This chapter shall be known as the "Fermanagh Township ATV and Snowmobile Road Use Ordinance" and is authorized by the provisions of Title 75 of Pennsylvania's Consolidated Statutes, as well as the provisions of Sections 1505 and 1506 of the Second Class Code of Pennsylvania.[1]

A.
General terms. In the interpretation of this chapter, the singular shall include the plural, and the masculine shall include the feminine and the neuter.
B. MUNICIPALITY PERSON TOWNSHIP
Specific terms. For the purpose of this chapter, the terms used shall be construed to have the following meaning: The definitions of the terms "ATV," "snowmobile" and "vintage snowmobile" are defined in 75 Pa.C.S.A. § 7702 of the Vehicle Code of Pennsylvania which are incorporated herein by this reference thereto.
Shall mean the Township of Fermanagh, Juniata County, Pennsylvania.
Any individual, association, partnership, public or private corporation whether for profit or not- for-profit, trust, estate or other legally recognized entity. Whenever the term person is used in connection with any clause providing for the imposition of a fine or penalty or the ordering of action to comply with the terms of this chapter, the term person shall include the members of an association, partnership or firm and the officers of any public or private corporation, whether for profit or not-for-profit.
Shall mean the Township of Fermanagh, Juniata County, Pennsylvania.
After the effective date of this chapter and upon the Township of Fermanagh posting the following public roads as required by the Vehicle Code it shall be lawful for any person 16 years of age or older to operate an ATV and/or snowmobile in conjunction with other authorized vehicles on the entire length of the following specifically designated the Township of Fermanagh public road provided the conditions and restrictions set forth in § 154-4 hereinafter are met:

A.
All ATV's and snowmobiles shall be operated in compliance with the provisions of 75 Pa.C.S.A. § 7726 which is incorporated herein by this reference;
B.
All ATV's and snowmobiles shall be operated in compliance with the provisions of 75 Pa.C.S.A. § 7727 which is incorporated herein by this reference;
C.
All ATV and snowmobile operators must comply with the accident and accident report requirements set forth in 75 Pa.C.S.A. § 7728 which are incorporated herein by this reference;
D.
All ATVs and snowmobiles operated on the designated public road above must comply with the head lamps and tail lamp requirements set forth in 75 Pa.C.S.A. § 7741 of the Vehicle Code as well as the provisions of 75 Pa.C.S.A. § 7742 of the Vehicle Code regarding required braking equipment and 75 Pa.C.S.A. § 7743 of the Vehicle Code regarding mufflers and noise control.
Penalties for violation of any of the provisions of the foregoing chapter shall be as are more fully set forth and described in 75 Pa.C.S.A. § 7752 of the Vehicle Code, as amended.
If any section or clause of this chapter shall be adjudged invalid, such adjudication shall not affect the validity of the remaining provisions which shall be deemed severable therefrom.
