The Village has been developed substantially with single-family dwellings located on streets usually about 24 feet in paved width. Many of the dwellings are on cul-de-sacs. Too often, residents have held large parties with totally insufficient on-site parking for their many guests, and have engaged private valet parking companies to park the vehicles of their guests. Often the number of valets is insufficient to timely park all of the arriving vehicles, and many times the vehicles are parked in such a manner as to make it difficult for vehicles travelling in opposite directions to pass each other. At other times streets have been totally closed off by valets, or otherwise blocked by the vehicles parked by the valets, so that firefighters, emergency medical personal, and police could not pass in their vehicles to promptly respond to an emergency. It is the intention of this chapter to address those issues for the health, safety, and property of the residents of the Village and their guests.

As used in this chapter, the following terms shall have the meanings indicated:
The Commissioner of the Village Police Department or the Commissioner's designee.
A valet parking permit.
Every individual who has any ownership interest in or holds any office or management position with the valet company.
A person working for a valet company during a valet event.
An entity that provides valet services.
A period of time when a valet company will be performing valet services within the Village.
Parking vehicles for another.
A vehicle parked by a valet.
A.
No valet company shall provide valet services for a valet event without a permit issued by the Commissioner.
B.
No valet shall provide valet services for a valet event unless the valet company for which the valet is working has acquired a permit for that valet event.
C.
No person shall engage a valet company to provide valet services for a valet event that does not have the required permit for that valet event.
D.
A permit shall be a period of one year from the date it is issued.
E.
The fee for a permit shall be established, from time to time, by resolution of the Board of Trustees.

A.
The application shall contain the following information:
(1)
The name of the valet company.
(2)
The address of the valet company.
(3)
The email address of the valet company.
(4)
A telephone number at which the valet company may be reached at all times during a valet event.
(5)
The names of every principal of the valet company.
(6)
Proof of the required insurance, as shall be established, from time to time, by resolution of the Board of Trustees.
(7)
A copy of a street map clearly identifying the staging area and all of the proposed parking locations.
A.
Not less than seven days before a valet event, the valet company shall give written notice to the Commissioner with the following information:
(1)
The name, telephone number, and residence address of the individual or individuals who engaged the valet company.
(2)
The street address or addresses of where the valet services are to be provided.
(3)
The date of the valet event.
(4)
The time when the valet event will begin and the time when it will end.
(5)
The name and mobile telephone number of the individual who will be supervising the valets during the valet event.
(6)
The names of the valets who will be providing valet services for the valet event.
B.
The Commissioner shall have the discretion to waive the seven-day period if special circumstances should require the shorter notice.

It is a violation of this chapter for a valet to violate any of the following rules.
A.
A valet shall at all times wear visible, above the waist, letters stating "valet", with letters not less than eight inches high and 1 1/2 inches wide.
B.
All vehicles shall be parked only on one side of a street.
C.
If a vehicle is parked on one side of a street, no valet vehicle shall be parked or remain parked on the opposite side of the street of that vehicle.
D.
The streets, whether public or private, shall at all times be sufficiently clear of valet vehicles for fire trucks and other emergency vehicles to safely pass.
E.
At no time shall streets, whether public or private, be closed.
F.
At no time shall valet vehicles be parked so that there are not distances of at least 20 feet along the side of the road at which no vehicles are parked, which shall not be less than 400 feet apart, to assure that there is a way for emergency vehicles to pass oncoming vehicles.
G.
At no time shall the staging or the parking of valet vehicles be other than in accordance with the staging area and parking locations submitted with the application for the valet permit.
If two vehicles are parked opposite each other on a street, or if vehicles are parked in such a manner as to prevent the ability of fire trucks and other emergency vehicles to safely pass, or if streets are closed, it shall be an affirmative defense that none of such parked vehicles were parked by the valets or that the valets did not close the street.
A violation of this chapter shall be punishable by one or more of the following penalties, which, other than the fines that only may be imposed by the Village Justice Court, may be imposed by the Superintendent of the Building Department or the Board of Trustees.
A.
A suspension or revocation of a permit.
B.
A prohibition of obtaining a permit for a period of not more than one year. Such prohibition may be against the valet company and/or every valet company of which one of the principals of the violating valet company is a principal.
C.
A fine for a first offense within a one-year period of not less than $500, nor more than $1,000.
D.
A fine for a second offense within a one-year period of not less than $1,000, nor more than $3,000.
E.
A fine for a third or more offenses within a one-year period of not less than $2,000, nor more than $5,000.
