City of Lewistown, IL: PARKING OF TRUCKS AND VANS.

Prohibition. It shall be unlawful for any person to park or cause to be parked any vehicle along the following streets in the locations indicated. Signs shall be erected to such effect giving notice thereof.

(B)

Penalty.

(1)

Any person violating Ord. No. 1988-3 shall be fined not less than $25, nor more than $500 for each offense, and a separate offense shall be deemed committed for each and every day during which a violation continues.

(2)

(a)

Whoever violates any other provision of this schedule shall be deemed guilty of a misdemeanor and fined not less than $25, nor more than $100 for each offense, except as provided below. Each day's violation constitutes a separate offense.

(b)

Violation of Ord. No. 2005-1, Ord. No. 2005-3 or Ord. No. 2006-10 shall be punishable by a fine as follows:

First offense	$25
Second offense	$40
Third offense	$60
Fourth and subsequent offenses	$60, plus $5 per prior offense up to $100

(c)

In determining the number of prior offenses, only violations of Ord No. 2005-1, Ord. No. 2005-3 or Ord. No. 2006-10 within the three years preceding the pending offense shall be considered.

(d)

Violations settled under divisions (B)(2)(e) and (f) below are considered prior offenses.

(e)

To avoid prosecution for an offense under Ord. No. 2005-1, Ord. No. 2005-3 or Ord. No. 2006-10, a violator may, within ten days of receiving a citation, settle the citation by payment of one-half of the specified fine at the City Building. The Chief of Police is hereby authorized and directed to cease prosecution of any citation so settled.

(f)

After ten days but prior to the court date stated in the citation, a violator may settle the citation by payment of the full amount of the specified fine at the City Building. The Chief of Police is hereby authorized and directed to cease prosecution of any citation so settled.

SCHEDULE II ONE-HOUR PARKING.

(A)

(1)

It shall be unlawful for any person to park any motor vehicle for a period longer than one hour during the week, from Monday through Friday, inclusive, between the hours of 8:00 a.m. and 4:00 p.m. on the following described streets.

(1)

Each business located upon the square may, subject to availability and the other terms and conditions referenced herein, designate up to two parking spaces for short-term customer parking. The term "square" above shall include the following locations:

(2)

A one-time fee of $75 per space to cover the cost of signage shall be payable by the business in question prior to having such spaces designated. Business owners shall be responsible for notifying the Lewistown Police Department with regard to complaints of non-customer use of such spaces during business hours.

(3)

In addition to a fine set forth elsewhere in this chapter, such business owners may request that vehicles in violation be towed at the expense of the owner of the vehicle in violation.

(4)

The Lewistown Police Department is authorized to enforce such requests for towing of vehicles. Signs posted in accordance with this provision shall state that illegally parked vehicles may be towed at the vehicle owner's expense.

(5)

The term BUSINESS as used herein shall include all establishments of the type and character identified in Section 7.2 of the Zoning Ordinance of the City of Lewistown.

(6)

A maximum of two parking spaces on each block may be designated by businesses having overlapping ownership. Overlapping ownership shall be considered to have occurred when any two or more businesses are owned or operated in whole or in part by any individual, partnership, corporation, or other business entity having an ownership interest of any sort in another business located on the same block.

(7)

The term SHORT-TERM CUSTOMER PARKING shall not include use by owners, employees, or principals of businesses (hereinafter "owners") for their personal use. The Mayor in his or her discretion may discontinue designation of any parking space or spaces under this section if such space is used regularly by the owners of the business affiliated with such parking space for such personal use as opposed to customer use.

(8)

Signs shall be erected to effectuate the above-referenced amendments to the parking schedule.

(C)

Penalty.

(1)

Any person who violates any provision of this chapter shall be subject to the following fines:

(a)

$10 if the parking violation is paid within five days of the date of issuance.

(b)

$20 if the parking violation is paid between five and ten days after the date of issuance.

(c)

$50 if the parking violation is paid between ten and 30 days after the date of issuance; and

(d)

$100 plus court costs if the parking violation is paid over 30 days after the date of issuance.

(2)

The Chief of Police is directed to wait no less than 45 days after issuance of a parking ticket before forwarding such ticket to the City Attorney for prosecution. The Chief of Police is directed to accept the sum of $25 in settlement of any violation of this section if such sum is received in full prior to the parking ticket being forwarded to the City Attorney for prosecution.

SCHEDULE III PARKING OF TRUCKS AND VANS.

(A)

Definition. As used in this schedule, the following words have the following definitions:

(1)

TRUCK.

Any vehicle with an open cargo area of to which a trailer is attached which is primarily used for the purpose of transporting consumer goods, raw materials, or farm products. This term does not include pickup trucks or sport utility vehicles which are primarily used for transportation of people, but which are occasionally used for the purpose of transporting consumer goods, raw materials, or farm products, unless a trailer is attached to such vehicle.

(2)

VAN.

Any vehicle with an enclosed cargo area, including vehicles with an enclosed cargo area to which a trailer is attached, which is primarily used for the purpose of transporting consumer goods, raw materials, or farm products. This term shall not include vans which are primarily used for the purpose of transporting people, such as mini-vans and conversion vans.

(B)

Parking restriction. It shall be unlawful to park any truck or van of the following streets:

Fourth and subsequent offenses $60 plus $5 per prior offense up to $100

(3)

In determining the number of prior offenses, only violations of this schedule within the three years preceding the pending offense shall be considered.

(4)

Violations settled under subsections (C)(5) and (C)(6) below are considered prior offenses.

(5)

To avoid prosecution for an offense under subsection (B) of this schedule, a violator may, within 10 days of receiving a citation, settle the citation by payment of ½ of the specified fine at the City Building. The Chief of Police is hereby authorized and directed to cease prosecution of any citation so settled.

(6)

After 10 days but prior to the court date stated in the citation, a violator may settle the citation by payment of the full amount of the specified fine at the City Building. The Chief of Police is hereby authorized and directed to prosecution of any citation so settled.

SCHEDULE IV PARKING DURING SCHOOL HOURS.

(A)

Parking restriction. It shall be unlawful to park any car, truck or van of the following streets between the hours of 7:00 a.m. and 4:00 p.m. on days when school is in session at J.J. McNally grade school. Signs shall be erected to such effect giving notice thereof.
