A. 
The owner of the business or any other person or agent in control of such business which operates within Sumner city limits shall implement and maintain in good condition source control BMPs.
B. 
Operational source control BMPs shall be implemented for all pollutant generating sources. In the event operational source control BMPs are not adequate to prevent illicit discharges or violations of surface water quality, structural source control or treatment BMPs are required.
C. 
Required source control BMPs are referenced in documents adopted under SMC § 13.48.030. In cases where the manual(s) lack guidance for a specific source of pollutants, the city shall work with the owner/operator to implement or adapt source control BMPs based on the best professional judgment of the city engineer or his/her designee.
D. 
The source control program will be implemented in accordance with the city's stormwater comprehensive plan and stormwater management plan developed in accordance with the NPDES Phase II permit.

A. 
Whenever there is cause to believe that a violation of this chapter has been or is being committed through improper BMP implementation or other means, the city is authorized to inspect during regular working hours and at other reasonable times all public or private stormwater drainage systems within the city to determine compliance with the provisions of this chapter.
B. 
Prior to making any inspections, the city's inspector shall follow the procedures outlined in SMC § 13.48.820(E).
