The location of manufactured and mobile homes on property within the city shall be subject to the provisions of this chapter.

A.
For purposes of this title, "Housing and Urban Development Standards" means the National Mobile Home Construction and Safety Standards Act of 1974, and the rules and regulations adopted thereunder, including:
1.
Regulations and interpretations of the state of Washington Department of Labor and Industries, adopted pursuant to the Department of Housing and Urban Development rules; and
2.
Information supplied by the manufacturer of a home, which has been stamped approved by the Department of Housing and Urban Development pursuant to the Department of Housing and Urban Development rules.
B.
The provisions of this chapter are supplemented by the definitions in the city zoning regulations.

The temporary or permanent establishment and use of a manufactured or mobile home shall be permitted only as allowed by the zoning regulations; provided such home shall meet the following assembly and installation requirements:
A.
Bear a tag or seal of approval of the United States Department of Housing and Urban Development or the state of Washington;
B.
Be installed according to the following state regulations:
1.
WAC 296-150B-200 for general installation,
2.
WAC 296-150B-225 for building site preparation,
3.
WAC 296-150B-230 for foundation system footings,
4.
WAC 296-150B-235 for foundation system piers,
5.
WAC 296-150B-240 for foundation system plates and shims,
6.
WAC 296-150B-245 for foundation facia,
7.
WAC 296-150B-250 for anchoring systems, and
8.
WAC 296-150B-255 for assembly;
C.
Be provided with approved detectors of products of combustion other than heat, conforming to Department of Housing and Urban Development standards, if not required by other regulations;
D.
Because of documented potential seismic risk, high wind loads and poor soil conditions within Sumner, the following shall apply:
1.
Within manufactured home subdivisions and outside of manufactured home parks, a continuous concrete perimeter footing measuring a minimum of six inches by 16 inches, with two number four reinforcing bars. Foundation walls may be either poured in place concrete or concrete masonry units with all cores poured solid. Subject to the approval of the building official, a report from a professional engineer or architect licensed in the state of Washington based on a site-specific soils report may modify these standards,
2.
Within manufactured home parks, the foundations shall be based on the geotechnical report prepared for the site. If no such report exists, the building official shall determine the foundation requirements;
E.
Be installed with permanent utility connections conforming to applicable codes.

Accessory structures such as awnings, carports, garages, porches or steps shall be allowed; provided they are constructed in compliance with the standards specified by applicable local codes. If attached structurally to the home, such construction shall also conform to the Department of Labor and Industries standards or manufacturers specifications, relative to such attachment.

Prior to the location, relocation, establishment, or occupancy of any manufactured home, the owner, or the authorized representative of the owner, shall secure a permit for such action from the development services department, as follows:
A.
Application for such a permit shall be made on forms prescribed by the development services department.
B.
A nonrefundable application fee of $150.00 shall be submitted with the application. This fee shall be in addition to fees required for other necessary permits.
C.
Applicants shall be required to:
1.
Provide a plot plan showing manufactured home dimensions and locations and distances to the nearest structures on adjoining property;
2.
Have approval for connection to the sewage and water systems;
3.
Meet all conditions of the manufactured home park or subdivision approval, as applicable;
4.
Submit to an on-site inspection consisting of setbacks, anchoring system, foundation, utility connections, and accessory structures, as applicable;
5.
Provide the building official with a copy of the manufacturer's HUD-approved installation instructions, if applicable. If no installation instructions are available, a report submitted by a professional engineer or architect licensed in the state of Washington and indicating sufficient installation may be accepted subject to the approval of the building official.

A manufactured home which has been placed and maintained upon a lot prior to the adoption of the ordinance codified in this chapter shall be legal nonconforming, upon proof to the building official that the home was placed and maintained upon such lot prior to adoption of the ordinance codified in this chapter, and upon compliance with all applicable provisions of SMC § 15.60.030. A manufactured home may be relocated within the city; provided such relocation otherwise conforms to all applicable provisions of this chapter.

Subject to the conditions, fees and standards otherwise required by this chapter, a manufactured home may be allowed as a temporary residential dwelling subject to the limitations established in the zoning regulations.
