The city council finds that in order to preserve the public safety it is necessary to provide bus turnouts and shelters along arterial and other major streets within the city. Bus turnouts provide added traffic safety and the turnouts and shelters help to encourage the use of public transit, thus decreasing traffic congestion.

In this chapter unless the context otherwise requires:
A. 
"Arterial street"
means an arterial street as designated on the city's general plan, a specific plan, or transportation plan;
B. 
"Bus shelter"
means an enclosure designed to protect passengers waiting for buses;
C. 
"Bus turnout"
means an inset of the curb, gutter and sidewalk to allow buses to stop and discharge and receive passengers so that the travel lane of a street is not blocked by the bus;
D. 
"Director"
means the city's community services director or his designate;
E. 
"Transit district"
means the Eastern Contra Costa County Transit District.

The director shall notify the transit district whenever the city receives an application for any of the following types of development:
A. 
Housing project with 50 or more units which is adjacent to an arterial street;
B. 
Commercial or industrial project which is adjacent to an arterial street;
C. 
One of the above types of projects which is adjacent to a street not designated as an arterial but which is likely to be serviced by a bus route and where buses would pose a substantial traffic hazard if stopped in the traffic lane for passengers.

The transit district shall review each project which is referred to it by the city and, within 15 days of receipt of the referral, notify the city whether a bus turnout or a bus shelter or both should be required to be constructed in conjunction with the project. The determination shall be based upon the existence of a bus route on an adjacent street or the likelihood that a route will be created along said street. If the transit district finds that a bus stop at the subject location is or would be desirable, it shall notify the director to require installation of the turnout or shelter.

If the district fails to respond to the referral within 15 days as specified in PMC § 15.96.040, the city may consider the requirement for a bus turnout or shelter waived. However, if the transit district subsequently affirmatively responds, and if there is sufficient time to incorporate design of the improvements into the developer's application and plans, then the director may require the facility.

If the transit district requests construction of a bus turnout or shelter the director of public works shall make construction of it a condition of approval of the development project. However, a failure of the city to so require because of error or omission does not create liability of the city to the transit district. Construction of the improvements shall be in conformance with specifications approved by the director and the transit district.
