Littering by throwing trash and other refuse is prohibited. No household or commercial garbage, trash, refuse or rubbish of any kind shall be placed in any container for litter in any park area unless said trash or litter was generated in the park area by use here. Camping is permitted only in designated areas at twenty dollars ($20.00) per night for primitive camping and thirty dollars ($30.00) per night for RV hookups. Camping permits are to be issued by the Police Department before occupancy of any camp site. Permits may be issued for up to seven (7) days in any one (1) calendar month. Fires are allowed in designated areas only.

Privately owned vehicles may be driven only on improved roads within any City park. Any person operating a motor vehicle off the paved portion of a park road or on a park trail may be subjected to a fine as set forth in Chapter 100, Article III, of this Code. A speed limit of fifteen (15) miles per hour is hereby established for all park roads. Park trails shall be closed after dusk and at all times during deer season. No all-terrain vehicles shall be allowed within the City park system. For the purposes of this Section an "all-terrain vehicle" shall be any motorized vehicle manufactured and used exclusively for off-highway use which is fifty (50) inches or less in width, with an unladen dry weight of six hundred (600) pounds or less, traveling on three (3), four (4) or more low pressure tires, with a seat designed to be straddled by the operator, and handlebars for steering control.

Pets shall be restrained while within park premises within the City limits. Pets at the lake areas shall be under the control of the owner.

A. 
No fee or other charges will be required of boats utilizing City lakes.
B. 
Only boats with less than nine and nine tenths (9.9) horsepower will be allowed to utilize City lakes. Use of personal watercraft is prohibited. For the purpose of this Section, personal watercraft shall be a type of vessel propelled by machinery which is designed to be operated by a person sitting or standing inside the vessel.

Group activities are permitted only upon prior approval with a twenty-five dollar ($25.00) user fee. A twenty-five dollar ($25.00) deposit must also be made to insure cleanup of the shelter houses and other areas of the park that may be used for group activities.
B. 
Group activities shall be permitted only during the hours the parks are open to the public, 6:00 A.M. to 10:30 P.M. Sunday through Thursday and 6:00 A.M. to 12:00 A.M. Friday and Saturday.

No fee or other charges will be required for fishing in City lakes.
B. 
The D.C. Rogers Lake and Fayette Lake are owned and operated by the City of Fayette. The primary purpose of those lakes is to provide water supply for the City of Fayette. Any and all other activities are secondary and will be permitted provided they are compatible with the primary purpose of these lakes. Any activity, including fishing, is subject to restrictions as required to serve the primary purpose of the lakes. Restrictions shall be conspicuously posted so as to notify lake users. Area use fee collected from non-Fayette residents shall assist in the expense of maintaining the roads, picnic areas, tables, and restocking of fish at the lake areas.
C. 
All bass more than twelve (12) inches but less than fifteen (15) inches total length must be returned to the water immediately after being caught. The daily creel limit shall be six (6).
D. 
Channel catfish less than fifteen (15) inches must be returned to the water immediately after being caught. The daily creel limit shall be five (5).
E. 
Fish may not be dressed within the City parks.
F. 
Only poles or rods may be used to take fish except carp and no more than three (3) poles or rods may be used by any one (1) person.
G. 
Fishing is restricted to the dam only on the D.C. Rogers Lake during the waterfowl season.

Hunting is permitted in designated areas only and in accordance with all State regulations. Deer may be taken by bow and arrow only in the D.C. Rogers Lake area. All State regulations concerning hunting seasons and methods shall apply.
B. 
Duck blind sites shall be assigned by a lottery system to Fayette residents, Howard County residents, and all others in that order. Duck hunters will register with the City Clerk during September of each year. At the time of registration, all duck hunters must show proof of Federal stamps, State stamps, hunting license, and migratory bird card. The City Clerk will announce the dates of the lottery drawing. A fifty dollar ($50.00) deposit is required at the time of registration to ensure the removal of blinds within fifteen (15) days following the close of the duck season. An additional fifty dollar ($50.00) user fee will be collected when individuals are selected for blind sites. Ducks shall be hunted only from an approved blind site and only under such guidelines as provided by the Parks and Recreation Commission. Duck hunting may take place only at D.C. Rogers Lake.
C. 
The Parks and Recreation Commission is hereby delegated and shall have the power to promulgate rules and regulations to carry out the purposes of this Section in the regulations, removal, and inspection of duck blinds or similar structures and for the issuance of permits required herein.
D. 
Trapping may be permitted in accordance with State regulations by special agreement to Fayette residents. Applications shall be made to the City Clerk and awarded on a first-come, first-serve basis. Trapping shall be permitted only in the areas of D.C. Rogers Lake.

