Prior legislation: Ords. 864, 1058, 1083 and 1094.
The following municipal parking lots are established as described below:
A. 
Municipal Parking Lot No. 1, being the on-street and off-street parking spaces approximately bounded on the north by Anchor Street, on the west by Tracy Way (formerly Park Street), on the south by San Francisco Bay and on the east by Humboldt Avenue.
B. 
Municipal Parking Lot No. 2, being the on-street and off-street parking spaces approximately bounded on the north by Bay Street, on the west by Bridgeway Boulevard, on the south by Anchor Street and on the east by Humboldt Avenue.
C. 
Municipal Parking Lot No. 3, being the off-street parking spaces approximately bounded on the north by Dolphin Street, on the west by Assessor's Parcel No. 65-037-07 and Bridgeway Boulevard, on the south by Bay Street, and on the east by Humboldt Avenue.
D. 
Municipal Parking Lot No. 4, being the on-street and off-street parking spaces approximately bounded on the north by Johnson Street, on the west by Assessor's Parcel Nos. 65-037-01, 65-037-03, 65-037-06 and 65-037-07, on the south by Dolphin Street and on the east by Humboldt Avenue.
E. 
Municipal Parking Lot No. 5, being the on-street and off-street parking spaces situated on portions of Locust Street and Humboldt Avenue, and approximately bounded on the north by Assessor's Parcel Nos. 64-078-03, 64-086-01 and 64-087-01, on the west by Bridgeway Boulevard, on the south by Assessor's Parcel Nos. 65-031-01, 65-032-01 and 65-032-03 and on the east by Richardson Bay.

The City Manager or their designated representative is authorized and directed to install, maintain and operate the necessary parking revenue equipment within municipal parking lot facilities operated by the City as shall be specified by resolution adopted by the City Council, for the purpose of, and in such numbers, and at such places, and for such days and hours, as to provide for the efficient control and regulation of the parking of vehicles therein.

A. 
Fees and operational hours for the parking of vehicles in Municipal Parking Lot Nos. 1, 2, 3, 4 and 5 shall be established by resolution adopted by the City Council.
B. 
Fees for the resident parking program operating within the municipal parking lots shall be established by resolution adopted by the City Council.
C. 
Fees for the downtown resident, employee and commuter parking programs operating within the municipal parking lots shall be established by resolution adopted by the City Council.

The City Manager or their designated representative shall enroll eligible applicants to the resident parking program under the following criteria:
A. 
Any person able to provide proof of residency at an eligible address as defined within this section may apply for and obtain a resident parking passcard allowing them to receive a parking benefit established by resolution adopted by the City Council.
1. 
Proof of residency may include, but is not limited to, a receipt of rent payment or a signed copy of a lease agreement, a receipt of property tax payment (dated within the last 90 days), a phone, internet, gas, electricity, water, garbage or other utility bill (dated within the last 30 days).
2. 
Eligible addresses are defined as any residential address within the 94965 ZIP code.
3. 
A post office box or a nonresidential address within the 94965 ZIP code shall not be deemed an eligible address.
B. 
At the time of initial application and any subsequent renewal or reapplication, each applicant shall be required to do the following before their application shall be processed:
1. 
Each applicant shall present the documents specified in this section as proof of their continuing compliance with the provisions of this chapter.
2. 
Each applicant shall agree to the policies and terms of service of the resident parking program established by resolution adopted by the City Council. Intentional violation of the policies and/or terms of service shall result in the applicant forfeiting eligibility for current and/or future enrollment in the program.
3. 
Each applicant shall submit payment of any necessary application fees.
C. 
The City Manager or their designated representative may waive any or all program enrollment criteria at their discretion.

The City Manager or their designated representative shall enroll eligible applicants to the downtown resident, employee and commuter parking programs under the following criteria:
A. 
Any person able to provide proof of residency at an eligible address as defined within this section may apply for and obtain a resident "D" parking permit and may park at no additional cost in Municipal Parking Lot Nos. 3, 4 and 5 when displaying a current and valid permit.
1. 
Proof of residency may include, but is not limited to, a receipt of rent payment or a signed copy of a lease agreement, a receipt of property tax payment (dated within the last 90 days), a phone, internet, gas, electricity, water, garbage or other utility bill (dated within the last 30 days).
2. 
Eligible addresses are defined as any residential address within the following areas:
a. 
Bridgeway Boulevard, Nos. 400 – 1000.
b. 
Princess Street, Nos. 1 – 40 and Nos. 90 – 92.
c. 
Excelsior Lane, No. 7.
3. 
A post office box or other nonresidential address shall not be deemed an eligible address.
B. 
Any person possessing a valid California State operator's license and who also possesses a current and valid California State vehicle registration certificate showing such person as the owner or lessee may apply for and obtain an employee and commuter parking permit as described below:
1. 
An employee "D" parking permit allows an enrolled applicant to park at no additional cost in Municipal Parking Lot Nos. 3, 4 and 5 when displaying a current and valid permit.
2. 
An employee "L" parking permit allows an enrolled applicant to park at no additional cost in Municipal Parking Lot No. 5 when displaying a current and valid permit.
3. 
A daily parking card allows an enrolled applicant to park at a discounted cost in Municipal Parking Lot Nos. 3 and 4 when using said daily parking card at such parking revenue equipment as is installed in the municipal parking lots.
C.

The City Manager or their designated representative may permit the parking of a vehicle in any municipal parking lot without charge when such action is necessary to protect the public peace or safety or is of direct benefit to the City. Such parking privileges without charge may include, but are not limited to, vehicles operated by special guests of the City, public safety personnel and agents and employees of other governmental jurisdictions.

A. 
It is unlawful for any person to cause, allow, permit or suffer any vehicle registered in their name or operated or controlled by them to be parked or left standing in any municipal parking lot without paying the fee required therefor, or without clearly displaying and having affixed to their vehicle a current and valid parking permit issued pursuant to the provisions of this chapter.
B. 
It is unlawful for any person to cause, allow, permit or suffer any recreational vehicle as defined in Section 18010 of the Health and Safety Code of the State of California, and which is registered in their name or operated or controlled by them, to be parked or left standing in any municipal parking lot between the hours of 2:00 a.m. and 6:00 a.m.
C. 
It is unlawful for any person, at any time, to cause, allow, permit or suffer any vehicle registered in their name or operated or controlled by them to be parked in any municipal parking lot except in a parking space clearly designated as such by pavement markings.

Any person violating any of the provisions of this chapter shall be deemed guilty of an infraction, and upon conviction thereof shall be subject to a fine established by resolution adopted by the City Council.
