Unless otherwise expressly stated, the following words and phrases, wherever used in these Rules and Regulations, shall be construed to have the meaning indicated herein:
APPLICANT
An individual who applies in writing to the Civil Service Commission in response to a legally advertised notice of vacancy and/or examination for any position in the Manheim Borough Police Department.
APPLICANT WITH ACT 120 TRAINING
An individual who applies in writing to the Civil Service Commission in response to a legally advertised notice of vacancy and/or examination for any position in the Manheim Borough Police Department that has completed training under Pennsylvania Act 120 with satisfactory test scores.
APPOINTING AUTHORITY
This term is synonymous and interchangeable with the Council of the Borough of Manheim, Lancaster, Pennsylvania, which is the duly elected governing body of the Borough and possesses the legal authority to exercise executive control over the appointment, suspension, promotion, and discipline of an employee covered by these Rules and Regulations.
ASSOCIATION
The Lancaster County Chiefs of Police Association, Inc.
BOROUGH
The Borough of Manheim, Lancaster County, Pennsylvania.
BOROUGH CODE
8 Pa.C.S.A., Part I, as a continuation of the Act of February 1, 1966 (1965 P.L. 1656, No. 581).
BOROUGH COUNCIL
The Council of the Borough of Manheim, Lancaster, Pennsylvania, is synonymous with "Appointing Authority."
BOROUGH SECRETARY
The Secretary of the Borough of Manheim, Pennsylvania.
CERTIFICATION
The Civil Service's act of developing and submitting the names of qualified applicants in order of ranking, taken from the eligibility list to the Appointing Authority (Manheim Borough Council).
CHAIRPERSON
The Chairperson of the Civil Service Commission of the Borough of Manheim, Pennsylvania.
COMMISSION
The Civil Service Commission of the Borough of Manheim, Pennsylvania.
COMMISSIONER
An individual duly appointed by the Council of the Borough of Manheim to serve as a member of the Civil Service Commission.
ELIGIBILITY LIST
The list of persons who have satisfied the minimum requirements and qualifications for a particular position in the police department covered by these Rules and Regulations and who have passed the written, oral, and physical agility examinations.
ELIGIBLE
A person whose name is recorded on a current eligibility list or furlough list.
EXAMINATION
Any test or investigation administered by the Commission or its designee to assess an applicant's merit and fitness for an initial or promotional appointment, covered by these Rules and Regulations.
FURLOUGH LIST
A list of persons temporarily laid off from positions in the Police Department because of a reduction in the number of officers.
JOB DESCRIPTION
A written description of a position containing the job title, a general statement of duties and responsibilities, essential job functions, and/or examples of the typical duties performed, and minimum qualification requirement(s).
MEDICAL EXAMINATION
Any examination, procedure, inquiry, or test designed to obtain information about medical history or physical or mental condition that might disqualify the applicant if it would prevent the applicant from performing, with or without a reasonable accommodation, all of the essential functions of the position.
MUNICIPAL GOVERNING BODY
The Council of the Borough of Manheim, Lancaster County, Pennsylvania.
PAID ADMINISTRATIVE LEAVE
A period of time where the Borough directs a police officer not to perform their regular duties or regularly report for work, with continuing regular base pay and benefits, for any reason.
PHYSICIAN
Shall have the meaning given in 1 Pa.C.S.A. § 1991 (relation to definitions).
POLICE DEPARTMENT
The Manheim Borough Police Department.
POLICE OFFICER
Any Act 120 certified police officer sworn and employed by the Manheim Borough Police Department who has been appointed or promoted under these Rules and Regulations regardless of rank.
PROBATIONARY PERIOD
The period of time prescribed under these Rules and Regulations during which the elected and appointed official of the Borough through its officer, employees, or agents assess whether a police officer's conduct and fitness in a Civil Service position has been satisfactory and during which time the appointment or promotion remains temporary and not protected by these Rules and Regulations.
PROBATIONER
A police officer in the Police Department who has been appointed from an eligibility list but who has not yet completed their probationary period.
PSYCHOLOGICAL EXAMINATION
Any examination, procedure, inquiry, or test designed to obtain information about medical history or psychological condition that might disqualify an applicant if it would prevent the applicant from performing, with or without a reasonable accommodation, all of the essential functions of the position from a mental or psychological perspective.
QUALIFIED MEDICAL PROFESSIONAL
An individual, in collaboration with or under the supervision or direction of a physician, as may be required by law, who is licensed (1) as a physician assistant pursuant to the Act of December 20, 1985, known as the "Medical Practice Act of 1985," or the Act of October 5, 1978, known as the "Osteopathic Medical Practice Act"; or (2) as a certified registered nurse practitioner pursuant to the Act of May 22, 1951, known as "The Professional Nursing Law."
REDUCTION IN RANK
A change in status from one civil service rank to a lower civil service rank covered by these Rules and Regulations, where the police officer fulfilled all of the requirements for both service ranks. However, a decrease in salary without a change to a different position or rank shall not necessarily constitute a reduction in rank, nor does this term include discontinuance of a duty assignment or temporary assignment of rank made outside the scope of these Rules and Regulations.
REMOVAL
The permanent removal of a police officer from the Police Department.
SECRETARY
The Secretary of the Civil Service Commission of the Borough of Manheim.
SUSPENSION
The temporary removal of a member of the Police Department from their position.
