For purposes of this chapter, the following terms shall be defined as follows, unless a different meaning is expressly provided:
A. 
"Commercial vehicle"
means and includes any vehicle the principal use of which is the transportation of commodities, merchandise, produce, freight, animals or passengers for hire.
B. 
"Crosswalk"
means the portion of the roadway between the intersection area and a prolongation or connection of the farthest sidewalk line or in the event there are no sidewalks then between the intersection area and a line 10 feet therefrom, except as modified by a marked crosswalk. A "marked crosswalk" is any portion of a roadway distinctly indicated for pedestrian crossing by lines or other markings on the surface thereof.
C. 
"Home business"
means any accessory activity customarily conducted in a dwelling, or in a building or structure accessory to a dwelling, for gainful employment involving the manufacture, provision or sale of goods and/or services, and where the residential character of the dwelling and neighborhood is maintained.
D. 
"Public right-of-way"
means any dedicated or developed property used or intended for use as public streets, alleys or other means of public ingress, egress or passage whether the property of the city, county, or state.
E. 
"Residential area"
means those areas in the city designated as zoned residential districts, such as low density residential (LDR), medium density residential (MDR), and high density residential (HDR), pursuant to SMC Title 18.
F. 
"Trailer"
means and includes every vehicle without motor power designated for being drawn by or used in conjunction with a motor vehicle; provided, that the term shall not include recreational vehicles such as travel trailers.
G. 
"Truck"
means and includes any motor vehicle designed primarily for the transportation of property.
H. 
"Motor vehicle"
means every vehicle which is self-propelled.
I. 
"Vehicle"
includes every device capable of being moved upon a street or public highway and in, upon, or by which any person or property is or may be transported or drawn upon a public highway.
J. 
"Recreational vehicle (RV)"
means a privately owned motor vehicle or travel trailer used for recreational purposes which is self-contained. The RV designation does not pertain to those RV vehicles being parked as part of a commercial activity such as repairs, sales or servicing or are being used for a commercial purpose.
K. 
"Food truck"
means an operable motor vehicle used to serve, vend, or provide ready-to-eat food or nonalcoholic beverages for immediate consumption, with or without charge, and is operated from a temporary location on a public way.
L. 
"Food truck vending"
means the sale of primarily food and/or nonalcoholic beverages from a food truck upon public ways of the city. Other items may be sold in conjunction with food truck vending items.
M. 
"Food truck vendor"
means a person who engages in the activity of food truck vending.
N. 
"Mailbox,"
in addition to its common meaning, means any authorized depository or receptacle of mail for the United States Postal Service or authorized depository for a commercial carrier that provides services to the general public, including any address to which mail is or can be addressed, or a place where the United States Postal Service or equivalent commercial carrier delivers mail to its addressee.
O. 
"Bicycle lane"
means any paths or parts of roadways set aside for the designated use of bicycles.

The purpose of this chapter is to ensure the effective utilization of the city's public parking resources, protect the general welfare, support commerce, protect residential uses, and implement the downtown parking strategy adopted by Resolution No. 883.
The Director of Public Works is authorized to establish time limits for parking on city streets and roadways. The Director’s determinations must be consistent with the provisions of this chapter. To be effective and enforceable, any such established time limitation must be posted clearly on an official street sign that also identifies the area of time-limited parking.

