Every person owing, controlling, or in possession of any premises shall maintain an improved sidewalk abutting the premises in good repair and in accordance with the width, materials and surface standards of the city.

Every improved sidewalk located within the city which does not conform to the sidewalk standards of the city as adopted and established by ordinance is declared to be a nuisance affecting the public safety and welfare and may be abated in the manner prescribed in CMC § 8.10.120 to § 8.10.160.

In addition to other requirements of CMC § 8.10.120 the council shall:
Notify the owner or agent in charge of the property abutting the nuisance of the defects in the sidewalk and what repairs must be undertaken in order to abate and correct the nuisance; and
Provide the owner or agent in charge of the abutting property a written estimate of the cost of making the repair if the repair is to be performed by the city under CMC § 8.10.140.
