Legal counsel to the City Council and staff of the City of Rio Dell is the City Attorney.

The City Attorney is defined for operational identity and is appointed by a majority of the Council, serving at the pleasure of the Council on terms of cost and scope of service made definite by a legal services contract or memorandum of understanding (MOU). The City Attorney shall be a licensed attorney at law experienced in municipal law. The City Attorney shall provide legal services to the Council, City Manager and other persons on a case-by-case basis.

Removal or dismissal of the City Attorney shall be by the City Manager at the direction of the Council. Such removal or dismissal shall comply in full with any legal services contract or memorandum of understanding for legal services. In removal or dismissal of the City Attorney, the Council shall use its uncontrolled discretion and its actions shall be final.