A. 
It is unlawful for any person to park or leave standing on any street within a residential area or on that portion of a street abutting a residential area any of the following:
1. 
A truck with a gross vehicle weight rating (GVWR) in excess of 24,000 pounds, or being in excess of 22 feet in length;
2. 
A trailer having a GVWR in excess of 10,000 pounds or being in excess of 20 feet in length;
3. 
A commercial vehicle having a width of 96 inches (eight feet) or more;
4. 
Any truck or trailer not having a current and valid truck or trailer license;
5. 
Any truck, trailer or other motor vehicle which constitutes a street or driveway sight distance obstruction or impairs the movement of emergency vehicles along the street;
6. 
Any recreational vehicles over 24,000 pounds GVWR or being greater than 28 feet in length regardless of GVWR, except as provided in SMC § 10.36.114.1; provided, however, notwithstanding SMC § 10.36.114.1, RVs exceeding eight feet, six inches in width, or 14 feet in height or 32 feet in length shall be prohibited from parking on residential streets.
B. 
No person shall park or allow to remain standing on or in the public right-of-way any commercial truck, trailer, or truck-trailer combination, as follows:
1. 
No person shall park or allow to remain standing for more than eight hours at a time any truck, trailer or truck-trailer combination over 24,000 pounds gross weight capacity upon any of the streets, avenues or alleys within the city limits unless otherwise specified in this chapter.
2. 
No commercial trailer may be detached from a motorized vehicle and left unattended in the public right-of-way unless otherwise specified in this chapter.
3. 
No unattended vehicle of any size carrying hazardous materials shall be allowed to park at any time upon any of the streets, avenues or alleys within the city limits.
4. 
Between the hours of 9:00 p.m. and 6:00 a.m., no person shall park a commercial vehicle upon the public right-of-way within 500 feet of residential dwellings and permit any motor, engine, compressor or other device to operate for more than 10 consecutive minutes or a total of 10 minutes within any two-hour period.
5. 
On 24th Street East from the West Valley Highway east to the White River foot bridge.
6. 
On both sides of 132nd Avenue East from 16th Street East south to the end of the street.
7. 
On the north side of 45th Street East from Tacoma Avenue east to the end of the road.
8. 
On the west side of 149th Avenue East and 150th Avenue Court East from 45th Street East north to the end of the road.
9.

10.

On the south side of 32nd Street East beginning at a point 150 feet east of 142nd Avenue East easterly to the end of the road.
4. 
On the south side of 45th Street East from a point 350 feet east of Tacoma Avenue east to the end of the road.
5. 
On both sides of 48th Street East from West Valley Highway east to the end of the road.
6. 
On both sides of 52nd Street East from West Valley Highway east to the end of the road.

On both sides of Williams Avenue from Puyallup Street south to the end of the road.

