The City of Perth Amboy does hereby adopt in full the current New Jersey State Sanitary Code, Chapter 8, Body Art Procedures, N.J.A.C. 8:27-1 et seq., and all future amendments thereto, with respect to body art procedures within the City. Any person or establishment who fails to comply with the provisions of N.J.A.C. 8:27-1 et seq. while performing such work is in violation of this section.
BODY ART ESTABLISHMENT
A personal service establishment that provides the practice of physical body adornment in permitted establishments by operators utilizing, but not limited to, the following techniques:
A. 
Body piercing;
B. 
Tattooing; and
C. 
Permanent cosmetics.
BODY PIERCING
The puncturing or penetration of the skin of a person using pre-sterilized single use needles and the insertion of pre-sterilized or disinfected jewelry or other adornment thereto in the opening.
PERMANENT COSMETICS
The intradermal implanting of inert pigments, colors, and/or dyes, which results in permanent alteration of tissue to gain a cosmetic effect, and includes the form of micropigmentation known as "microblading."
TATTOOING
Any method of placing ink or other inert pigment into or under the skin or mucosa by the aid of needles or any other instrument used to puncture the skin, resulting in permanent coloration of the skin or mucosa. This includes all forms of permanent cosmetics.
No person shall engage in the business of a body art establishment within the City without first obtaining a license. Such an application shall be made to the local health department.
The license fee shall be $300 for an initial review of plans for body art establishments. Fees for annual licensing inspections of establishments performing tattooing shall be $200, with a one-year licensing period from January 1 to December 31. All licenses issued during the course of a calendar year shall expire on December 31 of that year, regardless of the date issued. All license renewals shall be procured with the local health department prior to the end of the calendar year of the current license.
