Signs not specifically permitted in this chapter are prohibited.
B. Specific definitions. As used in this section, the following terms shall have the meanings indicated:
The total square footage of a sign face exposed to public view.
A temporary unsecured sign made of natural, flexible, synthetic or plastic material.
Any freestanding sign on a parcel of land which does not include another principal structure.
A sign which is part of, hung from the underside of, or attached to, a canopy, awning, marquee or other covered structure projecting from and supported by a building and does not project horizontally beyond or vertically above the canopy, marquee, awning, or covered structure.
Signs limited to directional messages, principally for pedestrian or vehicular traffic, such as "one way," "entrance," "exit," and "drive-through."
A sign that utilizes computer-generated messages or some other electronic means of changing copy. These signs include displays using incandescent lamps, LEDs, LCDs, or a flipper matrix (mechanical means).
A sign designed to span over and above an entrance drive, but not limited to a curved shape.
A sign on paper, cloth, fabric, or other flexible or combustible material of any kind that is attached to a permanent conforming pole in accordance with the zoning ordinance and the building code. Flags are typically supported on one side of the sign.
A unit of measure of the intensity of light falling on a surface equal to one foot from a given surface.
A sign supported by one or more uprights, poles, pylons, monuments, or braces placed in the ground and not attached to any building or other structure. Freestanding signs include monument signs, but do not include billboards.
A freestanding sign affixed to the ground with a full footing where the display surface is less than four feet above the grade to the bottom of the display area. Ground signs can include EMC, reader board, and illuminated signs.
Any sign designed to give forth artificial light or designed to reflect any light given from any source which is intended to cause light or reflection.
A base-mounted, freestanding sign placed on the ground and not attached to any building or other structure. A monument sign includes a solid supporting base of at least 24 inches in height and a width equal to or greater than the width of the sign face. Monument signs are constructed of a decorative and durable material (e.g., masonry), and shall have no separations between the sign face and the base.
A sign that was lawfully permitted at the time it was erected but is not permitted under current law.
A sign constructed of durable materials intended to withstand prolonged exposure to exterior elements. Permanent signs are affixed to the ground or a structure by means of footings beneath the ground surface, bolts or screws into a structure, or other method intended to ensure the sign is displayed for an extended period of time with minimal maintenance or replacement of parts.
A freestanding sign which is supported by one or more uprights in permanent footings with all parts of the display surface of the sign eight feet or more above the grade at the base of the sign.
A sign designed to be moved easily and not permanently attached to the ground, a structure, or a building.
A secondary portion of a sign, designed to allow for messages that are manually or electronically changeable.
A permanent structure, including, but not limited to, walls, columns, and gates, marking entrances to single-family subdivisions or multiple housing projects.
A sign which is erected, constructed, and maintained upon or above the roof, or parapet wall of a building, which is wholly or partially supported by said building.
A sign that is intended to be displayed for a limited period of time.
A sign fastened to or painted on the wall of a building or structure in such a manner that the wall becomes the supporting structure for, or forms the background surface of, the sign and which does not project more than 12 inches from the building or structure.
A sign that is applied or attached to the exterior or interior of a window or located in such a manner within a building that it can be seen from the exterior of the structure through a window.
C.
Sign design standards in all zoning districts. All signs in all zoning districts are subject to the following standards:
(1)
General requirements. All signs shall be designed and constructed in a safe and stable manner in accordance with the Township's adopted building code and electrical code. All electrical wiring associated with a freestanding sign shall be installed underground.
(2)
Building code compliance. All permanent signs shall be designed to comply with all requirements contained in the adopted building code.
D.
