As used in this chapter, the following terms shall have the meanings indicated. All other terms used in this chapter shall have the same meanings as those terms are defined in the Liquor Code, 47 P.S. § 1-102.
INTENT TO CONSUME
Includes any of the following:
A. 
Drinking from the container.
B. 
Possession with movement of the container to the mouth.
C. 
Possession with alcohol on the breath of the possessor.
D. 
Any circumstances evidencing an intent to ultimately consume on any public lands without permission.
POSSESS
Exercise of dominion over the container or beverage.
It shall be unlawful for any person to consume alcoholic beverages on the sidewalks, streets, avenues, alleys, parks, playgrounds, parking lots, shopping areas or other public places within the Township of Lower Yoder.

It shall be unlawful for any person to possess or transport with intent to consume any alcoholic beverages in an open container or a resealed container, which had previously been opened, on the sidewalks, street, avenues, alleys, playgrounds, parks, parking lots, shopping areas or other public places within the Township of Lower Yoder.

This chapter shall be enforced by action brought before a District Justice in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. Any person who violates or permits the violation of this chapter shall, upon conviction in a summary proceeding, be punishable by a fine of not more than $1,000, or by imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues, or is permitted to continue, shall constitute a separate offense. Each section of this chapter that is violated shall also constitute a separate offense.
