It is the purpose of this chapter to implement regulations for the Springtown Open Space area (formerly known as the Springtown Golf Course), which is generally defined by the Open Space area within Primrose Lane, Aster Lane, Rhododendron Drive and Golf Drive, Scenic Avenue, Bluebell Drive, Heather Lane, Hollyhock Street, Marigold Road, Iris Way and Lilac Avenue. It is the intent of the City to preserve the Springtown Open Space area for protection of scenic character as well as passive recreation space. The regulations stated herein apply to all persons. Persons entering Springtown Open Space property may remain as long as they abide by these regulations, all federal, state and local laws and regulations, all posted rules, and lawful instructions of law enforcement officers and city employees.

For the purposes of this chapter, the following words and phrases shall have the meaning respectively ascribed to them by this section:
A. 
"Amplified sound"
means music, sound waves, vibration, or speech projected or transmitted by electronic equipment, including but not limited to amplifiers, loudspeakers or similar devices.
B. 
"Dumping"
refers to the unlawful disposal of used tires, construction debris, old appliances, furniture, and household, commercial and industrial waste.
C. 
"Litter"
refers to the willful discarding, dropping or scattering of small or large quantities of rubbish, including but not limited to beverage and food containers, wrappers, wastepaper, facial tissue, toilet tissue, newspapers or magazines, charcoal, lighted or non-lighted cigarettes, cigars, matches or any flaming or glowing material, and/or garbage, trash, refuse, paper, containers or packaging.
D. 
"Motorized vehicle"
refers to a device by which any person or property may be propelled, moved or drawn, which is powered by an internal combustion engine or electric motor.
E. 
"Wildlife"
refers but is not limited to ducks, geese, rabbits, raccoons, fish, fowl, skunks, deer, squirrels, coyotes, foxes, possums or any wild animal not commonly considered a domesticated pet.

The following rules and regulations apply to all persons throughout Springtown Open Space:
A. 
Operating Hours. Overnight usage of the Springtown Open Space area is prohibited. The Springtown Open Space area shall be open to the public from dawn to dusk. It shall be unlawful to enter or remain within such lands between one hour after sunset and one hour before sunrise the following day without approval from the Public Works Director.
B. 
Restrictions on Activities. The following activities shall not be permitted to occur at any time within the Springtown Open Space area:
1. 
Golfing;
2. 
Camping, pursuant to Chapter 12.65 LMC, as may be amended;
3. 
Use of air filled devices (e.g., jump houses);
4. 
Use of motorized vehicles of any kind;
5. 
Possession or consumption of alcohol or drugs;
6. 
Use of radio controlled devices, which includes any device that uses radio signals to wirelessly control the device, such as radio controlled cars, planes, boats, helicopters, models, and drones;
7. 
Carrying or use of weapons, paintballs, fireworks or fires;
8. 
Amplified sound;
9. 
Littering or dumping;
10. 
Feeding of ducks, geese or wildlife;
11. 
Solicitation, which includes a person who practices, carries on, conducts, or solicits for any occupation, business, or profession, or sells or offers for sale any merchandise, article, or anything whatsoever.
C. 
User Responsibilities. The following are responsibilities of any individual utilizing the Springtown Open Space area:
1. 
Owners must clean up after their pets.
2. 
All dogs must be on a leash.
3. 
Individuals must be considerate of residents living in the property adjacent to the Springtown Open Space area, including no trespassing or infringing on private property.

A violation of this chapter, including a violation of permit conditions, is subject to administrative penalties pursuant to Chapter 1.20 LMC and may be enforced by any enforcement officer of the City. In addition to administrative penalties under Chapter 1.20 LMC, the City shall be entitled to take any other action permitted by law to enforce the provisions of this chapter.
