As used in this article, the following terms shall have the meanings indicated:
BOROUGH
The Borough of Roselle.
MOTOR VEHICLE or VEHICLE
Includes all vehicles propelled otherwise than by muscular power, excepting such vehicles as run only upon rails or tracks and motorized bicycles, as defined in N.J.S.A. 39:1-1.
RESIDENT-ONLY PERMIT PARKING AREA
Those areas of the Borough where this article applies, as further described in Schedule XXX (§ 523-139). All properties with any property line fronting along a street therein described are to be considered part of that area and eligible to be issued a permit pursuant to § 523-70.
Proper signs shall be erected by the Borough in all resident-only permit parking areas to indicate the requirements and restrictions imposed by this article in accordance with existing rules and regulations of the State of New Jersey, specifically N.J.S.A. 39:4-198.
A. 
Every resident who resides in a resident-only permit parking area shall be provided an annual parking permit for each vehicle registered at such address by the Roselle Police Department, which permit shall be placed conspicuously on the vehicle's driver-side front dashboard (if a placard) or driver-side rear window (if a sticker). The permits shall be numbered such that each permit may be associated with the resident who resides in the permit parking area to whom it was issued. The permits shall be mailed by the Borough to the address provided by the resident as reflected in the application provided for in § 523-71 hereof.
B. 
Every resident who resides in a resident-only permit parking area may apply, not more than four times per month, to the Roselle Police Department for up to 10 daily guest parking permits per household. The daily guest parking permit shall be placed conspicuously on the vehicle's driver-side front dashboard. The daily guest parking permit shall indicate the date for which it is valid and identify the residence it is associated with. A resident may apply for additional guest parking permits, and upon a showing of good cause, the Roselle Police Department may issue additional permits. The daily guest parking permit shall be in such form as adopted by the Roselle Police Department.
A. 
Any resident who desires a parking permit to enable them to park a vehicle in a resident-only permit parking area may apply for a parking permit under this section by completing an application, to be provided by the Borough, detailing the applicant's name and address, insurance, and the registration number of the motor vehicle for which the applicant desires a parking permit. Residents may obtain a parking permit for each vehicle registered to such resident.
B. 
Permits shall be issued for and valid in only one resident-only permit parking area and shall permit the holder of said permit to park on any street within that resident-only permit parking area.
A. 
Each permit shall be issued upon request of any resident of a resident-only permit parking area, on an annual basis commencing on January 1 of each year. There shall be no proration if less than the full relevant period remains at the time an application for a permit is submitted.
B. 
Parking permission is subject to:
(1) 
The parking permit shall be and remain in effect throughout the calendar year issued unless surrendered or revoked prior thereto.
(2) 
The issuance of a parking permit shall not obligate the Borough to furnish parking facilities to the holder of said parking permit.
C. 
Permission to park may be revoked for any of the following:
(1) 
Falsely representing the ownership of a vehicle or the residence of the owner.
(2) 
The commission, by the holder of a parking permit, of any unlawful act prohibited by the laws of the State of New Jersey or for any act in violation of the provisions of this section or contrary to any regulation of the Borough pertaining to the use and occupation of any parking area while entering, parking, or leaving such parking area as set forth in this article.
D. 
Reproduction of any parking permit is prohibited.
(1) 
No person shall:
(a) 
Copy, reproduce, or otherwise create a parking permit authorized pursuant to this article.
(b) 
Create a facsimile or counterfeit parking permit.
(c) 
Display or use a parking permit knowing same to have been copied, reproduced, or otherwise crafted in violation of this article.
E. 
No person shall furnish false information or fraudulent documents in connection with an application for a parking permit.
F. 
Any person found violating the provisions of this section shall be subject to a fine not to exceed $2,000 and/or imprisonment for not more than 10 days and shall forfeit the right to receive or use a parking permit under this section for a period of three years.
G. 
No parking permit may be issued to a person with three or more outstanding summonses for violation of any of the provisions of this section. Further, the Borough may provide for the removal of any vehicle which is allowed to stand or be parked in any permit parking area in violation of the provisions of this section. The owner of such vehicle shall bear the reasonable cost of removal and storage that may result from such removal before regaining possession of the vehicle.
H. 
Any violations under this section that are disputed by the resident to whom the parking permit was issued will be adjudicated in the Municipal Court of the Borough.
The following vehicles shall be exempt from the provisions of this article:
A. 
Contractors, service, and delivery vehicles bearing the name and address of a commercial business during the time they are rendering service to a residence on any of the restricted streets.
B. 
Public utility vehicles bearing the name and address of the utility during the time they are rendering service.
C. 
Police, fire, and medical emergency vehicles while parking in the line of duty.
This article shall not affect, repeal, or revise any other parking restrictions of the Borough Code, including, but not limited to, § 523-124, governing no parking during certain hours, and § 523-29, prohibiting parking of trucks, buses, and commercial vehicles within the Borough.