Zoning compliance permit requirements. A zoning compliance permit shall be obtained for the erection, construction, alteration, and/or replacement of any sign; except as otherwise provided in this chapter. Requests for a zoning compliance permit shall consist of a completed application form, provided by the Township, and a nonrefundable application fee as established by the Township Board. In addition, as part of the zoning compliance permit application, the applicant shall provide the following:
(1)
Name, address, and phone number of applicants;
(2)
Location of building, structure, or lot on which the sign is to be attached or erected;
(3)
Indication of the zoning district in which the sign is to be located;
(4)
Total display area of the sign in square feet;
(5)
Proposed setback of the sign from the road right-of-way, drives, and adjacent properties;
(6)
Elevation drawing of the proposed sign, indicating sign type, height, and ground clearance, if applicable;
(7)
Details regarding methods of lighting, if any;
(8)
Height and width of building (or height and width of occupant frontage, if applicable) if the sign is a wall sign;
(9)
Site area and frontage;
(10)
Site plan showing sign location and setback from property lines and other structures;
(11)
Written and signed consent from property owner if sign is located on a separate lot.

F.
Exempt signs. The following signs shall not require a zoning compliance permit:
(1)
Temporary signs, not otherwise prohibited by this section, provided they comply with all of the following regulations outlined in Subsection G.
(2)
Nonilluminated development sign (one per lot) of up to 24 square feet in all districts that may not be erected prior to preliminary site plan application and must be removed within 30 days after completion of the project.
(3)
Nonilluminated "no trespassing," "no soliciting," or similar announcement signs on private property, each not exceeding two square feet in area.
(4)
Name plates or street numbers of fewer than two square feet.
(5)
Directional signs at drive entrances or other locations for providing direction to motorists on site, not exceeding two square feet in area and four feet in height.
(6)
Road name signs and other signs established by state, county, or Township units of government when necessary for giving proper directions, identifying or promoting publicly held assets, or otherwise safeguarding and informing the public.
(7)
Non-advertising signs erected by state, county, or Township units of government or a public utility to warn the public of dangerous conditions and unusual hazards, including, but not limited to, caving ground, drop offs, high voltage, fire danger, explosives, and severe visibility limits in any districts, of under two square feet.
(8)
Window signs mounted on the interior of the window, provided that no more than 30% of the window area is obscured by window signs.
G.
Temporary signs. Un-illuminated on-site temporary exterior signs may be erected in accordance with the regulations of this section, except that no permit shall be required.
(1)
Temporary wall or window signs.
(a)
In all districts, the Zoning Administrator may allow two temporary wall or window signs for up to a forty-five-day period, not more than three times per year. All temporary signs permitted under this provision shall otherwise comply with all requirements pertaining to height and area for the zoning district in which the sign is located.
(b)
All temporary wall or window signs which are not properly maintained shall be removed at the order of the Zoning Administrator.
(2)
Temporary ground signs.
(a)
In all districts, up to three non-illuminated temporary ground signs shall be permitted per parcel, provided that the combined sign area does not exceed 40 square feet. One additional non-illuminated temporary ground sign may be permitted per every 20 feet that a parcel exceeds 100 feet of road frontage. For each additional sign, the parcel shall be permitted an additional four square feet added to the total combined sign area. The minimum setback for any temporary ground sign from any property line or public right of way shall be 10 feet.
(b)
All permitted temporary ground signs may be displayed for no more than 180 days per year. Following the expiration of the 180-day period, the landowner shall remove the temporary ground sign. Failure to timely remove a temporary ground sign constitutes a violation of this section.
(c)
Each sign shall have a maximum height of 48 inches from the ground and a maximum width of 96 inches, including the support structure.
(3)
Banners, pennants, search lights, balloons, or other gas-filled figures are permitted at the discretion of the Zoning Administrator for the opening of a new business in a commercial or industrial district for a single period not to exceed 14 consecutive days. Such signs shall not obstruct pedestrian or vehicular view.
(4)
In all districts, all types of temporary signs shall comply with the following:
(a)
Temporary signs shall not be attached to any tree, shrub, natural feature, utility pole, or any structural element not capable of supporting signs or be located within any public right-of-way.
(b)
Temporary signs shall not be located closer than 10 feet from the edge of the traveled portion of the roadway, nor shall they be located within any dedicated right-of-way.
(c)
Temporary signs shall not be erected in such a manner that they will or may reasonably be expected to interfere with, obstruct, confuse, or mislead traffic, or to create a hazard of any kind.
(d)
No temporary sign may be displayed without the consent of the legal owner of the property on which the sign is mounted or displayed.
H.
