The Soquel Village Parking and Business Improvement Area Advisory Board is established under the authority of the Parking and Business Improvement Area Law of 1979 as amended and the Parking and Business Improvement Area Law of 1989 (Streets and Highways Code Section 36500 et seq.), Chapter 9.42 SCCC establishing the Soquel Village parking and business improvement area, and in compliance with SCCC § 2.38.060.

The Advisory Board shall consist of five members, all of whom are residents of the County and participants in the Soquel Village parking and business improvement area, appointed by the Board of Supervisors. One of the members of the Advisory Board shall be nominated by the Soquel Village Business Association. The remaining nominations for membership shall be based on applications generated from an annual notice of vacancies mailed to the improvement area participants on or before April 1st of each calendar year. If a vacancy in the Advisory Board occurs and there will be more than three months before the annual appointments are made, then an appointment shall be made by the Board of Supervisors as soon as possible. Efforts shall be made to include representatives from each quadrant of the improvement area. No more than two of the members of the Advisory Board shall serve concurrently as directors of the Soquel Village business association.

Each member shall serve for a term of four years commencing on April 1st of the year in which the member is nominated. However, the initial appointment of members shall be staggered so that four of the original members shall serve for a term of two years, with such staggering to be determined by lot.

(A) 
General Organization. The Advisory Board shall comply in all respects with SCCC § 2.38.110 through § 2.38.250 unless otherwise provided herein.
(B) 
Filling Vacancies—Scheduled and Unscheduled. All vacancies on the Advisory Board shall be filled by the Board of Supervisors in accordance with SCCC § 2.38.210 or § 2.38.220, except as otherwise provided in SCCC § 2.95.020.
(C) 
Staff Support. The Department of Public Works shall provide staff support for the Advisory Board and receive copies of all minutes, reports and recommendations submitted to the Board of Supervisors by the Advisory Board.
(D) 
The organization and procedures of the Advisory Board regarding absences of members, officers, election of chairperson, meetings, quorum, agenda and subcommittees shall be pursuant to bylaws approved by the Board of Supervisors.

(A) 
The Soquel Village Parking and Business Improvement Advisory Board is created for the purpose of complying with the legal requirements of the Parking and Business Improvement Area Law of 1989 and Chapter 9.42 SCCC and to advise the Board of Supervisors on the administration of the Soquel Village parking and business improvement area.
(B) 
Specifically, the Advisory Board shall exercise the following responsibilities:
(1) 
Make an annual recommendation to the Board of Supervisors on the expenditure of revenues derived from the levy of assessments pursuant to Chapter 9.42 SCCC, on the classification of businesses as applicable, and on the method and basis of levying the assessments;
(2) 
Cause to be prepared a report for each fiscal year for which assessments are to be levied and collected to pay the costs of the improvements and activities described in the report. The report may propose changes, including, but not limited to, the boundaries of the parking and business improvement area or any benefit zones within the area, the basis and method of levying the assessments, and any changes in the classification of businesses;
(3) 
File the annual report with the Clerk of the Board on or before April 1st of the year preceding the fiscal year discussed in the report. The report shall comply with SCCC § 9.42.070 and § 9.42.071.
