B. "Dealer"
means a person, partnership, association, or corporation engaged in the business of selling off-road vehicles at wholesale or retail in the state of Washington.
C. "Highway roads"
means the entire width between the boundary lines of every roadway publicly maintained when any part thereof is open to the use of the public for the purpose of vehicular travel.
D. "Nonhighway roads"
means roads that are owned or managed by a public agency, a primitive road, or any private road where the owner has granted an easement for public use, and does not receive funds from the motor vehicle account.
E. "Off-road vehicle,"
hereinafter "ORV," shall mean a four-wheeled vehicle where the passenger sits behind the operator of the vehicle, manufactured primarily for recreational nonhighway all-terrain use.
F. "Operator"
means each person who operates or is in physical control of any nonhighway vehicle.
G. "Primitive road"
means a linear route managed for the use of four-wheel drive or high-clearance vehicle that is generally not maintained or paved.
I. "Wheeled all-terrain vehicle,"
hereinafter "ATV" or "utility vehicle," shall mean a four-wheeled vehicle where operator and passenger sit side by side in the vehicle, manufactured primarily for recreational nonhighway all-terrain use.

For the purpose of this chapter, "off-road vehicles" (ORV) does not include wheeled all-terrain vehicles. (Example: quad – where the rider sits behind the operator.)