A. 
Authority for Administration of Restricted Parking Zones. The city of Sumner, by ordinance, may establish a restricted parking zone in which:
1. 
Parking in the street is reserved for the exclusive use of abutting properties and/or residents in a prescribed vicinity; vehicles used by their visitors; and service vehicles of persons having business in the street; or
2. 
Parking in the street is reserved during certain posted hours for such exclusive use and available at all other times without restriction; or
3. 
Time limits are established for parking in the street which apply to all vehicles except vehicles owned or used by such residents, their visitors or service vehicles of persons having business in the street or with the residents; or
4. 
Each restricted parking zone shall be subject to review by the city council after its first six months of operation; or
5. 
In any restricted parking zone, the city may issue permits or other means of identification, maintain lists of vehicles owned or used by residents, or adopt any other reasonable means of distinguishing vehicles that may validly be parked in any restricted parking zone from other vehicles. The establishment of restricted parking zones shall not limit parking of vehicles displaying a card or decal issued pursuant to RCW 46.16.381. Restricted parking zones shall be appropriately signed and/or marked.
B. 
Establishing Restricted Parking Zones. Restricted parking zones may be established either:
1. 
Upon a petition of the majority of the residential households in a neighborhood, which is presented to the director of community development; the director of community development may recommend to the city council establishment of a restricted parking zone whenever 60 percent or more of the capacity of the streets available for parking in such neighborhood is generally occupied during regular business hours or any consecutive six-hour period on both Saturdays and Sundays, or any consecutive four-hour period for five consecutive days, Monday through Friday, during nonbusiness hours; at least 30 percent of the vehicles parked on the street in the area during such hours are not owned by residents of the immediate neighborhood, persons visiting them, or doing business in the street or with such residents; and the public interest would be served. If a petition initiates the process, the director of community development, after review by the director of public works, shall, within 180 days, forward the petition, with recommendations thereon, to the city council; or
2. 
Upon a recommendation from the community development director which is presented to the city council. Such a recommendation shall be made as part of an area-wide strategy for addressing parking issues in a particular area of the city. The strategy shall be presented for consideration to the city council at a public hearing and the adoption of an enabling ordinance.
C. 
Repeal of Restricted Parking Zone. Notwithstanding the authority granted the director of public works in subsection E of this section to recommend the abolition of restricted parking zones, the majority of the residents of a neighborhood, which has been designated a restricted parking zone, may petition the city to remove such parking restrictions in that neighborhood that were originally established under the authority of this section. The director of community development, after review by the director of public works, shall forward the petition, with recommendations thereon, to the city council.
D. 
Director of Community Development – Authority. The director of community development, or his/her designee, will process applications for restricted parking zones, recommend designation of restricted parking zones, and implement rules and regulations for the use of restricted parking zones and the issuance, use, and revocation of permits.
E. 
Director of Public Works – Authority. The director of public works, or his/her designee, will recommend the establishment, revision, or abolition of restricted parking zones as described in this section, and shall hear, review, and approve or disapprove any protests or appeals regarding the issuance or denial of any permit, or the installation of any traffic control device or the establishment of any regulation pursuant to this section. The director may recommend the establishment, revision, or abolition of restricted parking zones as outlined in this section. The director will make surveys and recommendations with respect to restricted parking zones and make appropriate recommendations to the director of community development.
F. 
Restricted Parking Zone Defined. A portion of the street commonly used for vehicular parking, which, except as to vehicles displaying a card or decal issued pursuant to RCW 46.16.381, is:
1. 
Reserved for the exclusive use of vehicles owned or used by residents of the abutting properties and/or residents in the prescribed vicinity and vehicles used by their visitors; and service vehicles of persons having business in the street or with abutting or nearby residents;
2. 
Reserved for such exclusive use during certain hours; or
3. 
Subject to time limits that apply to parking of all vehicles except vehicles owned or used by such residents or their visitors, or service vehicles of persons having business in the street or with the residents.
G. 
Neighborhood Defined. For the purpose of this section, a "neighborhood" shall be defined as both sides of the traveled portion of the street for a minimum distance of one city block.
H. 
Restricted Parking Zone. No person shall stop, stand or park a vehicle in violation of the posted or marked restrictions or when a permit or other authorization issued by the city is required as a condition for parking the same, or without a card or decal issued pursuant to RCW 46.16.381 being displayed in a prominent place on the vehicle. The following restricted parking zones and times are established, with parking prohibited without a permit issued by the city:
Zone 1
Parking is allowed for a maximum of one hour without a permit in the following locations and between the specified times:
1.
Bonney Avenue, between Main and Academy Streets, and between Washington and 16th Streets, between the hours of 7:00 a.m. and 3:30 p.m., weekdays.
2.
East side of Lewis Avenue, between Main and Academy Streets, between the hours of 7:00 a.m. and 3:30 p.m., weekdays.
3.
Meeker Avenue, between Main and Park Streets, except on the west side of the street, between the hours of 7:00 a.m. and 3:30 p.m., weekdays, except where designated per SMC § 10.36.095(B).
4.
Maple Street, between Bonney and Meade Avenues, between the hours of 7:00 a.m. and 3:30 p.m., weekdays.
5.
South side of Main Street, from Lewis Avenue extending east approximately 200 feet, where abutting a residential zoning district, between the hours of 7:00 a.m. and 3:30 p.m., weekdays.
6.
Academy Street, between Lewis Avenue and Meeker Avenue, between the hours of 7:00 a.m. and 3:30 p.m., weekdays.
7.
North side of Mason Street, between Wood Avenue and the eastern terminus of Mason Street, between the hours of 7:00 a.m. and 3:30 p.m., weekdays.
8.
Langdon Street, between Wright and Bonney Avenues, between the hours of 7:00 a.m. and 3:30 p.m., weekdays.
9.
Everett Street, from McMillan to Bonney Avenues, between the hours of 7:00 a.m. and 3:30 p.m., weekdays.
10.
Lewis Avenue, from Voight Street to Academy Street, between the hours of 7:00 a.m. and 3:30 p.m., weekdays.
11.
West Main Street between Traffic Avenue and Hunt Avenue between the hours of 7:00 a.m. and 7:00 p.m., weekdays and weekends.
12.
Elizabeth Street between Hunt Avenue and Traffic Avenue between the hours of 7:00 a.m. and 7:00 p.m., weekdays and weekends.
Zone 2
Parking is allowed for a maximum of one-half hour without a permit in the following locations between the specified times:
1.
East side of Graham Avenue, between Washington Street and Daffodil Street Court East, between the hours of 4:00 p.m. and 10:00 p.m., weekdays, and between the hours of 9:00 a.m. and 5:00 p.m., weekends.
2.
Daffodil Street Court East, between 156th Avenue Court East and Graham Avenue, between the hours of 4:00 p.m. and 10:00 p.m., weekdays, and between the hours of 9:00 a.m. and 5:00 p.m., weekends.
3.
54th Street East, between 156th Avenue Court East and Graham Avenue, between the hours of 4:00 p.m. and 10:00 p.m., weekdays, and between the hours of 9:00 a.m. and 5:00 p.m., weekends.
Zone 3
Parking is allowed for a maximum of three hours without a permit in the following locations between the specified times:
1.
Cherry Avenue, between Park Street and Maple Street, between the hours of 7:00 a.m. and 7:00 p.m., weekdays, except as provided in SMC § 10.36.060(N).
2.
South side of Maple Street, between Cherry and Kincaid Avenues, except where posted for handicapped-accessible parking, between the hours of 7:00 a.m. and 7:00 p.m., seven days per week.
3.
North side of Academy Street from Cherry Avenue to Kincaid Avenue, between the hours of 7:00 a.m. and 7:00 p.m., seven days per week.
4.
West side of Kincaid Avenue from Academy Street to Maple Street, between the hours of 7:00 a.m. and 7:00 p.m., seven days per week.
5.
North side of Harrison Street from Cherry Avenue to Narrow Street, between the hours of 7:00 a.m. and 7:00 p.m., seven days per week.
6.
Kincaid Avenue between Academy Street and Thompson Street, except on the west side of the street from Park Street to Thompson Street, between the hours of 7:00 a.m. and 7:00 p.m., weekdays, except as provided in SMC § 10.36.060(F).
7.
Alder Avenue between Academy Street and Park Street between the hours of 7:00 a.m. and 7:00 p.m., weekdays.

