Sales of personal property, material or equipment the estimated value of which is over five hundred dollars shall be as follows:
A. 
By advertising for a period not less than fourteen days prior to date of sale. Advertising shall be published at least one time in a newspaper of general circulation in the borough, written notices on the bulletin board in the borough building, at all post offices located within the borough, and in at least one other public place.
B. 
Sale shall be by sealed bid. Bids shall be opened and read by the borough manager or his designee on the date set for opening bids.
C. 
Conditions of sale shall be payment in full within three business days after award by the borough. No bid may be withdrawn subsequent to the opening of bids, and in the event a successful bidder does not complete the purchase, the borough, may at its option, accept the next lowest responsive bid(s).

All advertisements shall contain the following information:
1. 
Reference to this chapter;
2. 
Object offered for sale;
3. 
Reference to sealing of bids;
4. 
Deadline for submission of sealed bids;
5. 
Date and place of opening;
6. 
Reservation of the borough's right to reject all bids and cancel the sale.
B. 
Advertisement shall be in substantially the following form:
Pursuant to and subject to the conditions stated in Title 3, Chapter 3.24 of the Code of the Bristol Bay Borough the Bristol Bay Borough offers for sale and will accept sealed bids on _____(object)_____ until 12:00 o'clock, Noon on ______(date)______ at the office of the Borough Clerk. Bids shall be publicly opened and read at ______ p.m. on ______(date)______ in the Assembly Chambers. Final acceptance of the successful bid shall be at such time as the Borough shall determine on the above date or later. The Borough reserves the right, in its sole discretion, to reject all bids and cancel the sale.

All property, material or equipment are sold on an "as is-where is" basis, and no guarantee of any sort, express or implied, by a borough official or employee of the borough shall be binding upon the borough. Bidder shall inspect the offered property and the submitting of the bid shall be conclusive evidence that the bidder is fully informed as to the marketability, condition and location of the object to be sold. Unless other provisions are included in the notice of sale, the successful bidder shall take the property into possession within three business days after acceptance of the bid. The borough reserves the right to reject any and all bids.

Any material, equipment or property which has been put up for bid in the manner set forth in this chapter and which has received no bid acceptable to the borough, may be offered at private sale thereafter by the borough manager.
