For purposes of this Chapter, the following words and phrases shall have the meanings as provided for herein:
ADULT
A person eighteen (18) years of age or older.
CONSUMER FIREWORKS
Shall have the same meaning as "1.4G fireworks" as defined in Section 500.110 of this Code, as amended by Section 500.115.
DISCHARGE
Shall mean to use, set off, ignite, or fire fireworks.
FIREWORKS SEASON
The period beginning on the third day of July and continuing through the fourth day of July of the same year.
PERSON
Any individual, partnership, corporation, company, firm, association, or organization, or any agent, officer, employee, authorized representative of the same, or any combination of the same, of whatever form or character.
RED FLAG WARNING
A forecast warning issued by the National Weather Service to inform area firefighting and land management agencies that conditions are ideal for wildfire combustion, and rapid spread, which may include, but is not limited to, any of the following factors a drought conditions, humidity is very low, high or erratic winds, or lightning.
Any terms or acronyms not defined herein shall have the same meaning as provided by Section 500.110 as amended by Section 500.115.

A. 
It shall be unlawful for any person, firm, or corporation to discharge fireworks of any kind for any nature within the City limits, except as provided for by this Chapter. However, this Chapter shall not apply to the following:
1. 
The necessary discharge of flares, or the equivalent, for signal purposes.
2. 
The activities of any military or Police organization for official purposes.
3. 
The use of blank cartridges, firearms or species of fireworks approved at the State level in connection with theatrical exhibitions.
4. 
Matches, toy pistols, toy canes, toy guns, party poppers, or other devices in which paper caps containing twenty-five hundredths grains or less of explosive compound as set forth in Section 320.131(5), RSMo.

A. 
The discharge of fireworks within the City shall be limited to between the hours of 6:00 P.M. and 11:00 P.M. during fireworks season and shall occur only on private property with the consent of the owner thereof; provided, however, this Section shall not apply to any fireworks display or the use of any fireworks pursuant to a permit issued by the City pursuant to this Chapter.
B. 
Persons seventeen (17) years of age and younger shall not discharge fireworks except under the supervision of an adult. Supervision shall be adequate where the adult is within sight and sound of the children during the discharge of fireworks.
C. 
It shall be unlawful for any parent, guardian or other adult person having custody or control of any minor seventeen (17) years of age or less to knowingly allow such minor to discharge fireworks in violation of the preceding Subsection.

A. 
Any permit issued pursuant to Section 500.110 of this Code, as amended by Section 500.115 shall also be subject to the provisions of this Section.
1. 
No permit issued pursuant to this Section shall be issued for more than one (1) day or any day other than a Saturday or a State holiday set forth in Section 9.010, RSMo., as amended.
2. 
The discharge of fireworks within the City authorized by a permit shall be limited to between the hours of 6:00 P.M. and 10:00 P.M.
3. 
No more than six (6) permits shall be issued pursuant to this Section in any calendar year and no person, including any persons residing at the same address or sharing a principal place of business, may apply for or receive more than one (1) permit during a fireworks season.

A. 
It shall be unlawful for any person to willfully set off, use, burn, explode or fire off any consumer fireworks except on private property with the consent of the owner thereof. Nothing contained herein shall allow a person to obstruct a public place in violation of Section 210.190 of the City Code.
B. 
It is unlawful for the owner, agent, or other qualified person to use, allow for use, consent to, or provide property within the limits of the City for the unauthorized discharge of fireworks or other violation of the provision of this Section.
C. 
Red Flag Warning. The Mayor has the authority to declare a ban on the discharge of all fireworks under a Red Flag Warning.
D. 
Any person who may discharge fireworks within the City limits of the City shall be responsible for the safe and responsible use of such fireworks and for any damages caused by such fireworks. The City shall not be responsible for the discharge of fireworks within the City limits.
E. 
No person shall ignite or discharge any fireworks:
1. 
Within three hundred (300) feet of any permanent storage of ignitable liquid, gases, gasoline pump, and gasoline filling station.
2. 
Within or throw the same from or into a motorized vehicle or any other means of transportation, or at or near any person or group of people.
3. 
Within six hundred (600) feet of any hospital, mental health facility, or school or within one hundred (100) feet of any location where fireworks are stored, sold or offered for sale.
