The Borough does hereby adopt in its entirety, Title 29 of the Code of Federal Regulations (CFR) Part 1926, Subpart L, as the standard for construction standards for scaffolding to be erected in the Borough of Cliffside Park.

In light of the minimal sidewalk widths, any erected scaffolding shall not impede the sidewalk area to the extent that the sidewalk shall be ADA/Barrier Free accessible to any individual.

If the contractor questions the scaffolding construction methods, then the Borough Engineer shall be retained on behalf of the Borough through the escrow process, paid by the contractor to resolve all scaffolding questions pertaining to safety, construction, eligibility, and type; and

The Council reserves upon itself the right to amend the permit fees for scaffolding and engineering escrow, by resolution.