Prohibited signs. The following signs are prohibited in all zoning districts:
(1)
A sign resembling the flashing lights customarily used in traffic signals, or police, fire, ambulance, or rescue vehicles or signs that imitate official traffic directional signs or devices.
(2)
A sign using the words, "Stop," "Danger," or any other words, phrases, symbols, or characters, in such a manner as to interfere with, mislead, or confuse a vehicle driver.
(3)
Signs on parked or moving vehicles where the sign is the primary use of the vehicle.
(4)
Signs that are affixed to trees, shrubs, or similar natural features; however, "no trespassing" or similar signs of under two square feet are permitted on private property.
(5)
Signs affixed to fences or utility poles, or to structural elements not capable of supporting such signs.
(6)
Any sign which obstructs the ingress or egress from a required door, window, or other required exit.
(7)
Banner signs used as permanent signs.
(8)
Signs placed within the road right-of-way, other than approved traffic control signs and devices.
(10)
Signs with moving or revolving parts.
(11)
Roof signs.
(12)
Pole signs.
(13)
Beacons.
(14)
Signs that emit an audible sound or odor of any kind.
(15)
Signs which contain obscenities according to state or federal law.
I.
Abandoned signs. If a sign advertises a business, attraction, or other enterprise or activity that is no longer operating or being offered or conducted, that sign shall be considered abandoned and the sign faces shall be removed and replaced with blank faces within 30 days after written notification from the Township to the sign owner, owner of the property where the sign is located, or other party having control over the sign. Any expense incurred by the Township incidental to removal shall be paid by the sign owner, owner of the property, or other party having control over the sign.
J.
Installation and maintenance. All signs and sign structures shall be erected to conform to all applicable codes adopted by the Township. Signs shall be installed in a workmanlike manner and be maintained at all times in a state of good repair, with all braces, bolts, clips, supporting frame, and fastenings free from deterioration, insect infestation, rot, rust or loosening. All signs shall be kept neatly finished, including all metal parts and supports that are not galvanized or made of rust-resistant metals.
K.
Clear vision. Signs erected in the Township shall not obstruct the clear view of traffic or a local traffic sign or signal, and shall conform to § 340-14, Clear vision. If the location or design of a sign may result in a conflict with pedestrian or vehicular movement or circulation, the Township may require a clearance of up to 10 feet from the finished grade level or curb elevation to the lowest part of such sign or a front setback of up to 10 feet.
L.
Measuring sign area.
(1)
Sign area shall be measured as the square footage of the sign face and any frame or other material or color forming an integral part of the display or used to differentiate it from the background against which it is placed.
(2)
The square footage of the sign shall consist of the area of the smallest rectangle that completely encompasses the sign, including any protruding elements.
M.
N.
Electronic message center/reader boards.
(1)
A reader board may consist of manually or electronically changeable messages.
(2)
An electronic reader board shall be subject to the following requirements:
(a)
Each message shall be static. Messages may not be animated, scrolling, or flashing.
(b)
Each message shall be displayed for no less than five seconds.
(c)
Transition from one message to the next shall be instantaneous or may fade out and in from one message to the next, provided that the fading between messages does not last longer than one second.
(3)
Commercial and industrial districts. Up to 60% of the area of a permitted sign for a commercial or industrial use in a commercial or industrial district may be utilized as a reader board.
(4)
Agricultural/open space and residential districts. Up to 60% of the area of a permitted sign may be utilized as a reader board for the following uses:
(5)
The illumination of an EMC shall conform to the criteria set forth in this section.
(a)
EMC illumination measurement criteria: The luminance of an EMC shall be measured with a luminance meter set to measure footcandles accurate to at least two decimals. Illuminance shall be measured with the EMC off, and again with the EMC displaying a white image for a full-color-capable EMC, or a solid message for a single-color EMC. All measurements shall be taken perpendicular to the face of the EMC at the distance determined by the total square footage of the EMC as set forth in the accompanying Sign Area Versus Measurement Distance Table.
(b)
EMC illumination limits: The difference between the off and solid-message measurements using the EMC measurement criteria shall not exceed 0.3 footcandles.