I. 
Abuse of Privileges in Restricted Parking Zones. No person shall for any valuable consideration offer or agree to authorize or permit another person to park a vehicle in any restricted parking zone. No person shall for any valuable consideration transfer or authorize the use of any permit or other identification issued by the city authorizing a vehicle to park in any restricted parking zone.
1. 
Any person to whom a permit or other authorization is granted to park in a restricted parking zone shall be strictly liable for compliance with its terms and conditions and for complying with this section. Any such permit or other authorization issued shall be revoked if any person to whom such permit is issued or authorization granted shall:
a. 
Offer or agree to authorize or permit another person to park a vehicle in any restricted parking zone for monetary consideration;
b. 
Transfer for money the use of any permit or other identification issued by the city authorizing a vehicle to park in any restricted parking zone;
c. 
Allow another person under his/her control to do either subsection (I)(1)(a) or (b) of this section; or
d. 
Allow a permit or other authorization issued to him to be so used.
2. 
No new permit may be issued or other authorization granted to any such person found to have abused his or her restricted parking zone privilege, as defined herein, for a period of one year.
3. 
Any authorization or permit granted to park within a restricted zone shall be valid for use only within the parking zone for which the authorization was issued.

No person shall park or allow to remain standing any automobile, truck or other vehicle for more than the consecutive hours as noted, Monday through Friday between the hours of 8:00 a.m. and 5:00 p.m., except holidays, in the following public off-street parking lots:
A. 
Parking Lot 1 (NE corner of Ryan Avenue and North Street), west half of Lot 9 and Lots 10, 11 and 12, Block A, Sumner Addition: time limit, four hours;
B. 
Parking Lot 2 (1309 Main Street), Lot 38, Block A, Sumner Addition: time limit, four hours;
C. 
Parking Lot 3 (south of Main Street), north 50 feet of Lot 3, Block 2, Sumner Addition: time limit, three hours;
D. 
Parking Lot 7 (south of Main Street), Lot 10, Block 2, Sumner Addition: time limit, three hours;
E. 
Parking Lot 8 (SE corner of Ryan Avenue and Main Street), Lot 3, Ryan's 1st Addition: time limit, three hours;
F. 
Parking Lot 9 (SE corner of Ryan Avenue and Main Street), east 26.33 feet of Lot 1 and Lot 2, Ryan's 1st Addition: time limit, three hours;
G. 
Parking Lot 10 (1008 North Street), south 60 feet of Lot 19, Block A, Sumner Addition, except as provided in subsection (B) of this section: time limit, six hours;

Parking Lot 12, adjacent to the south side of the City Hall: city vehicles only.

