A.
Property owners may apply for a waiver from having to apply with a full application to the Village’s Architectural and Preliminary Site Review Board, the Village’s Planning Board, and the Village’s Board of Trustees, which is to be resolved in the manner set forth in this chapter.
B.
An application with regard to the Board of Trustees shall be made to the Mayor. An application to any other board shall be made to its chairman.
C.
The following sets forth when waivers are available:
(1)
An application for the following changes may be made, without being required to notify the neighbors:
(a)
Changes to the shades of color of walls, roofing, and siding;
(b)
Changes to the location of windows, so long as the change is less than two feet in any direction; and
(c)
Changes to the width, length, and/or location of driveways, swimming pools, other accessory structures and hardscape, so long as the change is less than two feet.
(2)
Changes to the style, color, or location of fencing, so long as the style is substantially the same, the color is only as to the shade, and the location as long as it is within two feet. If the change is with regard to a fence within five feet of a property line, the owner of the property within that five feet must be notified, at least 10 days before the chairman addresses the waiver. Such notice must be delivered in the manner provided in Chapter 25, unless such owner agrees to the waiver or waives the notice. Proof of such notice shall be delivered to the Village Administrator at least eight days before the Mayor or chairman, as the case may be, reviews the application. If such owner does not agree to the waiver, it may provide a written objection to the waiver not less than three days before the Mayor or chairman addresses the waiver, and such written objection, if any, shall be provided to the applicant at least one day before the Mayor or chairman addresses the waiver, so it may respond. The Mayor or chairman is authorized to discuss the application with either or both of the parties, separately or together.
