200 feet on either side of a line drawn through the center of Main Street from the old courthouse in the Town of Columbiana, Alabama, to the intersection of Depot Street with Main Street.
C. 
It shall be unlawful to build, erect or construct or to make any repairs on any buildings already constructed within 200 feet on either side of a line drawn through the center of Main Street from the old courthouse in the Town of Columbiana, Alabama, to the intersection of Depot Street with Main Street without first presenting to the Town Council written plans and specifications of the proposed buildings or repairs with description of lot upon which the same are to be erected, and obtaining from said Council written permit to erect said building or make such repairs.
D. 
Any person, firm or corporation violating any of the provisions of this section shall be guilty of a misdemeanor, and on conviction thereof shall be fined not less than $5.00 nor more than $100.00, and may also be imprisoned in the Town Jail or sentenced to hard labor for the Town not exceeding six months.