A. 
Persons displaying a parking permit placard/mirror hanger provided by the city of Sumner, per subsection (B) of this section, or its designated agent may park without time limit in the public off-street parking lots as designated in SMC § 10.36.080(A) through (H).
B. 
The following procedures are for the issuance and administration of the parking permit placard/mirror hanger:
1. 
Beginning on a pre-announced day, the city or its agent will issue 30 permit placards with an expiration date set 24 months after issuance. First day distribution will be on a first-come-first-serve basis with a limit of two placards per person. If any placards remain after the first distribution day, a second distribution day will be held with a limit of two placards per person also in effect. Additional distribution days may be held until all 30 placards are distributed.
2. 
On each such expiration date, the city will issue 30 more permit placards with revised 24-month expiration date. Distribution will be as per subsection (B)(1) of this section.
3. 
Parties wishing to receive permit placards are required to be licensed businesses in the city of Sumner. A copy of a current city of Sumner business license must be provided upon application for a parking permit placard under this section.
4. 
A fee of $100.00 will be charged for replacement of any lost, stolen, or otherwise misplaced placard.
5. 
Holders of placards may transfer, temporarily or for the 24-month life of the placard, control of the placard to any other party. Placards may be used by any passenger vehicle and are not necessarily restricted to use by one particular holder. However, the city will not be responsible for monitoring such shared use or resolving disputes about such.
6. 
To avoid a violation of the parking time limit in the above referenced lots, the placard must be displayed on the dashboard or hung from the mirror of a vehicle. The placards are for use in the above eight city-owned parking lots only.
C. 
The mayor or the mayor's designee has the authority to establish parking restrictions, rates, fees, and permitting practices and procedures to pay to park in municipal parking lots. Parking lots which require payment to park will be clearly identified. Parking permits will be issued to park in a lot but not necessarily a specific parking stall within said lot. No parking restrictions shall apply to law enforcement or other emergency and city vehicles when in service.

Parking shall only be allowed for food trucks and food truck customers between the hours of 10:00 a.m. and 3:00 p.m., Monday through Friday, in the following locations:
A. 
On the south side of 45th Street East beginning from a point 600 feet east of Tacoma Avenue to the end of the road.

No person shall park or allow to remain standing any automobile, truck or other vehicle in areas designated as loading zones for purposes other than the loading or unloading of passengers and/or materials. When a time limit for the zone is posted on an official sign, it is unlawful for a person to park or allow any vehicle to remain standing in the zone for longer than the posted time limit.

A. 
No person shall park or allow to remain standing any automobile, truck or other vehicle for more than 15 minutes for the purpose of loading or unloading school-related passengers and/or materials between the hours of 7:00 a.m. and 3:30 p.m. of each day, except Saturdays, Sundays and holidays, upon the following streets:
1. 
The north side of Main Street adjacent to 1707 Main Street, between the bus loop entrance and exit; and
2. 
The west side of Meeker Avenue from Main Street to a point 80 feet south.
B. 
Except for Sumner High School buses, no person shall park or allow to remain standing any automobile, truck or other vehicle on the south side of Mason Street from Wood Avenue to the eastern terminus of Mason Street, between the hours of 7:00 a.m. and 3:30 p.m., school weekdays.

No person shall park or allow to remain standing any automobile, truck or other vehicle for more than 15 minutes at a time between the hours of 8:00 a.m. and 5:00 p.m. of each day, except Saturdays, Sundays and holidays, upon the following street: the south side of Maple Street from Alder Avenue East to the west side of the alley.

The police chief is authorized to establish permits and accompanying rules to authorize residents and their guests with no on-site parking to park within subject parking areas in excess of these regulations.

