The City of Lakeside City hereby creates the Office of Code Enforcement that is responsible to enforce this article and is responsible for compliance therewith. The Code Enforcement Officer shall serve as the city's building inspector and code enforcement officer, will perform any other duties required by this article and will otherwise administer and implement the Technical Codes adopted by the city pursuant to this article 3.02.

For the purpose of this article, the following terms shall have the meaning indicated in this section. Words not specifically defined herein or in the Technical Codes but used in this article 3.02 or the Technical Codes shall have their ordinary meaning.
Builder
This term, as used herein, shall not only include individuals, but shall include partnerships, corporations, and limited liability companies who shall perform construction as defined herein. Provided, however, that nothing in this definition shall limit the responsibility of individuals to comply with the provisions of this article 3.02 when they are acting on behalf of a partnership, corporation, limited liability company or other business entity.
Construction
This term, as used herein, shall include:
(1) 
Construction of a building, structure or appurtenances from the ground up, including foundation, framing, roofing, and installation of windows and doors;
(2) 
Alternations, movement, enlargement, replacement, repair, and installation of equipment or removal or demolition of every building, structure or appurtenances;
(3) 
The installation, repair, removal, demolition, destruction or modification of all systems associated with every building, structure or appurtenances, including, without limitation, any plumbing electrical or mechanical systems; and
(4) 
Any activity which is regulated by any of the Technical Codes, as well as any future versions of those codes adopted by the city.

The following codes (hereinafter collectively referred to as the "Technical Codes") are hereby adopted by reference and all construction within the city limits of Lakeside City shall be done in compliance with the following, unless otherwise required by this article 3.02:
(1) 
Building code.
2012 International Building Code.
(2) 
Plumbing code.
2012 International Plumbing Code.
(3) 
Electrical code.
2011 National Electrical Code.
(4) 
Other codes.
All codes referred to in any of the building code, plumbing code or electrical code.

A permit shall be required for all construction as defined in section 3.02.002, Definitions. All permits are issued for a six-month period. A new permit will be required after six months. To obtain a permit, an individual or firm must submit (as applicable) building plans, site design, elevation certification, and appropriate licenses, pay all required permit fees and provide proof of insurance coverage to Lakeside City Administration. The Lakeside City Administrator will coordinate plans with Code Enforcement Office, and secure coordination from a minimum of two council members, when new construction is involved. After approval, Code Enforcement will issue permits as required upon compliance with all provisions of this article 3.02.

Any individual, company, firm, partnership, or corporation engaged in any phase of construction work within the corporate limits of the City of Lakeside City shall obtain and have in full force and effect a policy of liability insurance insuring against claims or actions for personal injuries or property damage occurring or claiming to have occurred upon or growing out of engaging in or doing such business. A current certificate of insurance meeting or exceeding the limits described below must be submitted with application for permit. The insurance certificate shall include a provision that the insurance carrier will provide a minimum of ten (10) days' notification to Lakeside City, Texas, should the insurance coverage be canceled or reduced. Property owners residing on property or who will reside on property are exempt from the liability insurance requirement if the owner is doing all of construction. Limits are as follows:
(a) 
Injuries to or death of one (1) person: $100,000.00.
(b) 
Injuries to or death of more than one (1) person: $300,000.00.
(c) 
Property damage pertaining to any one accident or occurrence: $100,000.00

(a) 
Electrical.
Individual or firm must furnish a master electrical license from a town or municipality reciprocating with Lakeside City. Property owners residing on property or who will reside on property, and will accomplish all electrical work, are exempt from license requirements, but will be subject to Lakeside City inspection and approval.
(b) 
Plumbing.
Individual or firm must furnish appropriate license prior to commencement of plumbing work. Property owners residing on property or who will reside on property, and will accomplish all plumbing work, are exempt from license requirements, but will be subject to Lakeside City inspections and approval.

