This article is enacted under the authority of Article VII, Section 702, Clause XLVII, of the Second Class Township Code, Act of May 1, 1933, P.L. 103, as amended July 13, 1961, P.L. 600, 53 P.S. § 65747.[1]

The following words and phrases shall be construed throughout this article to have the meanings herein indicated:
COUNCIL
The Washington Township Council.
MOTOR VEHICLES
Any automobile, van, bus or any other similar vehicle utilized for transportation.
RECREATIONAL AREAS AND PARKS
Those areas or parks designated on the Official Washington Township Zoning District Map as recreational areas or parks.
TOWNSHIP
Washington Township, Erie County, Pennsylvania.
All township recreational areas and/or parks shall be closed to the public from the hours of sunset to sunrise, and any person who shall remain on such recreational area or in such recreational park after these hours shall be deemed to have violated this article.

A. 
Enforcement proceedings for violations of this article shall be as provided in Chapter 1, General Provisions, Article III, Criminal Enforcement.
B. 
Any person who shall violate this article shall, upon conviction thereof, be required to pay a criminal fine in the amount of $25 per violation and shall be imprisoned to the extent allowed by law for the punishment of summary offenses. All penalties imposed for the violation of this article shall be paid to the Township Treasurer for the use of the township.

ARCHERY
An activity involving the use of a bow and arrow.
ARROW
A missile shot from a bow, having a slender shaft with fletching or veins at the butt and a pointed head without any explosive, chemical or poison in the head or shaft and used solely with a bow.
BOW
A weapon which propels an arrow, is hand-held, hand-drawn, held in the drawn position by hand or by a hand-held mechanical devise, and released by hand. This term shall be construed or interpreted to mean or include what is commonly known as a cross bow.
CONTROLLED HUNTS
Hunt or hunting of pre-designated animals, by bow or firearm, at times and locations determined in advance by Township personal. If a controlled hunt is warranted, notification of the hunt as well as the animal(s) to hunted, will be established at the first scheduled meeting of Council before said hunt. Township property subject to a controlled hunt will be posted up and through the date and time of the controlled hunt.
FIREARM
An instrument used in the propulsion of shock, shell, bullet, or any other object by the action of gunpowder exploded, explosive powder, the expansion of gas, or the force of a mechanical device under tension.
HUNT or HUNTING
An act or furtherance by the taking or killing of any game or wildlife, or any part or product thereof, and includes, but is not limited to, chasing, tracking, calling, pursuing, lying in wait, shooting at, including shooting at a game or wildlife facsimile, or wounding with any weapon or implement, or using any personal property, including dogs, or the property of others, of any nature, and furtherance of any of these purposes.
RIFLE
A gun, especially one fired from shoulder level, having a long spirally grooved barrel intended to make a bullet spin and thereby have greater accuracy over a long distance.
TOWNSHIP PROPERTY
Any real estate owned by Washington Township that is more fully identified on Exhibit A[1] attached hereto, incorporated herein by reference and made a part hereof.
TRAPPING
The securing or attempting to secure possession of game or wildlife by means of setting, placing, or using any device that is designed to close upon, hold fast, confine, or otherwise capture game or wildlife whether these means result in capturing or not. It includes every act of assistance to any other person in capturing game or wildlife by means of such a device whether these means result in capturing or not.
WATERFOWL
Ducks, geese or other large aquatic birds, especially when regarded as game.

Waterfowl hunting and archery hunting, only, will be permitted in the parks identified on Exhibit A at and during those times as more fully identified in the postings on said parks. Hunting with any rifle is strictly prohibited, unless permitted as per § 94-9 of this article.
Nothing in this article prohibits or limits the Township to hold and conduct controlled hunts upon Township property to control wildlife populations.
Any violation of the provisions of this article shall be considered a summary offense. Any person who is found by a court of competent jurisdiction, including, but not limited to, a magisterial district court or court of common pleas, to have violated a provision of this article, to have failed to comply with any of the requirements of this article, or to have failed to comply with an order, directive, or notice of the appropriate Township official concerning this article shall be liable for a civil penalty of not less than $100 or more than $1,000 for each violation, plus any and all costs incurred by the Township in bringing an action against such violation, including, but not limited to, consultant fees, attorneys fees, and expert witness fees. Each day that a violation continues shall be deemed a separate violation.