Except when necessary to avoid conflict with other traffic, or in compliance with law or the direction of a police officer or official traffic control device, no person shall:
A. 
Stop, stand or park any automobile, truck or other vehicle:
1. 
On the roadway side of any automobile, truck or other vehicle stopped or parked at the edge or curb of a street,
2. 
On a sidewalk or street planting strip,
3. 
Within an intersection,
4. 
On or within 20 feet of a marked or unmarked crosswalk,
5. 
Between a safety zone and the adjacent curb or within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless official signs or markings indicate a different no-parking area opposite the ends of a safety zone,
6. 
Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct traffic,
7. 
Upon any bridge or other elevated structure upon a highway or within a highway tunnel,
8. 
On any railroad tracks,
9. 
In the area between roadways of a divided highway including crossovers,
10. 
At any place where official signs prohibit stopping, standing, or parking, or for a length of time that exceeds the time limit posted on an official parking sign for that parking location,
11. 
Outside the designated or marked parking stall lines and in no event shall the vehicle or portion of vehicle occupy more than one parking stall,
12. 
Within 10 feet of a clearly visible mailbox which is located directly adjacent to a curbside or on a public right-of-way, between the hours of 8:00 a.m. and 5:00 p.m., except on Sundays and holidays, or
13. 
Upon any marked bicycle lane;
B. 
Stand, stop or park any automobile, truck or other vehicle, whether occupied or not, except momentarily to pick up or discharge a passenger or passengers:
1. 
In front of a public or private driveway or within five feet of the end of the curb opening leading thereto,
2. 
Within 15 feet of a fire hydrant,
3. 
On or within 20 feet of a marked or unmarked crosswalk,
4. 
Within 30 feet upon the approach to any flashing signal, stop sign, yield sign or traffic control signal located at the side of a roadway,
5. 
Within 20 feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within 75 feet of the entrance when properly signposted,
6. 
Bus loading zones as identified by the Pierce Transit identifier signs,
7. 
At any place where official signs prohibit standing, stopping or parking,
8. 
Outside the designated or marked parking stall lines and in no event shall the vehicle or portion of vehicle occupy more than one parking stall, or
9. 
Within any space marked as a fire lane;
C. 
Park any automobile, truck or other vehicle, whether occupied or not, except temporarily for the purpose of and while actually engaged in loading or unloading property or passengers:
1. 
Within 50 feet of the nearest rail of a railroad crossing, or
2. 
At any place where official signs prohibit parking;
D. 
No person shall move any automobile, truck or other vehicle not lawfully under his or her control into any prohibited area or away from a curb such a distance as is prohibited;
E. 
No person shall reserve or attempt to reserve any portion of a highway for the purpose of stopping, standing or parking of any automobile, truck or other vehicle to the exclusion of any other like person, nor shall any person be granted such right.

A. 
Except as provided in subsection B of this section, no person shall park or allow to remain standing any automobile, truck or other vehicle in any public roadway within the city other than parallel with the edge of the roadway, headed in the direction of lawful traffic movement and with the wheels of the vehicle furthest from the curb on that side which is consistent with the lawful movement of traffic be more than 12 inches from the curb or edge of the roadway.
B. 
Parking a vehicle at an angle to a roadway is permitted at locations with posted, official signs authorizing angle parking, as approved by the Director of Public Works. The angle of parking is limited to the angle of the official parking stripes painted upon the roadway and in the manner designated by the posted official signs.

The parking and storage of motor vehicles and other objects upon city streets and right-of-way for any of the following purposes or in the following manner is prohibited:
A. 
Parking or storage of a motor vehicle which is temporarily or permanently inoperative for any reason whatsoever, including lack of proper license, except parking for emergency repairs not requiring more than 48 consecutive hours total time shall be permitted;
B. 
Parking or storage, at any time for any reason, of a boat, boat trailer, house trailer, travel trailer, mobile home, camper, flatbed trailer, utility trailer or any other vehicle, object or trailer incapable of self-locomotion;
C. 
Parking or storage of a self-propelled motor home or travel trailer attached to a motorized vehicle for more than 48 consecutive hours; provided, that the chief of police is authorized to extend this time on a case-by-case basis;
D. 
Storage of firewood, building materials, sand, gravel, sawdust, beauty bark, rocks or any other materials of any kind whatsoever for a period in excess of that reasonably necessary for its removal from the street onto private property; any period in excess of 48 consecutive hours shall be presumed to be unreasonable.

