For the purpose of this article, the following term(s) shall have the meanings indicated:
COMMERCIAL VEHICLE
Those vehicles having three or more axles.
TRAFFIC CONTROL DEVICE
Any sign, signal, or device legally authorized and used for the purpose of regulating, warning, or guiding traffic or parking.

A. 
All municipal streets in the City of Harrington shall be used solely for the convenience of the abutting owners, and all trucks, agricultural equipment, and vehicles other than noncommercial passenger vehicle are prohibited from the use thereof, except for local deliveries requiring their use, and emergency uses of the municipality, county, or state.
B. 
Nonapplicability to school buses. The provisions of this article shall not apply to school buses or vehicles used to transport children to and from school.

A. 
It shall hereafter be unlawful for any person, firm, association, or corporation, driving, operating, or having physical control over a motor vehicle on any street or property within the limits of the City of Harrington to violate any section found in Subchapters I through XIII of the Title 21, Chapter 41, of the Motor Vehicle Laws of the State of Delaware.
B. 
The City of Harrington hereby adopts by reference the provisions of Title 21, Chapter 41 of the Delaware Code, as amended from time to time, and incorporates said provisions as part of the City's traffic regulations. All violations of Title 21, Chapter 4l occurring within the corporate limits of the City of Harrington shall constitute violations of this chapter and shall be subject to enforcement by the Harrington Police Department, with the exception of the penal provisions of those statutes which are hereby excepted from this chapter, and 2l Del. C. § 4175 and 2l Del. C. § 4177, which shall remain subject to enforcement solely under Delaware State Statute.
C. 
Any person found guilty of violating any provision of this chapter shall, upon conviction, be fined not more than $50 for each violation, unless a different penalty is expressly provided by this chapter.
(1) 
For violations of locally established traffic regulations (including speed limits and parking restrictions), penalties shall be as follows:
(a) 
A fine of not less than $50 and not more than $200 for a first offense.
(b) 
A fine of not less than $100 and not more than $300 for a second offense within one year.
(c) 
A fine of not less than $250 and not more than $500 for a third or subsequent offense within two years.
(2) 
Any vehicle found in violation of City parking regulations may be subject to towing at the owner's expense.
D. 
For violations pertaining to commercial vehicles, including violations of 21 Del. C. Chapter 43 and/or Chapter 45, penalties shall be as follows:
(1) 
A fine of not less than $100 and not more than $300 for a first offense.
(2) 
A fine of not less than $200 and not more than $400 for a second offense within one year.
(3) 
A fine of not less than $500 and not more than $700 for a third or subsequent offense within two years.
Nothing in this article shall be construed to prohibit any vehicle, commercial or otherwise, from using the streets referred to in § 410-7 above for pick-up or delivery service to any residence or place of business located on any of the aforesaid streets.
Nothing in this article shall be construed to affect the movement of hearses, ambulances, pick-up trucks, panel trucks or station wagons over any of the streets referred to in § 410-7 of this article.
