No person, corporation, partnership or association shall keep bees within the City without a written permit to do so from the Health Officer of the City, which permit shall only be issued by such officer after a written application has been submitted to such officer by the would-be beekeeper setting forth the following information:
A. 
Name and address of applicant;
B. 
Location and dimensions of lot or parcel of land where applicant proposes to keep bees;
C. 
Whether the applicant proposes to keep bees as a hobby, for the production of honey for the use of applicant and applicant's family, or for sale or commercial purposes;
D. 
The number of hives the applicant proposes to keep and the distance from the property lines of applicant's property where such hives are to be placed.

The Health Officer shall, upon the submission to him of such application, and before issuing such permit, investigate the proposed location where the applicant desires to keep bees, the surrounding neighborhood, and all other matters indicating whether the keeping of bees by the applicant might result in a public or private nuisance, or both, and if the Health Officer finds and determines that the keeping of bees by the applicant in accordance with such application will probably not result in either a public or a private nuisance, he shall issue a written permit to the applicant.

No permit shall be issued by the Health Officer for the keeping of any hive or hives at a distance of less than 300 feet from a public school, park or playground; no permit shall be issued for the keeping of more than three hives; and every such permit issued under this chapter shall expire at the end of one year from the date of its issuance, at which time in every case a new application for a permit, as prescribed, must be submitted to the Health Officer.

Anyone keeping bees without a valid written permit from the Health Officer shall be guilty of a misdemeanor and shall, upon conviction, be subject to a fine not to exceed $100.00 or to imprisonment in the County Jail not to exceed 30 days, or to both such fine and imprisonment.
