The City Council finds that the violation of this title by the placement of an obstruction in the public right-of-way in violation of the provisions of this title constitutes the maintenance of a public nuisance and an immediate threat and danger to the public. Any such obstruction shall be summarily abated by any peace officer or by the City Engineer or his designee, and maintained in the custody of the City Public Works Department. Where identifying information found on the summarily abated item makes the owner of the item readily identifiable, such owner shall be informed within a reasonable time of the City's abatement and maintenance of the item. Such summarily abated item shall be returned to the owner of such item upon payment of all costs incurred by the City in abating and storing such item.