(c)
Dimming capabilities: All permitted EMCs shall be equipped with a sensor or other device that automatically determines the ambient illumination and programmed to automatically dim according to ambient light conditions, or that can be adjusted to comply with the 0.3 footcandle measurements.

Illumination.
(1)
Except for electronic reader boards as permitted by this section, signs shall be illuminated only by steady, stationary, shielded light sources directed solely at the sign (i.e., front-lit signs) or internal to it (i.e., backlit signs).
(a)
The background of front-lit signs (i.e., external illuminated signs) may be any color, provided they are not reflective at night. However, they may use light-reflecting lettering and messaging.
(b)
The background of backlit signs (i.e., internally illuminated signs) may be any color, provided the background is blacked out at night so that only the lettering and message is illuminated.
(2)
Use of glaring, undiffused lights or bulbs shall be prohibited.
(3)
All lighting fixtures or light sources for lighted signs shall be positioned and/or shaded so that the light source is not visible from normal traffic or pedestrian areas and does not project onto adjoining properties or thoroughfares.
(4)
Underground wiring shall be required for all illuminated signs not attached to a building.
(5)
All lighting shall not exceed 0.5 footcandle at a residential property line and 1.0 footcandle at a nonresidential property line.
(6)
Any illuminated sign located on a lot abutting or across a street from any residential zoned or occupied property shall not be illuminated between the hours of 11:00 p.m. and 7:00 a.m., except that such sign may remain illuminated during such time as the activity to which the sign pertains is open for business.
P.
Nonconforming signs.
(1)
Nonconforming signs in use on the effective date of this chapter, except for prohibited signs, shall be permitted to remain, provided they are properly maintained. Such maintenance is restricted to painting and minor repairs which cannot be considered a rebuilding of the sign. Extensive repairs constituting rebuilding must meet the requirements of the pertinent zoning district. A change solely in the wording of the copy or replacement of the sign face with a new face of the same size and height shall not require bringing the sign into conformance.
Q.
Violations; removal of signs.
(1)
A violation of any provision or requirement of this article is a municipal civil infraction, subject to enforcement and the fines and penalties for civil infraction violations as set forth in Chapter 55 of the Township of Putnam Code of Ordinances, in addition to the penalties set forth herein.
(a)
In addition to the remedies set forth in Subsection Q(1) above, the Zoning Administrator or his/her designee shall have the right to revoke any permit issued hereunder for a violation of this section. Any of the grounds upon which the initial permit application may be denied shall also constitute grounds for such revocation. In addition, the failure of the sign erector and property owner to comply with the provisions of this article or other provisions of this Code or other law shall also constitute grounds for revocation of the permit. The sign erector and property owner shall be notified in writing by the enforcement officer or his/her designee of the specific grounds for a revocation and demand for correction and abatement. Such notice may be served personally or by registered mail, return receipt requested. The notice shall allow a maximum of 10 business days after service of the notice to correct or abate the violation. Additional time may be granted by the Zoning Administrator or his/her designee when bona fide efforts to remove or eliminate the offending condition are in progress. The notice shall provide that the sign erector and property owner may request a hearing on the notice and permit revocation by filing an appeal with the Zoning Board of Appeals.
(b)
If a violation is neither remedied nor appealed within the given time period set forth by the written notice, the Zoning Administrator or his/her designee shall have the right to revoke the sign permit. Upon revocation of a permit issued pursuant to this section, the sign erector or property owner of the parcel on which the sign has been placed shall remove the sign from the property within 10 calendar days from the date of the notice and, if not so removed within the time period, the Township or Township's contractor may initiate removal of the sign. All costs associated with the removal of the sign and correction of the offense incurred by the Township, or the Township's contractor, shall be the joint and several responsibilities of the permittee and property owner. If such obligation is not paid within 30 days after mailing of the bill of costs to the property owner, the Township may place a lien upon such real property enforceable as a tax lien in the manner prescribed by the general laws of this state against the property and collected as in the case of general property tax. If the same is not paid prior to the preparation of the next assessment roll of the Township, the amount shall be assessed as a special tax against such premises on the next assessment roll and collected thereunder.
(c)
The Township Zoning Administrator or designee shall have the authority to enter upon property to remove any signs located within the public right-of-way.