The dumping of any stone, branches, limbs, or tree cuttings is prohibited in designated areas. The marking or defacing of any structure whatever kind in any of the Fayette parks is prohibited. The posting of any signs, bills, advertisements except municipal postings or anything in the parks is prohibited. The damaging of any walk or driveway with heavy motor vehicles with steel tires is prohibited. The parking of vehicles on grass areas is prohibited.

No person shall be permitted to loiter in the parks between the hours of 10:30 P.M. and sunrise the next morning (Sunday through Thursday) and the hours of Midnight and sunrise the next morning (Friday and Saturday) and no person shall play any game for bet, wager or prize in such park. This prohibition applies to all Fayette City parks.

A. 
General Restriction. Except as otherwise provided in this Section, the use or discharge of firearms within the corporate limits of the City of Fayette is prohibited.
B. 
Permitted Locations For Firearm Use.
1. 
The discharge of firearms shall be permitted only at the following authorized facilities:
a. 
The designated City rifle range; and
b. 
The Fayette Fairgrounds Shooting Facility, located at the Fayette Fairgrounds and operated by the Howard County Fair Development Association.
2. 
Use of firearms at either location is restricted to official daylight hours, defined as the period between sunrise and sunset, unless otherwise authorized by the City through special permit or emergency provision.
3. 
Violation of this ordinance will result in a five hundred dollar ($500.00) fine.
C. 
Requirements for the Fayette Fairgrounds Shooting Facility.
1. 
The Howard County Fair Development Association shall maintain current and continuous liability insurance coverage for the Fayette Fairgrounds Shooting Facility, in an amount not less than one million dollars ($1,000,000.00) per occurrence or as otherwise set by resolution of the Board of Aldermen.
2. 
The Association shall develop, implement, and annually update an emergency action plan (EAP) for the facility. The EAP shall include protocols for medical emergencies, firearm safety, evacuation, and emergency contact procedures.
3. 
A copy of the current insurance certificate and emergency action plan shall be submitted to the City Clerk no later than January 31 of each calendar year, or prior to any scheduled shooting event at the facility.
D. 
Exception For Waterfowl Hunting. Discharge of firearms for lawful waterfowl hunting is permitted within the City limits, provided it complies with all applicable Federal and State hunting regulations, City-designated restricted zones, and the use of non-toxic shot as required by law.
E. 
Other Exceptions. This Section shall not apply to:
1. 
Law Enforcement Officers or public safety personnel acting in the scope of official duties;
2. 
Individuals using firearms in lawful self-defense or defense of others as permitted under Missouri law;
3. 
Activities authorized by special event permit or specific ordinance approved by the Board of Aldermen.
F. 
Violations And Penalties. Any person violating this Section shall be guilty of an ordinance violation and, upon conviction, may be fined not less than one hundred dollars ($100.00) and not more than five hundred dollars ($500.00), imprisoned for up to ninety (90) days, or both.
G. 
Severability. If any provision of this Section is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

All the above regulations and rules apply to all the Fayette City parks, including D.C. Rogers Lake, Rickette Lake, Peters Lake, Liberty Park, Fayette City park and all parks and recreations and sewage lagoon facilities owned by the City of Fayette unless otherwise stated.

It shall be unlawful for any person to bring, or possess, or cause another person to bring or possess glass drinking vessels or other glass objects subject to breaking into any City park.

Violation of any Section of this Division 1, punishment for which is not set forth, shall be punishable as set forth in Chapter 100, Article III, of this Code.