Recreation vehicles in excess of the weight and/or length provisions set forth in SMC § 10.36.020(A)(6) may be parked on residential city streets for a period not to exceed 48 hours if the following circumstances exist:
A. 
The RV is parked on the street frontage immediately adjacent to a residential dwelling and the parking or use of the RV in question is related to the occupancy of the residential dwelling.
1. 
The occupants of the residential dwelling either own, rent or lease the RV in question.
2. 
The RV is not owned, rented or leased by the occupants of the dwelling, but the owner, renter, lessor or user of the RV is visiting the occupants of the residential dwelling.
B. 
In no event shall power cords, extension cords, garden hoses, or other like devices be run from the RV across the public right-of-way or sidewalk to a residential dwelling or like source.

No person shall park or allow to remain standing any automobile, truck or other vehicle in a parking space or stall designated for a physically disabled person without the automobile, truck or other vehicle displaying a state disabled parking permit when the space or stall is designated as provided for in RCW 46.61.581, which section is adopted by reference.

No person shall park any automobile, truck, or other vehicle or trailer on any public street, alley or right-of-way for the purpose of:
A. 
Displaying and advertising;
B. 
Displaying such automobile, truck, or other vehicle or trailer for sale; provided, that this section shall not apply to the displaying of an automobile or a truck under 10,000 pounds gross weight capacity for sale by a person in front of his or her residence; or
C. 
Selling merchandise from such automobile, truck, or other vehicle or trailer, except for the selling of products from a food truck or when otherwise authorized.

No person shall cause any automobile, truck or other vehicle to remain parked in any parking space beyond the parking time limit for such parking space, unless otherwise authorized herein. That each additional like period of limited time any automobile, truck or other vehicle is parked beyond the parking time limit for such parking space shall constitute a separate offense and be punishable as such.

No person shall erase, eradicate or otherwise remove a mark placed on the tire of any automobile, truck or other vehicle by a police officer or designated parking enforcement officer, while any such automobile, truck or other vehicle remains parked in the same place in which it was located at the time the mark was placed upon the tire of such automobile, truck or other vehicle.

There is hereby created a rebuttal presumption that the registered owner of any such motor vehicle or trailer committed the violation in question for which the infraction citation in question was issued.

A. 
Any person who commits a parking infraction shall be assessed the following civil penalty, unless otherwise provided herein:
1. 
All parking infractions, whether on public streets or within lots, except as detailed in subsections (A)(2), (3) and (4) of this section: $45.00;
2. 
Unauthorized handicapped zone parking: $250.00 plus mandatory costs and assessments;
3. 
Commercial vehicles and trailers as defined in SMC § 10.36.005 that violate any parking provision of this chapter: $150.00;
4. 
Parking in a municipal paid parking lot without a permit displayed pursuant to SMC § 10.36.085(C): $250.00. In addition to the parking infraction described herein, the city is further authorized to tow the vehicle pursuant to SMC § 10.68.020(A)(10) or place a wheel- boot on the vehicle that does not have displayed a valid paid parking lot permit. The costs of towing and/or removal of a wheel-boot shall be the responsibility of the registered owner. It is not a defense to this infraction to have been issued a permit but the issued permit was either inadvertently or intentionally improperly displayed.
Each subsequent violation of the posted period of parking time constitutes another violation. Calculation of the new period of parking time begins immediately after a notice of infraction has been issued.
B. 
Any person who commits a parking infraction, and who fails to respond to the notice of that infraction within 30 days of its issuance or within 33 days from the date it was mailed, shall be assessed up to a $25.00 civil penalty for such infraction as is set forth in subsection (A) of this section.
C. 
As used in this section, the word "person" shall refer to the registered owner of the vehicle found to be in violation of the parking provisions of this chapter.
D. 
It shall be an infraction for any person to move and re-park a vehicle parked on the street within two blocks of the original parking space in order to avoid a parking time limit regulation. It shall be an infraction for any person to move and re-park a vehicle parked in a parking lot to another space within the same parking lot in order to avoid a parking time regulation. For the purposes of this section, a block shall be defined as a city street or alley section located between consecutive intersections. A violation of this section shall be an infraction punishable by a fine of $45.00.