In addition to the Technical Codes referenced in section 3.02.003, the following requirements and/or restrictions shall be imposed on all residential construction in the city limits of Lakeside City, Texas:
(1) 
Building requirements and/or restrictions.
(A) 
Lot size shall be a minimum of 15,000 square feet. All replatted lots will be required to be a minimum of one (1) acre.
(B) 
Home shall contain a minimum of 1,600 square feet of living space, exclusive of porches, attached garages, and other outside storage facilities. No outbuilding(s) shall be constructed and placed in use on any property until the family residence thereon is completed. House trailers, mobile homes, railroad cars, bus or truck bodies, or similar items will not be moved into or onto any property situated within the city. Primary dwelling shall be of new construction. No old house or building shall be moved into or onto any property situated within the city. Storage buildings built at another location can be sited on properties for storage purposes providing all provisions of this and other ordinances are met (i.e., setback requirements, lateral line obstruction, utility easement integrity, etc.). Outbuildings less than four hundred (400) square feet in size do not require a permit, unless a foundation slab is laid. If electrical or plumbing work is done, a permit is required.
(C) 
A twenty-five-foot front and three-foot side and back setback shall be maintained on all construction unless it is on a corner lot, a twenty-five-foot front and a ten-foot side setback shall be maintained, with back setback and side not abutting a street remaining at three (3) feet. The city reserves the option to enforce a greater, more than ten (10) feet, side setback on corner lot should safety, traffic obstruction or other considerations warrant it. For purposes of determining structure location, all overhangs shall be considered as part of the construction. Note: Setback will be maintained the required distance from the property lines of the lot. When property lines are not easily identifiable, Code Enforcement shall require a survey to provide identification of property lines.
(D) 
All foundations shall be one (1) foot above the 100-year floodplain established by the Federal Emergency Management Agency (FEMA). FEMA has established the floodplain at 986 feet above sea level. Therefore, all foundations shall be at or above 987 feet above sea level. Additionally, the City of Lakeside City shall impose restrictions detailed in Ordinance 90-3, "Flood Damage Prevention Ordinance," when or where construction will impact runoff water heights or velocities.
(E) 
All residential structures shall be constructed with 80% of either a masonry, brick, or stucco veneer. Outbuildings that exceed four hundred (400) square feet in size shall also be required to have a masonary, brick, or stucco veneer to a height of three and one-half (3 1/2) feet above the foundation, and shall be constructed with restrictions or requirements described in this article.
(F) 
Collar trusses shall be every six (6) feet on roof trusses.
(G) 
All decking shall be a minimum of 5/8 of an inch thick.
(H) 
When room size exceeds sixteen (16) feet in any direction, (2"x8") sized material shall be used for ceiling joists and rafters. Trusses shall be of (2"x6") material and shall be used on a minimum of twenty-four (24) inches on center.
(I) 
All vegetation shall be removed from the slab site before construction begins.
(2) 
Plumbing requirements and/or restrictions.
(A) 
A minimum of one hundred (100) feet of lateral line are required in our wastewater permit issued by the state. Site plans shall make accommodations for these lines.
(B) 
All swimming pool construction, whether above or below ground, will require a permit.
(C) 
All lawn irrigation/sprinkler system installations shall require a permit prior to commencement of installation. A "double check" type backflow preventer equipped with 2 ball valves with 4 test cocks shall be installed to prevent backflow into the city water system. Backflow preventer must be testable and be made of non-corrosive material in body and parts. (See Ordinance 05-03 as amended.)
(D) 
To the extent applicable, any plumbing supplied to an outbuilding shall be subject to Ordinance No. 86-1 and requisite city inspections.
(3) 
Electrical requirements and/or restrictions.
No electrical wire smaller than twelve (12) AWG shall be used for electric wiring in any building or structure.

The following fees shall be paid by persons or firms seeking a permit to undertake any of the following types of construction:
(1) 
Building permit fees.
(A) 
New building or addition to an existing building:
(i) 
Residential, storage or shop: $0.25 X total sq. ft. of structure.
(ii) 
Business, mercantile, educational, and institutional: $0.25 X total sq. ft. of structure.
(B) 
Demolition: $50.00.
(C) 
Swimming pool: $50.00.
(D) 
Lawn sprinklers: $50.00.
(E) 
Reinspection: $25.00. Chargeable if any work fails to pass initial inspection.
(2) 
Plumbing permit fees.
(A) 
New building or addition to an existing building:
(i) 
Residential or addition: $50.00.
(3) 
Septic tank and excavation permit fees.
(A) 
Septic tank inspection: $125.00.
(B) 
Septic tank tapping fee: $500.00.
(C) 
Septic tank install: $1,700.00. Installed by licensed septic tank installer registered with the State of Texas (TCEQ).
(4) 
Electrical permit fees.
(A) 
New building or addition to an existing building:
(i) 
Residential or addition to an existing building: $50.00.
(ii) 
Commercial or addition to an existing building: $50.00.
(iii) 
Meter loop alteration or change out or upgrade services: $50.00.

The City Council of the City of Lakeside City, Texas, finds that the regulations set forth in this article 3.02 are necessary to protect the public health, fire safety and sanitation of the city and its inhabitants. Any person or firm that violates any of the provisions of this article 3.02 shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine not to exceed $2,000.00. Each day a violation occurs shall constitute a separate offense.
