A.
The 2021 Edition of the International Code Council (ICC) Property Maintenance Code, published by the International Code Council, is hereby adopted to provide requirements for construction and maintenance of structures within the City of St. Ann, Missouri, as fully as if each Section, portion and provision thereof was set forth in this Section, subject to the additions, insertions, deletions and changes, if any, prescribed in this Section. In the event that a provision of this code as altered by this Section conflicts with any other provision of the City's Municipal Code or City ordinance, the strictest provision shall apply.
B.
The violation of any provision of this Code shall be punished by a fine of not exceeding one thousand dollars ($1,000.00) and costs, or by imprisonment not exceeding ninety (90) days, or by both such fine and imprisonment. Each day that any violation of any provision of this Code shall continue shall constitute a separate offense.
C.
Amendments. The following Sections are hereby revised:
Section 101.1 Insert "City of St. Ann"
Section 103.1 Insert "Building and Zoning Department"
Section 110.4.1 Insert a new Section 110.4.1, which shall read as follows: "Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than five hundred dollars ($500.00) or more than ten thousand dollars ($10,000.00)."
Section 202 Insert a new definition in Section 202, which shall read as follows: "RETAINING WALL. A structure constructed of natural or manmade inorganic material. Wood tie walls are not permitted. Existing tie walls may be repaired if the extent of the repair does not exceed twenty percent (20%) of the length and/or area of the wall. Tie walls requiring more than twenty percent (20%) repairs must be replaced with a retaining wall. A wall less than twenty-four (24) inches in height is considered landscaping."
Section 302.4 Insert "eight (8) inches"
Section 304.14 Insert "April 15 through October 15"
Section 505.3 Insert the following sentence at end of Section 505.3. "Shut off valves shall be provided in the supply piping at the point of connection for all fixtures with the exception of tubs and showers."
Section 602.3 Insert "October 1 through April 15"
Section 602.4 Insert "October 1 through April 15"
Section B101.3, Membership of the Board, Delete and insert in lieu thereof "The Board of Adjustment shall serve as the Board of Appeals as that term is used in this Code"
