The following words, terms, and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Adult:
Any person 18 years of age or older.
Child:
Any person less than 18 years of age.
Crosswalk:
The portion of a roadway:
(a) 
Designated as a pedestrian crossing by surface markings, including lines, whether or not located at an intersection; or
(b) 
At an intersection that is within the connections of the lateral lines of the sidewalks on opposite sides of the roadway measured from the curbs or, in the absence of curbs, from the edges of the traversable roadway.
Daytime:
The period each day begins one-half hour before sunrise and ending one-half hour after sunset as established for the National Weather Service office located at 2579 S Loop 289 #100, Lubbock, TX 79423.
Driver:
The person driving and having physical control over a micro-mobility device.
Electric bicycle:
As defined in Texas Transportation Code § 664.001(4).
Gas combustible motor-assisted scooter:
A motor-assisted scooter propelled by a gas combustible engine.
Helmet:
Protective headgear that is not structurally damaged and that conforms to the standards of ANSI, ASTM, the Snell Memorial Foundation, or any applicable federal regulatory agency.
Inclement weather:
Weather that impacts the performance or ability to control a motor-assisted scooter, including but not limited to rain, lightning, fog, high winds, snow, or icy conditions.
Micro-mobility device:
A range of small, lightweight vehicles or devices incapable of operating at a top assisted speed faster than 25 mph and driven by one person. This includes bicycles, electric bicycles, electric motor-assisted scooters, electric skateboards, electric pedal-assisted bicycles (including one, two, three, and four-wheeled models), Segways, hoverboards, unicycles, and skateboards. Gas-powered devices are excluded.
Motor-assisted scooter:
As defined in Texas Transportation Code § 551.351(1).
Nighttime:
The period beginning one-half hour after sunset and ending one-half hour before sunrise as established for the National Weather Service office located at 2579 S Loop 289 #100, Lubbock, TX 79423.
Operator:
The person driving and having physical control over a micro-mobility device.
Parent:
The natural or adoptive parent or court-appointed guardian or conservator of a child.
Passenger:
Any person riding upon or attached to a micro-mobility device who is not the operator of such device.
Pedestrian:
A person on foot.
Public safety personnel:
An employee or officer of a law enforcement agency or the city's fire department, or a volunteer acting under the direction of said departments.
Public street:
A publicly owned or dedicated road, street, drive, alley, or right-of-way for use within the city's corporate boundaries.
Public way or public property:
Any property or easement owned, leased, or controlled by a governmental entity, including paths, trails, sidewalks, alleys, streets, highways, and parks.
Trail:
A separated linear pathway, typically 8 to 14 feet in width, intended for pedestrian and micro-mobility device recreational or transportation use.

It shall be unlawful for any person to:
(1) 
Operate or ride a motor-assisted scooter on any public way or public property where the posted speed limit exceeds 30 mph, except to cross such roads at intersections.
(2) 
Allow a child to operate a micro-mobility device on a public way or property without a properly fitted and fastened helmet.
(3) 
As a parent, authorize or permit a child to violate Subsection (2). It is presumed the parent has permitted the violation if the child is found operating a device without a helmet.

Operate a gas combustible motor-assisted scooter on public property.

It is unlawful to:
(1) 
Operate a micro-mobility device on public property in excess of 30 mph.
(2) 
Operate such device in violation of Texas Transportation Code, chapter 551, subchapter C.
(3) 
Operate any motorized micro-mobility device (except a nonmotorized skateboard) at nighttime unless equipped per Texas Transportation Code, § 551.104(b).
(4) 
Use a portable electronic device while operating a micro-mobility device.
(5) 
Use headphones or earphones while operating a micro-mobility device.
(6) 
Carry a passenger on a micro-mobility device.
(7) 
Operate a micro-mobility device during inclement weather.
(8) 
Operate a micro-mobility device in tandem or non-single-file formation.
(9) 
Operate a micro-mobility device with fewer than all wheels in contact with the ground.

Right-of-way and conduct:
(1) 
Operators must yield to pedestrians at all times.
(2) 
Operators shall slow and provide audible warning before overtaking or passing a pedestrian.

The provisions of this article do not apply to law enforcement officers using micro-mobility devices in the course of official duties.

Each motorized micro-mobility device must be equipped with:
(1) 
A functional braking system.
(2) 
A deck or seat for standing or sitting.
(3) 
A means to disengage the motor, allowing operation by human power alone.

(a) 
A first violation shall incur a $50.00 fine. However, the fine may be refunded if the violator:
(1) 
Schedules a micro-mobility safety course within 30 days of the judgment; and
(2) 
Attends the course as scheduled.
(b) 
A second violation shall incur a $50.00 fine.
(c) 
A third or subsequent violation shall result in a $100.00 fine per violation.
