The imposition of impact fees is an important method of mitigating the impact of future development on public safety facilities and services. As development occurs, the city will need to expand, construct and maintain existing and additional public safety facilities to maintain its existing standards for an increasing service population. Therefore, the city has determined that improvements and additions to public safety facilities are required to maintain the city's existing level of service.

For the purposes of this chapter, the following words and phrases shall have the meaning respectively ascribed to them by this section:
A. 
"Building"
means any new structure used or intended for supporting or sheltering any use or occupancy, including those moved into the city limits, but does not include any outdoor tanks, towers, carports or other similar structures.
B. 
"Dwelling unit"
means a single unit providing complete, independent living facilities, balconies and other similar structures, as determined by the building official.
C. 
"Manufactured home space"
means any area or portion of a manufactured home park designated, designed or used for the occupancy of one manufactured home on a temporary, semi-permanent or permanent basis.
D. 
"Person"
means any domestic or foreign corporation, firm, association, syndicate, joint stock company, partnership of any kind, joint venture, club, society or individual.
E. 
"Residential building"
shall mean apartment buildings or dwelling units. All other buildings shall be considered nonresidential.

The following public safety impact fee schedule is imposed upon any dwelling unit, manufactured home space, any nonresidential building, and every person to whom a permit to construct any building is issued.

A. 
The public safety impact fee is intended to apply to the living area of all residential construction and to all reconstruction, alteration, modification and additions which create additional habitable spaces and/or dwelling units.
B. 
The public safety impact fee is intended to apply to the building area of all new nonresidential construction and to additional building areas due to reconstruction, alteration, modification and additional nonresidential buildings.
C. 
Square footage shall be determined by adding the number of square feet of space on each floor or level.

The public safety impact fee required to be paid shall be due and payable upon issuance by the city of a building permit or upon issuance by the city of a permit to construct and install electrical and plumbing equipment to service a manufactured home space.

All of the public safety impact fees collected shall be placed in a special fund which is created and established for such purposes and which shall be known as the public safety impact fund. Sums collected under this chapter may be expended for land, buildings, office equipment, capital equipment, maintenance equipment, vehicles, and improvements as consistent with state law.
